Janet Fleming was born a daughter to Malcolm Fleming, 3rd Lord Fleming. [1]
Although Balfour Paul suggests she was legitimate it is highly improbable. She is known to have married Richard Brown, son and heir-apparent of Andrew Brown of Hartree, an estate in Peebleshire and likely a subordinate laird to Lord Fleming. He had a precept of sasine from his father-in-law, Lord Fleming, of the 5 pound lands of East Hartree on 23 September 1536. Thus they were married before of in September 1536. While it could reasonably be assumed she was young it must also be assumed she is older than 10, her father marrying in 1525. It seems more reasonable that she was born c. 1520 and thus illegitimate. William Hunter, family historian, also notes that Lord Fleming had two sons and five daughters by his wife Janet Stewart, and also several illegitimate children, this Janet must have been one of those.[2]
