1791 Virginia Court Reports[2]
The guardianship records discussed below are for a Joseph, son of John Shelton, who died 1725 (MDCCXXV, ?), leaving 9 children. This profile instead attaches father William Shelton.
Joseph's birth date range is based on lawsuit filed by his guardian in 1734 in Goochland County, VA:
Thomas Prosser and Elizabeth his wife administratrix of John Shelton deceased.
Joseph never married. His will is recorded in Louis County, VA, Will Book 3, p. 29. The will was written in 1770 and Joseph died in 1784. His estate was the cause of a lawsuit, decided in 1791 and recorded by Bushrod Washington in "Reports of Cases Argued and Determined in the Court of Appeals of Virginia, Volume I. The case is on pages 54 through 69 and is entitled: Of the Year 1791, David Shelton, William Shelton, and Samuel Shelton, Executors of Joseph Shelton, Deceased against John Shelton. The children of John the Elder were named and also the sons of John, Jr. On page 58 is the statement that "His (Joseph) male relations (in 1770) were three surviving brothers (David, William and Samuel) and two nephews, sons of his elder brother and heir (John) who was dead". This is fortunate because almost all of the records of the Clerk's Office of Hanover County, VA, were destroyed in The Civil War and other castrophes.
This Report by Washington gave the surviving siblings of Joseph: 1. David Shelton of "Old Town", near Orchid, Louisa County 2. Samuel Shelton of Nelson County and, lastly, Albermarle County. 3. Joseph Shelton, bachelor, on Owen's Creek, Louisa County 4. John Shelton, "Rural Plains" Hanover County. 5. Mary Shelton of Hanover and Goochland Counties. She married (1) George Raine and (2) William Trueheart. The Inventory of Joseph's estate is found in Louisa County Will Book 3, page 95. Total amount was 7,199 pounds, 31 shillings, 12 pence.
From "Sketches of Virginia" by Foote, 1850, page 168. Record of the General Court granting permission for a "dissenting minister" to meet a congreation of Protestant Dissenters at the meeting house(s) to be erected on the land of Joseph Shelton near Owen's Creek in the County of Louisa.
In the book "The Cabells and Their Kins" by Alexander Brown, published 1895, reprinted 1939, page 50: List of first Court of Louisa County, VA, Dec. 13-24.
