Conflation

There two men named Joseph Benham living in Wallingford, Connecticut during the same time. Joseph Benham born 1685[1] and his son Joseph Benham born 1711.[2].

1. Joseph Benham b. Apr 1711, d. 14 Nar 1777 at Cheshire, m. there 7 Jan 1736 Em Curtis (b. 29 Jul 1714 at Wallingford, d. 23 Apr 1789 at Cheshire, dau. of Samuel & Elizabeth (Frederick) Curtis);

2. Joseph Benham, b. 05 Dec 1685 to Joseph Benham and Hannah Merriman and the subject of this profile.

Both the father and son were married to women with the last name of Curtis.

Joseph Benham born 1685 married for a second time to Mary Curtis The marriage record for Joseph and Mary Curtis names him as Sergt. Joseph Benham..[3] Mary is also the name of his wife in his will of 1754. Joseph names his beloved wife Mary and the "three daughters born of her body viz: Mary, Abigail & Lettice" in his will.[4]

Joseph Benham born in 1711 was married to Em Curtis on January 7, 1735 by Capt. Hall in Wallingford.[5] To further add confusion, both father and son had a daughter named Lois. The first was born in 1726 to Joseph and Hope Benham. Lois is named in Joseph's will and she is not noted to be a daughter of his wife Mary. The second was born to Joseph and Em Benham (twin to James) in 1750.

Joseph Benham born in 1711 and the son the the subject of this profile had daughters born named Elisha and Em born in 1760[6] that are not named in the will of Joseph born in 1685.[7] The same Joseph Benham and Em had children named Isaac, Samuel and Uri. None of these names appear in our Joseph Benham's will of 1754.[4]

The man named Joseph Benham that married Em Curtis had a daughter named Em on April 17, 1760. This birth occurred after the death of our Joseph Benham, subject of this profile, who died in 1754.[8]

Based on this evidence the second wife of Joseph Benham (subject of this profile) was Mary Curtis. Em Curtis was the wife of his son Joseph Benham born in 1711.

Sergeant Joseph Benham was born December 5, 1685 to Joseph Benham and Hannah Merriman .[1][9]

Marriage

Joseph married Hope Cook on December 18, 1706.[10] Hope died on January 30, 1731 in Wallingford.[11]

Joseph married a second time to Mary Curtis on April 5, 1732 by Mr. Whitelsey.[3]

Joseph died on April 18, 1754. [12][8]

Will and Probate

Joseph died in 1754 and his will was written on April 3, 1754 in Wallingford, New Haven.[4]

In the name of God Amen this 3rd day of April Anno Dom. 1754 I Joseph Benham of Wallingford in the county of New Haven and colony of Connecticut in New England being under bodily indisposition, but of perfect mind and memory, thanks be given to God therefore but calling to mind the mortality of my body and knowing that it is appointed for all men once to dye, do make and ordain this as my last will and testament. Principally & with all my soul I recommend to God who gave it, hoping for mercy through a glorious mediator, & my body to the earth to be buried in a decent christian burial at ye discretion of my Ex. hereafter named. and such worldly estate as it hath pleased God to bless me with in this life, after just debts & funeral expenses are paid, I give and bequeath in the following manner -

Imps: To Mary my dear & loving well beloved wife I give & bequeath the use and improvement of one third part of my whole estate so long as she remains my widow, both real & personal estate except the lands ye come to me by my first wife who was Hope Cook & no longer & give her all her wearing apparel & ye whole of my pewter a large iron kittle & an iron pot & one third part of the rest of my household stuff during the time of her natural life but at her decease to return to my three daughters born of her body viz: Mary, Abigail & Lettice - and likewise the use of one fourth part of the dwelling house, barn & well as long as she remains my widow.

Item. To Joseph Benham my eldest son I give & bequeath besides what I have heretofore given him one acre of land upon the plain in the common field call the great field, being ye 9th part of the land at said place that I purchased, of the Revd Sam Whittlesby dec'd which descended to me on the right of my first wife, a pair of silver shirt buttons ye was my fathers and no more.

Item. To Enos Benham my 2d son besides what he has already had, I give & bequeath one ninth portion of the above land on ye plain of said Whittlesby & 2 acres of land on the plains bounded by south on the land ye by this will I give to my son Benj. -

Item: To John Benham my 3d son besides what I have heretofore given him I give & bequeath one 9th part of ye land on ye plain of Mr. Whittlesby as aforesaid

Item: To my Daughter Hannah the wife of Saml. Beach, besides what she has had of my estate heretofore, I give & bequeath one acre of land as aforesaid being the 9th part of the land of Mr. Whittlesby & no more -

Item: To my Daughter Thankful Widow & Relict to Jonathan Peck dec'd I give & bequeath one 9th part of land on the plain being one acre.

Item: To my Daughter Phebe wife of Robert Austine I give one acre of said land on the plain.

Item: To my Daughter Elizabeth wife of David Merriman I bequeath one 9th part of said land on the plain being one acre & twenty pounds old tenor to be paid by my Ex. out of my movable estate

Item: To my Daughter Lois wife of Enoch Culver, besides what she has already received I give & bequeath one ninth part of the plain land of Mr. Whittlesby, and fifteen pounds old tenor to be paid out of my movable estate at my decease, by my Ex. as aforesaid & no more.

Item: To Esther my Daughter wife of Thom. Curtis Jr. I give & bequeath besides what she has already had one ninth part of said land, which is one acre as aforesaid & no more.

Item: To Benjamin Benham my fourth son. I give & bequeath a piece of land upon the east side of Long Hill so called near Saml. Halls containing in quantity about 22 acres more or less, as its bounded on record & 100 acres of land upon ye plain, being on the north side of the land of Wm. White before mentioned and disposed of in this will, & extending north ye the whole length of sd. lot, so far as to make two acres, likewise one acre & a half of river meadow in ye common field, being the one half of the meadow at sd. place I gave to son Dan. Hall in quantity and quality, likewise half my lot at Jacobs low ground so called -

Item: To Reuben Benham my fifth son. I give & bequeath one half of my dwelling house & half my barn & half my homelot, with fences, fruit trees & apportenances belonging thereto & half the River Meadow lot of son Daniel Hall in quantity and quality and two acres upon the Plains & bounded south on Enos two acres -

Item: To Shadrock Benham my 6th son I give & bequeath ye whole of my land lying a little westwd. from Waitstill Munsons containing about 18 acres be it more or less as its bounded on the record be and two acres on the Plains bounded south on Reuben's two acres -

Item: To James Benham my youngest son I give & bequeath the other half of my house, barn and homelot only its understood that my wife has the improvement of ye fourth part so long as is before specified the one half of my lot at Jacobs low ground. The whole of my land on ye east side of the river, both Plain land & Meadow land except of three acres Bo' of Danl. Hall ye is given to my sons Benj. & Reuben as above mentioned & the remainder of my plain lot not by this my will disposed of -

Item: To my three youngest Daughters Viz: Mary Benham, Abigail Benham and Lettice Benham I give & bequeath ye whole of my land at the Parsonage Plain, so called to be equally divided between them & each of them alike -

Lastly: I do hereby ordain & appoint my two sons Viz: Joseph & Benjamin Executors on this my last will & testament hereby revoking all other wills by me made acknowledging this and no other to be my last will and testament In witness whereof I have hereunto set my hand and seal ye day & year before mentioned -
