Josiah wrote his will 2 Nov 1816 in Pendleton Dist, SC. He died five years later in Greene Co., AL. His will was proved 27 Aug 1821. [1] In his will he gave half of his estate to his wife, Polly, and the other half to his brothers and sisters and their heirs. The estate was settled after the death of Polly Foster in 1835. Josiah had two surviving brothers, George S. Foster and R. S. C. Foster, and two surviving sisters, Nancy Perry and Mary Hendley. His brother John C. Foster, deceased, had the following heirs: George E W Foster James R W Foster Josiah M C Foster Jared Kirksy in right of his wife Parthenia Dempsey Bonner in right of his wife Harriet. John S B Foster was deceased and had heirs [all of Mississippi, widow Polly T Foster], Robert Foster, Landon Foster, Pamelia Kirksey w/o E B W Kirksey, Elisha B W Kirksey and wife Parmelia[?]. Nelly Kisksey [wife of Jehu Kirksey] was deceased and left heirs: Jno M B Kirksey, E B W Kirksey, Ro: B W Kirksey, Foster M Kirksey, Isiah J Kirksey, Ciciro L Kirksey, Mary E P Foster now Mrs Hale and wife of S F Hale. His sister Frances (Foster) Grant was deceased and left six children: Green W Grant, Jno F Grant, Mary Robinson, Nancy Grant, Reuben H Grant, Richd Harris and wife Eliz.[2]
