Grandfather, Robert Lockhart's Will

May 9 1817

I, Robert Lockhart, living on Back Creek, Frederick County, Commonwealth of Virginia, make this my last Will and Testament in manner and form as follows: Item, I give and devise to my daughter, Ann McNeil, that tract of land which I have rented to Abraham Hawks during his life on Mill Creek, Hampshire County, Virgina, which rents for $130.00 per year, containing upwards of 500 acres that I purchased of Cline, party of Bush and Mitchell survey.

Item, I give and devise to my three grandchildren, Robert L. Wright, Sarah Ann Wright and Rebecca Margery Wright, all that tract of land on the drains of Mill Creek, in Hampshire County, the greater part of which is rented to Sanford and Hawks for life, the balance unimproved, about 700 acres, together with about eighty acres where Hawks not lives, which I purchased from Engle; also 22 acres near or adjoining the last, with all I purchased of Lewis Vandever near 700 acres, now in tenure of Greenville, also a Negro wench called Little Beck. This devise is on condition that they pay my wife annually $50.00 during her life. [Total acres in Hampshire county left to the grandchildren: 700+80+22=802=]

Item, I give and devise to my daughter, Sarah Baker, to her and her son, Robert Lockhart Baker, after her decease, that farm near Kernstown [partly located within independent city of Winchester and part in the county of Frederick], containing about 320 acres, the greater part of which is now in tenure of Walter Bell. I also give her Negro wench, named Alice and Negro boy, Ruben about seven or eight years old, on condition that she pay my wife $30.00 annually during her life, if she requires it.

Item, I give and devise to Thomas Lockhart, son of Josiah Lockhart, the balance of that tract of land his father lived on lately in Adams County, Ohio, 500 acres more or less.

Item, I give and devise to my son Josiah the several tracts of land I now live on in Frederick County, on Back Creek the old place of 300 acres; that which I purchased from Caleb Seal for 330 acres; that on Timber Ridge purchased from Roustes of 239 acres, will all my Negroes and all my United States Bank Stock, excepting the Negro that are otherwise devised. I further give and devise to my daughter Ann McNeil, a bond passed by me, for $l,000.00 by Georger Harness 3rd, and Peter Hutton, payable on the 6th of last May past, provided that Ann McNeil does agree to abide by this my will without dispute or lawsuit. Should either of them or both of them dispute or institute a lawsuit, then this obligation of $l,000.00 is to belong to Sarah Baker.

It is my will that my plantation near Round Hill containing about 130 acres in tenure of William Campbell, together with the tenement of Tucker rents from me on North River in Hampshire County, be sold by my executors immediately after my decease and the money arising from the sale be divided between the three eldest, surviving daughters of my son and sons-in-law; my son Josiah Lockhart's daughter, Sarah Baker's daughter and John Wright's daughter which is a daughter of my daughter Rebecca.

It is my will that my son, Josiah will give and support his mother during her life in every manner, accommodating necessary for a woman of her age, and to pay her annually $100.00 during her life and further, for my son Josiah is to pay all debts.

I leave my wife Margery, two Negroes, namely Big Beck and Bole during her life and at her decease, then to Robert Lockhart, son of Josiah.

It is my will that all my heirs to whom I devised land, shall receive the rents that may be due on said lands. And should any of the advisees dispute or go to law about anything devised to the, or not abide by, or not agree; to this my Will and Testament, then in that case my daughter Sarah Baker is to pay each that do not agree with this my Will, 10 pounds and she shall be entitled to their share or shares. I further give and devise to Robert L. Wright, Sarah Ann Wright and Rebecca Margery Wright, $800.00, which sum I have deposited in the hands of Joseph Baker for that purpose, in one year after may decease.

Lastly, I do hearby name my son Josiah Lockhart and my son-in-law, John Wright and Joseph Baker as executors of this my Last Will and Testament, and empowering them or the survivor of them to make conveyance of all my lands, which that may be lawfully sell under this, my Last Will and Testament, thereby revoking all former will and testaments by me heretofore made.

In testimony whereof I have set my hand and affix my seal, this the 9th day of May 1817.

On the 16th of May, 1817, Josiah Lockhart gave bond[1] for $40,000.00 with George Smith and Samuel Swayne as securities. John Wright gave bond for like amount, with Charles Magill as security.[2]
