Basic transcription of document: In the name if God amen, we Jacobus S. Davis and Elizabeth Davis (husband and wife) of the Town of Marbletown, in the County of Ulster and State of New York, being in health and perfect memory (Blessed by God therefore) Do this eighteenth day of April in the year of our Lord One thousand Eight hundred and fifteen, make and publish this our last Will and Testament in manner following. Whereas We the said Jacobus S. Davis and Elizabeth his wife, have our lands situated in such a manner, as to render it inexpedient to dispose thereof seperately without great prejudice--therefore have mutually agreed and concluded to make this our joint Will and Testament. and whereas the said Jacobus S. Davis has conveyed a certain tract of land, situate in the Town of Solon in the County of Onondaga, unto his Son Samuel, therefore consider that with many other gifts heretofore made, to be his full proportionable part of our estate--Therefore firstly we give and devise unto our Son James-All that Southeasterly? part of the Land now in our possession, situate at Ashocan in the Town of Marbletown aforesaid-Beginning at a Rock marked J.D. 1810 on the South bounds of a Wood Lot of Land of Thomas ?anden, and trees(?) from thence South Twenty and a half degrees West, to the Ashocan Road, Then South sixty seven degrees West, to the bounds of Lands of Henry Broadhead, hereby comprehending all the Lands we own Southeasterly and Easterly of the described Lines Coutaining about ninety two and ahalf acres to him the said James his heirs and assigns forever, ? deference had to the annexed map Will more plainly appear provided nevertheless, and upon the express condition that the said James shall be as the one third part of the cost and expence of well and sufficiently maintaining our unfortunate Son Jacob-And pay unto our Grandchildren the children of our deceased Daughter Barbara-And to our Daughters Elizabeth the Wife of Benjamin Buley-And Elshe the Wife of William Miricle?, or to their heirs after the decease of said Son Jacob the sum of One hundred and fifty Dollars--that is to say--unto the Said Children of Barbara fifty Dollars in four equal payments of twelve Dollars and fifty cents yearly and every year until the said sum of fifty Dollars be paid--And to Elizabeth the sum of fifty Dollars, also in four equal payments of twelve Dollars, and fifty cents yearly and every year until the Same be paid--And to Elshe the sum of fifty Dollars in like payments of twelve Dollars and fifty cents yearly ---Secondly we give and devise, unto our Son William and to our Grandson Thomas Son of deceased Son Thomas, equally share and share alike, and to their respective heirs and assigns all the rest and residue of our Real Estate, which is not herein before given to James, upon this express condition that our said Son William shall occupy and possess the whole thereof, until the Said Thomas shall arrive to the age of twenty one years, providing also, that he the said William shall keep and support the Widow of my deceased Son Thomas/ if she remains his Widow-And my said Grandson Thomas and his sister Catharine until the said Thomas shall arrive to the age of twenty one years-And providing also that my said Son William pay unto our Daughters Sarah the Wife of Matthew Keator, Sally the Wife of Henry Keator, and Jean, the Wife of George Keator or their heirs, after the Death of my said son Jacob the sum of fifty Dollars a pieces in four equal yearly payments, and be at the cost and expence of two thirds, of maintaining our said Son Jacob--And providing also on the part of our Grandson Thomas, that he the said Thomas when he arrives to the age of twenty one years pay unto his sister Catharine or her heirs the sum of One hundred Dollars; and also be at the one thirdpart of the cost and expence of supporting and maintaining the said Jacob, which one third part is to be at the relief of the said William. Thirdly We give and bequeath unto our Said Son William and Grandson Thomas, two houses and the farming utensils whatsoever. Fourthly-All the rest and residue of our personal Estate which is not herein before given, we give and bequeath unto James, William and Grandson Thomas, Elizabeth, Elshe, Helena, Sally + Jean each the one ninth part thereof. And the other one ninth part thereof unto the children of our dec'd Daughter Barbara. Lastly We do hereby nominate and appoint our said Sons James and William, and our son in Law George Keator Executors of this our Last Will and Testament hereby revoking all former Wills by us made. In Witness whereof We have hreunto put our hands and seals the day and year first above written. Signed, sealed published and declared by the Testators as and for their Last Will and Testament. In the poresence of us, subscribed as Witnesses-Note on the 15th line the word our + on the 29-line the Word Dollar interlined 2nd page the Word Barbara obliterated--.Jacobus S. Codicil made the third day February in the year of our Lord One thousand Eight hundred and nineteen, to the Last Will and Testament bearing date the 18th day of April 1815 of Jacobus S. Davis ( and wife) Elizabeth Davis-First-We do hereby give + devise all the Lands given to our Son James in and by said Last Will and Testament unto our Executors therein named, in trust, for his support and maintenance during his life, and after his death, We give and devise the Same unto his Children providing that my Said Executors pay out of said Estate therein given to my said Son James the sum or sums of money as is mentioned to be paid by him at the times therein mentioned--We do hereby give and bequeath thereunto the heirs of our deceased Daughter Barbara, and Daughters Elizabeth, Elshey, Helenah, Sally and Jenetah?All our personal property whatsoever to be equally divided between them my said Daughters, excepting the farming Utensils and a pair of horses, which is in said Will given to our Son William and Grandson Thomas. And we also hereby further order and devise that our Grandson Thomas in Lieu and Stead of one hundred Dollars to be paid to his Sister Catharine, that he shall pay the sum of fifty Dollars to her at the time therein mentioned. And we do further declare that this shall be part of our Last Will and Testament--In Witness Whereof we have hereunto set our hands and seals the day and year above written--Note the word Barbara on 16th and word pay on 24. line first Interlined. Codicil written February 19, 1819. Codicil written by both spouses, thus Jacobus S. Davis dies after February 19, 1819. [2]

This Will lists children, both living and deceased. Deceased children listed: -Barbara Davis, spouse of ? -Thomas Davis, leaving behind his own children Thomas and Catherine.

Living children as of 1815: -Samuel Davis. -Jacob Davis (might have died before Codicil written in 1819). -James Davis -Elizabeth Davis, wife of Benjamin Buley or Bulay. -Elshe Davis, wife of William Mericle (Merckle). -William Davis -Lenah, wife of Mathew Keator. -Sally, wife of henry Keator. Her birth name is Sarah, Sally is nickname. -Jean, wife of George Keator. Her birth name is Jannetje.

Research Note

  • On May 2, 1777, Jacobus S Davits/Davis gave a sworn deposition [3] relating to The Marbletown Disaffection of 1777. In the depositon, he reports how he went with some men to his father's home to convince his brother, Jacob, not to join up with the group. He failed and his father gave his permission for his bnrother Jacob to go with the men. Jacobus reports being disappointed at this. More reserach is needed.
    • Jacobus was made administrator of Jacob's estate on 18 Sep 1790, after he died intestate. He is listed as "Jacob Davis, late a private in Col. DuBois's Regiment" [4]
