Biography

John Warburton was of Arley and Warburton, Cheshire.[1] He was the son of Piers/Peter Warburton[2] and his second wife Ellen Savage.[1]

John was the brother of Piers Werberton who was living in 1510-1511.[2]

On the death of his father, John inherited the title of Seneschal of Halton, Cheshire.[3]

John was knighted in perhaps 1497.[4] He became Knight of the Body to King Henry VII, and Sheriff of Cheshire, with a brief interval during this period, from 1495 to his death in 1523.[1] [5]

In 1513, John is said to have fought against the Scots at the Battle of Flodden Field.[3]

John married Jane Stanley.[1] They had at least six children:

  1. Piers Werburton,[2] [6] (Peter Warburton, Knt)[1] married Elizabeth Winnington,[7] [8] daughter and heir of Richard Wynyngton, esq, while both were in their minorities;[2]
  2. John Warburton,[2] [1] married Emma Golborne;[8]
  3. Jane Warburton, married William Turvyle, Knt;[1][8]
  4. Douce Warburton,[6] [9] [2] married John Starky[1] (Starkie);[8]
  5. Ellen Warburton,[6] [2] [9] [10] married John Carrington,[1] (Ormerod calls her Margaret;[8])
  6. Blanche Warburton,[6] married William Davenport, Esq.[1][8]

John had three illegitimate children by a mistress, Sibyl Starky, whose brother was Richard Starky:[1]

  3. Geoffrey.[1]

In 2 Henry VIII [22 April 1510-21 April 1511], John Werberton, Kt, and William, Bishop of LIncoln, enrolled a deed at Chester, covenanting that Piers Werburton, son and heir apparent of the said Sir John should marry Elizabeth Wynyngton daughter and heir of Richard Wynyngton, Esquire, deceased; that if Piers died before the consummation of the marriage, then John Werburton, brother of the said Piers, should marry the said Elizabeth; the said John should make an estate in fee-simple, of lands in Appulton, to the value of 20l yearly, to George Bromley, Ralph Birkened, Roger Maynwaryng, and Thomas Smythe to the use of the said Piers and Elizabeth for life, in survivorship, with remainder to the heirs male of their bodies, with remainder over to the uses set forth in the entail made by Piers Werburton father of the said John, with respect to all his lands; the said Sir John should take the profits of the said lands until the coming of age of the said Piers and should pay to the Bishop 400 marks in yearly payments of 26l 13s 4d to commence on Elizabeth attaining the age of 14, and to cease on her death without heirs by Piers; all Sir John's manors, lands, &c., on his death should descend to the said Piers and his heirs according to estate tail by Piers Werburton, esquire, father of the said Sir John, excepting those lands charged with the jointure and dower of Dame Jane wife of the said Sir John, those charged with an annuity to Piers Werberton brother of the said Sir John, those to the value of 20 marks intended to be given by the said Sir John to John his second son, those held for life by John Werburton uncle to the said Sir John, those assigned for the marriage of Glyn or Dowte his daughters, and those to the yearly value of 20s to be given for the maintenance of a priest to sing at the alter of St Katherine in the parish church of Budworth. The Bishop was to deliver to the said John all grants of the wardship and marriage of he said Elizabeth which he had received from King Henry VII, and all leases he had of the King pertaining to Elizabeth's inheritance.[2]

Also in 2 Henry VIII [22 April 1510-21 April 1511], John Werberton, Kt, made his Will, conforming with the above deed.[2]

On 20 April, 1519, Peter Warburton, son and heir of Sir John Warburton, Sheriff of Cheshire, granted to his father, Sir John, all manors, lands, tenements, and rents in Cheshire or elsewhere possessed or seised in the right of Elizabeth, daughter of Richard Winnington, for the preferment and advancement of Peter's sisters, Blanche, Ellen, and Dowce, except for the manor of Marthall.[6]

Death

John died a little before 19 October 1523.[1]

After his death, Piers (Perys) Warburton, esquire, son of John Warburton, knight, from Cheshire, sued Sibyl Starky, 'gentylwoman which was paramoure unto the seid Sr John' for detention of deeds relating to the manor of Warburton and other lands, which Piers claims as heir of his father and in right of his wife Elizabeth, daughter of Richard [Mydylton? This document is mutilated and partly illegible],[7] It should be Wynnington.

Also, Jane, late the wife of John Werburton of Sutton, knight, from Cheshire, sued Sibell Starky of Stretton, single-woman, for a third of her said husband's goods and chattels 'unleafully spoyled' at Sutton, no part given to her or to Elyn and Dowse, his unmarried daughters.[9]

On 8 September, 27 Elizabeth [1585], Peter Warburton of Arley, esq, conveyed his manors, premises and other properties to John Egerton of Oulton, Peter Warburton of the Northwich, esq, and other to the use of himself and the heirs male of his body, with contingent remainders, in default of such, to the heirs male of the body of his father, Sir John Warburton kt, deceased, of his grandfather, Sir Peter Warburton kt, deceased, of his great-grandfather, Sir John Warburton kt, the right heirs of the said Peter Warburton of Arley, for ever.[11]

Research Notes

Children

Ormerod's History of Cheshire says there were two other children of John Warburton and Jane Stanley - an unnamed son and an unnamed daughter.[8]

WikiTree has previously shown three other people as children of Jane Stanley and John Warburton: Elizabeth, Agnes Ann and William. All three profiles are effectively unsourced. No good source has so far been found for the relationships, and they have been detached. Cayley-55 10:22, 15 July 2020 (UTC)
