28 Oct 1905 The West Australian Perth (via trove.nla.gov.au) HIGH COURT OF AUSTRALIA WEDNESDAY. OCTOBER 25. (Before the Chief Justice, Mr. JusticeBarton and Mr. Justice O'Connor.) An Insurance Case. Argument was continued in the part heard matter of George Staniford Anderson, which originally came before the Full Court, consisting of the Chief Justice, Mr. Justice Parker, and Mr. Justice Burnside, some time ago. It was stated at the time that Anderson died in South Africa in 1903, and left a policy in the A.M.P. Society for over £1,000 to his, sister. His widow, now Ethel Egan, was it was alleged, ig nored. Under an order for judicial separation obtained in this State by his wife, an amount of £400 odd had accrued for alimony and costs. The widow of the deceased, being a creditor in the estate to the extent of this sum, sought the opinion of Mr. justice McMillan.on the matter, and his Honour held that the moneys received from the A.M.P. Society were available for creditors. Against this order the administrator appealed, on the ground that moneys arising from a life policy were protected under section 33 of the Life Assurance Act. The Court held that if the money, as in this case, passed outside the next of kin, it was not protected as contended, and was, therefore, available for the creditors.' The appellant now appealed, and the Court reserved judgment. (The appeal was dismissed with costs)
