Simon Davis died between February 27, 1777 when his will was dated and April 2, 1777 when it was lodged with the court. Here left beqests to: [11]

  • wife Hannah, executrix (declined in favor of son Nehemiah)
  • son Nehemiah, executor with Hannah
  • son Simon
  • daughter Elizabeth Brooks
  • daughter Lucy Farrer (wife of Oliver Farrer)
  • daughter Mary Davis
  • daughter Hannah Brook (wife of Samuel Brook) [11]

On September 9, 1777, John Winthrop, sq., Judge of probate, did disaprvoe and disallow the above will citing as insufficient by having two witnesses rather than the required three by state law to disperse real estate. [11]

October 4, 1777: Simon Davis and Katharine Davis of Acton submitted a letter to the court indicating their acceptance of their late father's will and asked that set up by the court. [11]
October 4, 1777: Elizabeth Brooks of Acton wrote a similar request to the court regarding her late father's will and estate. [11]
On the same date, Mary Davis, spinster of Concord also wrote to the court, accepting her father's will as written. [11]

Judge Winthrop ascertained from the witnesses that they were present at the writing of the will and testified to Simon Davis' soundness. In light of the above letters, and noting that the remaining heirs had quitclaimed their rights, the judge then revoked his previous ruling, and allowed the will on October 7, 1777. [11]

On June 7, 1782, the selectman of Concord determined that Hannah Davis, widow of Simon Davis was 'non compos' due to her advanced age and unable to take care of herself or her property. They appointed Captain David Brown as her guardian. [13]

On June 12, 1782, the court appointed a committee and ordered that Hannah's estate be inventoried. Her personal estate was assessed at L 48:11:6 and lands at L347: 1: 6 which included her one third dower from Thomas Brown as well as lands left to her in Simon davis' will. [13]

Mrs. Hannah Davis died December 1, 1782. [1] [14]

On March 17, 1783, the court appointed a committee to reappraise the real estate of Thomas Brown, deceased, granted to his widow Hannah as her one third dower to be reverted, as she is now also deceased. The committee determined the the real estate could not be divided fairly, without prejudice and recommended that the whole be settled on eldest son Ephraim Brown. [4]
