On 6 January 1761, Matthew Agate exhibited his will to the probate court. On 4 March 1761, John Egerton and Eleazer Waterman objected to proving the codicil of the will, the court however approved both the will and codicil after hearing evidence. They appealed.[1]
His will is dated 29 September 1739 with a codicil dated 2 April 1760 and proved on 11 March 1761 in Norwich. He mentions two grandsons, Thomas and Jonathan, sons of Thomas Agate (his eldest son), his son Matthew, his daughter Rebecca ("for special reasons to me known"), his daughter Mary, Hannah, and Martha, his deceased daughter Ruth. The codicil mentions that the above grandson Jonathan is deceased and gives his share to his brother Thomas, Jr.[1]
His inventory was completed on 16 April 1761 in Norwich.[2]
