Disputed Origins

It has been claimed that John Bates of Virginia was the son of James Bate(s) and Mary Martine. However, evidence shows that this couple's son John was buried 6 Mar 1606, which would mean that James and Mary couldn't have been the parents of John, whose known children don't include a James or a Mary.[1]

John BATES boarded the ship "Southampton" which sailed for VIrginia in Oct 1623 with 30 passengers, while accompanying the Pierseys. Captain Harvey requested permission for trip to Virginia 9 July 1623.[3] John was on the King's Muster, travelling on 20 January 1624/5, to obtain a census of the Royal colony following the liquidation of the Virginia Company. [4]

John Bates was listed in the muster of Abraham Peirsey at Peirsey's Hundred, 1624/5, as aged 24, apparently unmarried. He married Elizabeth ______, named with his four children in his will dated 2 Sept 1666 and proved 24 Jan 1667/8.[5] [6] [7]

Marriage & Children

John Bates married Elizabeth in James City about 1624, but more evidence is needed to confirm Elizabeth's maiden name. Please see the Research Notes.

It appears that their children were born in James City "Incorporation," part of which became Charles River County in 1634. George Bates' record specifies Bruton Parish.

I John Bates of the County of York in Middletowne parish being very sick and weak yet in perfect memorie do here make my last will and testament.

ITEM I give and bequeath unto my eldest daughter Anne Bellbee one pide cowe called Primrose to be delivered after my decease.

Research Notes

  • Conflation possibly explains the addition of a middle name "Isaac" to this profile, since no burial date is given for Isaac, son of James and Mary. As is known, middle names were uncommon in this time frame and "Isaac" may have been added to preserve the link to James and Mary. It probably should be removed.   • Regarding the spousal identification, Ancestry.com matching and indexing identifies some references merely on the entry of John Bates and Elizabeth Winston's names and living dates, including, which should confirm their relationship and origins:

    • This source states: "It is said that he married Elizabeth Winston; however the only reason for this conclusion appears to have been the fact that William Winston witnessed the will of John Bates. As genealogists, we use the name that the person used. To distinguish the generations when the person did not use any extension or suffix, we use dates to distinguish between the generation (note: specific dates are used here and no source is attached to explain that level of specificity). Per Jamestowne Society and per his will, he did not use 3RD. He was plain old John Bates. The 3RD suffix should not be part of his name (and similarly, 1ST probably not as a part of his grandfather's name, nor 2ND as his father's). No one has ever - to my knowledge and experience - written those designations in caps, and it is especially inappropriate when we have no indication that any sort of a suffix was used (with the exception of this generation having a son using Jr).

Note also reconciling his vital dates with what Jamestowne Society says is important: "born 1601, died 1667/8, York Co.; (Ancient Planter, Muster of 1624/5)." Granted the probate date may be where 1667/8 is derived.

Please also note that the first source citation probably should either be moved to the actual discussion (so that it doesn't show up in the Sources list) or else clarified that it supports the disproval of the parents named in the source; otherwise, it is misleading (and is only important because it disproves the parents named by some because the vital dates don't correspond).

Also regarding origins, some statement should be made as to why he is attached to the father to whom he is attached, especially because a disputed origins section is used.

Lastly, nowhere are any apparent sources that say he had a middle name of Isaac. That undocumented middle name has already been removed at least once, and yet it has reappeared with no source to indicate that that was a part of his name. If his name is in dispute, then that should be discussed within the narrative.

If Susanna is his daughter, why is she not listed in his will? Does anybody have confirmation of him listing her as his child anywhere?

Though not rising to the level of references, the following two sites provide confirmatory pedigree data:

The latter site has a link for the transcription of the Bates Family Bible (1739-1929) and the Will of John Bates (d. 1666/7). If the Will is completely concordant, then site "Bible" data may be valid/worthy of study. Let me know if you want me to pursue.

It takes a long time to load, as it is from an electronic archive.

What I was able to get to load may be incomplete. The header says:

"Bates Family Bible, 1739-1929: This is a transcription of the Bates Family Bible, now in possession of the Library of Virginia. Some pieces of pages are missing, and some information is no longer legible."

It looks like the first generation recorded in the bible was:

Benjamin and Hannah Bates of York County were married the 1st day of the 5th mo 1760.

So if the PDF that I was able to print (which is incomplete, but goes through: Saml Edward Bates Jr son Saml Edwd & Nille Ann Bates died 20 Sep 1929) is considered to be of any validity, perhaps I should attach it to Benjamin Bates who married Hannah's profile.

Bates-40 and Bates-9334 appear to represent the same person because: same first name, last name, birth year, birth country, same daughter, same death date, same death location.

There is no source documentation for his birthplace or that he had a middle name. We only know he came on the Southampton as a servant to Piersey. He was unmarried in the 1624/5 Kings Muster at Jamestown. His son George was born in 1625 so the marriage happened around that time.

I have deleted the middle name of "Isaac" because there is no documentation of John using Isaac as a middle name, and middle names were extremely uncommon in the early 17th century.

John Bates had several children including the following from my research:

George Bates b May 23 1625 John Bates b Aug 29, 1627 Anne Bates b. 1630 Alse (Alice) Bates b. 1632 Elizabeth Bates Susanna Bates b Sept 30 1635

I can't recall where I found this information as I worked on this portion of my tree several years ago. I have not imported my tree here yet as there are too many matches to go through.

If you have any questions I have a lot of info on the bates line that may help you. :)
