Joseph Barker's Will, written March 27, 1854, Probated May 10, 1858, Henry County, Virginia: In the name of God, Amen. I Joseph Barker of the County of Henry and the state of Virginia, being of sound mind and disposing memory, make this my last will and testament in form following: That is to say first of all, I desire all of my just debts and funeral expenses to be paid, then I give and bequeath to my son Daniel Barker one dollar. I also give and bequeath to my son Joseph Barker one dollar. I also give and bequeath to my son Burwell Barker one dollar. I also give and bequeath to my daughter Nancy Creasy one dollar. I also give and bequeath to my son Guilliams Barker one dollar.

I give and bequeath to my daughter Isabel Dyer, alias Isabel Wilson, the house and lot where unto I now live, for and during her natural life and with the privilege of wood and Water The said house and lot not to be rented out by her. Neither is she to be permitted to bring any person to occupy said house and lot than herself and child Nancy Jesting, and at the death of said Isabel, it is my will and desire that the said house and lot be given to my son Henderson Smith Barker.

I also give and bequeath to my son Henderson S. Barker, fifty-five acres of land embracing the said house and lot given to my daughter Isabel during her natural life, and adjoining a tract formerly owned by John Henry Creasy and sold by him to Henderson S. Barker and Guilliams Barker, to him the said Henderson S. Barker and his former wife.

I give also to my Henderson S. Barker one bed. I give and bequeath the said Louisa Jane one walnut chest, supposed by some to be cherry. Also to the said Louisa Jane one clock and case, one new side saddle, one cotton or spinning wheel and one droping table (walnut).

I give and bequeath to my granddaughter Eliza Ann Dyer sixty-seven acres of land embracing my house in which I now live adjoining the lands of Benjamin Jones and Allen Barker, for and during her natural life and then to the heirs of her body, should she leave any at her death; but should the said Eliza Ann die without leaving any heirs, then it is my will that the said sixty-seven acres of land should be equally divided among my granddaughters Louisa Jane Barker, Virginia Barker and Pernetta McDaniel. It is my will that the dividing line between my son Henderson Smith Barker and my said granddaughter Eliza Ann Dyer shall commence at some point on Abner Martin's land and northeast of this my land and run a southwesterly direction so as to divide my land between my said son Henderson Smith Barker and my said granddaughter Eliza Ann Dyer, as above denoted as to quantity embracing this whole of the lands owned by me.

I also give and bequeath to my said granddaughter Eliza Ann Dyer, the remainder of my household furniture not bequeathed above. My kitchen furniture, also my stock of every description, also my will that the articles above willed to my granddaughter Louisa Jane Barker be left in the possession of Eliza Ann Dyer until the said Louisa Jane shall become of lawful age or marry. I hereby revoke all former wills and testaments hereftofore by me made and given under my hand and seal this 27th day of March in the year of Christ 1854.

At a court held for Henry County on the 8th day of February 1858 the foregoing paper writing purporting to be the last will and testament of Joseph Barker deceased was produced in court - partly proven by the oath of Richard G. Lampkin, one of the subscribing witnesses thereto and continued for further proof. And afterwards to wit, at a court held for said county on this 10th day of May 1858. The said writing was further and fully proven by the oaths of Aaron Turner and Hopkins Bateman, to have been executed and acknowledged according to the Statute of Virginia. Whereupon it is ordered that said writing be recorded as and for the last will and testament of said Joseph Barker, deceased. Testa : G. Griggs[2]
