His will dated date of death 1855, Probated in McMinn Tennessee on September 23, 1855.[3] Listed in his will were, Laverna, Temperance Hurt, Prudence Moorland, Margaret Keeton, Julia Malipa Fields, Mary, and the heirs of Nancy. The remaining divided with all, and Hile Buttram, Larkin Buttram and the Heirs of Noah Buttram.
