Research Notes

Notes for JOHN SHELTON: On file in the records of the Goochland County, VA, Chancery Court are lawsuits brought by Joseph Shelton and by William Shelton through their guardian, Thomas Prosser, in 1735 against their brother, John Shelton, to obtain slaves from the estate of their father, John Shelton. This suit states that their father, John Shelton, died intestate in 1725, names all of the children and specifies that John, II, was eldest son and heir-at-law. The other sons were David Shelton, Joseph Shelton, William Shelton, and Thomas Shelton and his three daughters were Ann Shelton, Mary Shelton and Elizabeth Shelton. See Goochland Order Book 3, pages 347, 365, Library of Virginia Chancery Record Index Goochland County 1735-002 and 1735-003.

This man is held to have been the builder of Rural Plains. The results of the official dendrochronology of the National Park Service dated the basement joists 1723 and the roof beams 1725. Therefore John apparently died in the same year that Rural Plains was being completed.

The Vestry Book of St. Paul's Parish of Hanover County, Virginia, 1706-1786, has on page 1 that it was "ordered that John Shelton officiate as Clerk until January next" for which he was to be paid two thousand two hundred pounds of tobacco. The date of this occurrence was not readable due to aging of the original Book. However, on Page 3 of the Vestry Book there is a reference to "New Kent County".

The first date in this book which was still readable was on page 5 and the date was for a meeting held on January 10, 1705. On page 7 of The Vestry Book is recorded that John Shelton was appointed Reader for 12 months and this appointment was dated September 9, 1705.

John received a patent in 1723 for 1,198 acres and 44 poles of land "lying and being on both sides of Owen's Creek in the County of New Kent and one corner joining the South Ann of the Pamunkey". (Transcriber's note: Hanover County was cut out of New Kent County in 1721 which means that the filing process on this land began while the area covered by this patent lay in New Kent County but by the time the grant was awarded, the land was in the newly erected Hanover County. Louisa County was cut out of Hanover in 1742 and some of this grant land fell into Louisa County at that time.)

Mildred Campbell Whitaker and others erroneously place a William Shelton married Hannah Armistead on the line instead of the actual William who married Elizabeth Rogers and in their version William and Hannah are the parents of the John who that married Eleanor Parks. The will of William who married Hannah Armistead is on file in York County and shows two facts which are beyond dispute: (1)his surname was “Sheldon”, not “ Shelton” (2) that he had no children, leaving his estate to a nephew. As per research notes, this John Shelton appears to be the son of John Shelton d. 1725, not William Shelton. Additional info at http://npshistory.com/publications/rich/hsr-shelton-house.pdf p. 20, 50/509.

Also, record of him ending guardianship in 1734 from Allen Howard. https://www.familysearch.org/ark:/61903/3:1:3QS7-99P6-3SZN?i=107&cat=365146 p. 193

John Shelton d. 1777 was supposed to be originally under the name of Chilton in War records which caused much confusion to early genealogists. If in fact the gentleman killed in action at Battle of Brandywine was a Shelton this would have been on one of the days around the 11 September 1777 action at Chadds Ford Township, Delaware County, Pennsylvania 39°52′19″N 75°35′24″W This location is very near Chadd's Ford at the Brandywine River crossing under US 1 in modern day West Chester, Chester County, Pennsylvania a few miles over the line from New Castle County, Delaware. If his birthdates listed in a range of 1705-1713 are accurate doing the math he would have been somewhere between 64 and 72 years of age. However, this is not the correct derivation, apparently John Chilton was the Capt of 3rd Virginia Continental Line KIA 11 Sept 1777 at the Battle of Brandywine (Defense of Philadelphia Northern Campaign). He was the son of Thomas Chilton and Jemima Cooke of "Rock Spring" Westmoreland County (later Fauquier County) and was born in 1739 according to an article in the William and Mary Quarterly. Capt Chilton is buried with many other patriots at the Birmingham-Lafayette Cemetery http://blcemetery.com/ near Chadd's Ford. His will specifically mentions "Capt. 3rd Virginia Regulars". This will is enclosed in his Rev War pension records dated Aug 1776. His surname is spelled Chilton/Chelton mostly in the records but at one point Shelton. See documented on p 58 of the W&M Quarterly article "Chiltons & Sheltons-Two Distinct Virginia Families". Shelton-829 and Shelton-116 appear to represent the same person because: same birth date/place; same father William Shelton
Hannah (Armistead) Shelton could not have been 8 years old at the birth of John.
