Will

In the name of God amen I Joanna Stith of the County of Hanover, widow, do make this my last will and testament in manner following: I give to my son Bassett Stith my negro boy named Billy a boy named Henry and a Girl Betty to him and his Heirs forever. I give to my daughter Elizabeth my best Bed and Bedstead, two pair of best sheets, three best Blankets my best Quilt my best dressing table and Glass and all my wearing apparel. I give my Land Slaves and other estate of every kind to my Executors and the survivor of them and his Heirs forever in trust for the following uses and purposes, that is to say, that they or one of them shall and will as soon as is convenient and proper after my death sell and dispose of the same in such manner as they or either of them shall think best and out of the money arising from the sale in the first place, pay and satisfy all my just debts and funeral expenses and after they are satisfied, pay one third of the money remaining unto my son Bassett, unto whom I give the same forever the other two thirds of the said money to be placed out at Interest on good security and one half of the Interest to be paid annually to my son John during his life, and if he should leave any child or children at his death I give one half of the principal so to be placed out to such child or children to be equally divided between them if more than one but if he should leave no child living at his death then I give the said one half of the principal to my son Bassett forever, he paying to my daughter Interest for half of it during her life, the other half of the Interest of the money so lent out to be applied to the clothing and maintaining my daughter Elizabeth during her life, and at her death the principal of it to be paid to my son Bassett to whom I give the same but he is to pay my son John Interest for one half of it during his life, if he should survive the said Elizabeth, and if my son John should leave any child or children at his death such child or children are to have half the said Elizabeth's principal money to be paid them by the said Bassett, and if my son Bassett should die before me without child living at his death then what I have devised to him is to be equally divided between my son John and daughter Elizabeth, that is they are to have the Interest thereof divided between them for life, and the survivor to have the whole Interest for life, and the principal to go to the child or children of my son John if he should have any living at his death, or if not then I give the whole money arising from my estate at the death of my surviving child provided they all die intestate to my niece Elizabeth Rickman forever but if my son Bassett should leave any child or children who shall survive me such child or children to have what is herein before given to the said Bassett to be equally divided between them if more than one. My reason for leaving my daughter the Interest only for life is that I do not think she can marry to advantage on account of her misfortune in wanting sight and would not wish to tempt any person to make her more unhappy by marrying her for the sake of the little fortune I could give her and I earnestly entreat her brothers to be kind to her and take all possible care of her while she lives. And whereas I am security to my son John to sundry persons and have advanced money for him, I therefore desire that what I have paid or my estate may be obliged to pay for him be included in his part of my estate, so that if any loss accrues on that account it is to be deducted from the share of that principal allotted for his use and not fall on my other children but my executors are nonetheless to endeavor to recover it or secure it from him so that it may go according to my will. Lastly I appoint my brother Col. Burwell Bassett Mr. Peter Lyons and my son Bassett executors and trustees of this will. I desire my estate may not be appraised nor security demanded of my executors and that I may be decently and plainly buried in a vault to be prepared for that purpose agreeable to my verbal directions. In witness whereof I have hereunto set my hand and affixed my seal this twenty ninth day of October in the year of our Lord one thousand seven hundred and eighty five

At a monthly Court of Hustings held for the City of Richmond at the Courthouse the ninth day of June 1800 this last will and testament of Joanna Stith deceased was proved by the oath of John Lyons a witness thereto and ordered to be recorded.
