Henry was the son of John Batte and Martha Mallory.[1][2][3] His birth date is uncertain: Douglas Richardson estimates it at about 1643. He was probably born in Birstall, Yorkshire where his father's main residence lay [1][2] and where his older brother William was baptised.[3][4] He was the second son called Henry: the first, Henry Batte-28, was baptised at Birstall, Yorkshire on 13 August 1628[3][5] and buried there on 8 September 1629.[3][6]
Emigration to Virginia
Henry emigrated to Virginia with his father and siblings in 1649.[1][2]
Marriage and Chidren
Henry married Mary Lound, daughter of Henry Lound of Henrico County, Virigina and his wife Ann.[1][2] They had at least the following children:
Martha who married John Peterson - Henry's will refers to a "daughter Peterson":[7] she is not listed by Douglas Richardson[1][2]
Life in Virginia
On 29 August 1665 or 1668 Henry and his brother Thomas were given a patent for 5878 acres on the south side of the James River in Appamattock, Charles City County, Virginia. This was for the importation of 118 persons into the colony, among them, William Bate, Jur. 2 times, Martha Bate, Jno. Bate, Senior, Jno Batte, Junr. Henry Batte, Tho Batte."[9]
In 1679 Henry, described as "Capt.", was granted the administration of the estate of John Peterson, father of the John Peterson whom Henry's daughter Martha married.[10]
Henry was an officer in the Virginia militia.[11] He was a member of the Viriginia House of Burgesses representing Charles City County, in 1685-6,[12][13] 1691-2[12] and 1695.[1][2]
Death and Will
Henry's will was dated 10 June 1695 and proved in April 1699.[7] In it, among other provisions, he:
described himself as of the parish of Bristol in Charles City County, Virgia
gave his wife Mary a life interest in the plantation he lived on and some other his lands, with them passing to his son Henry on her death
left other lands to his sons William and John and his daughters Mary, Elizabeth, Anne, Rachel and Sarah Batte
left a mare and her "increase" [offspring] to his "Daughter Peterson": this will be Martha - she was not bequeathed any of Henry's lands, and one can guess that she may have received her share of them on her marriage
entrusted the residue of his estate to his wife during her widowhood, with her permanently entitled to a fifth. Of the other four-fifths, an eighth was to be paid to his son Henry when he requested it, and the other children were to become entitled to an eighth each when they reached the age of 21. If she remarried, she was to have a fifth, with the remainder divided equally between "my three sons Henry William and John and five daughters Mary Elizabeth Anne Rachell and Sarah Batte".
This page on the web on the Batte family has a lot of incorrect information and should not be trusted.
Wife's Death Date
Richardson states that Henry’s wife died before before 10 September 1720:[1][2] on that date some of her daughters and their husbands made a deed relating to land Henry had owned.[14] Richardson presumably believes this signifies that Henry’s wife died before then, and that this led to lands passing into her daughters' possession. This is, though, not necessarily the case. Under the terms of his will, five of his daughters were entitled to a share of Henry’s lands on his death, and to a share of the residue when they reached 21. Henry’s wife was left a life interest in some of his lands, but his will stipulated that this should pass to his son Henry on her death.[7]

Henry Batte is listed in Magna Carta Ancestry as a Gateway Ancestor (vol. I, pages xxiii-xxix) and was identified by the Magna Carta Project as being in trails to Magna Carta Surety BaronsSaher de Quincy and Robert de Vere that were project-approved/badged in May 2015 and re-reviewed in March 2022. Trails from the Batte Gateways to William d'Aubigny, Robert de Ros and Robert FitzWalter were developed and badged in 2022. The Batte Gateways also appear as Gateways in an second Richardson-documented trail to Saher de Quincy (vol. III, pages 114-123 MALLORY) that was badged in October 2022. The trails are set out below.
See Base Camp for more information about identified Magna Carta trails and their status. See the project's glossary for project-specific terms, such as a "badged trail".

DNA Connections
It may be possible to confirm family relationships with Henry by comparing test results with other carriers of his Y-chromosome or his mother's mitochondrial DNA.
However, there are no known yDNA or mtDNA test-takers in his direct paternal or maternal line.
It is likely that these autosomal DNA test-takers will share some percentage of DNA with Henry:
ooh - transcription of will found!! and another son... "three sons Henry William and John and five daughters Mary Elizabeth Anne Rachell and Sarah Batte"
Please add a source (pre-1700 profile) for Henry's birth and death, and him being the father of Martha. The FindAGrave memorial appears to be unsourced for each of these facts, and lists the daughter as Mary instead of Martha.
A merge was proposed with Batte-33, which notes that there is no support for a daughter of Henry named Martha (or Mary), m Peterson. The profile for Martha/Mary (Batte) Peterson - Batte-59 - has been detached from this profile in anticipation of that merge. As posted in a 2015 comment on her profile: records indicate five daughters of Henry & Mary (Lound) Batte in 1720... This Martha was alive in 1720 & was not among them. Therefore, I'm detaching her as a daughter.
Ken - That Order Book transcription of Henry Batte's will that I just posted about... it came up because he says in it "my daughter Peterson":
Item I Give and bequeath unto my five daughters Mary Elizabeth Anne Rachell and Sarah Batte all my Lands lying upon the second swamp of the Blackwater being twelve hundred Acres to be as Equallie devided amongst them as may be according to quantitie and quallitie to them theire heires and assignes forever
Item I Give unto My Daughter Peterson my Mare Runing at the plantacons with her Encrease forever
SO.... There now IS support for a daughter who married a Peterson (and it couldn't be Mary, since she's named with the four other girls still "Batte"). I'll reattach Marth and remove the warnings!!
removed Anne (Batte) Spain & left the following note on her profile: The profile for Anne (Batte-163) Spain was disconnected from parents Henry & Mary (Lound) Batte. The daughter of Henry Batte and his wife Mary Lound named Ann married Edward Stratton. A daughter of John Peterson, who is said to have married a Batte (supposedly Martha), is named "Mary Spain" in his will.
oh dear. Changing name to Mary & moving to be the daughter "Mary Spain" named in John Peterson's will won't work, since the LNAB of "Ann Spain" is Batte. Since she's attached to the Spain family, I think it's better she stay attached to them but lose parents Henry & Mary (Lound) Batte. Unless I hear otherwise (with sources!), I'll detach Anne (Batte-163) Spain from Henry & Mary. Sorry about the (well, my) confusion :D
found the m Spain person I was thinking of. The will of John Peterson (husband of Martha - questioned daughter of Henry & Mary) names a daughter Mary Spain.
in the Name box, put Charles City at https://virginiamemory.com/collections/lost - the quoted bit is from the first page of the third transcription (see comment from the transcriber in G2G).
