Last Will and Testament

In the name of god amen I William Brooks of the county of Berkeley and state of Virginia being weak in body but sound in mind and memory thanks to the allmighty God for all his mercies have thought it knowing it necessary the uncertainty of human life to make this my last will and testament in manner and form following viz. First-it is my wish and desire that the monies due be collected out of which all my just debts are to be paid. 2nd-It is (my) will that my negro man James enjoy his freedom from all manner of service and slavery from my death and for ever unless he be hired out at my death for a year In that case, as soon as the term expires he shall be free from my heirs and forever. 3rd-It is my will and I give a bequeath to my brother, Daniel BROOKS, all of the wearing apparel which I may have at my death-and in case he the said Daniel should die before me, in that case I give them unto his son, William BROOKS. I also give and bequeath unto the said William BROOKS my silver watch. 4th-It is my will that all my personal property except what is above devised of any kind together with my land containing sixty acres in Berkeley County be sold by my executors named below and the money past out at interest and these moneys arising from such take of personal property and land together with all the debts due me after my just debts are paid I give and bequeath to my grandchildren, William Brooks LARUE and Jacob Warren LARUE one equal moity to each of them to be paid to William Brooks LARUE the 7th day of June 1814 on which day he will be Twenty years of age and Jacob Warren LARUE moity to be paid him the 27th day of Dec. 1816 on which day he will be Twenty years of age, and in case either one of them dies before he arrives to the age of twenty years, then and in that case I give and bequeath the whole sum to the survivor, and in case they both die before they severally arrive at the Age of Twenty years, then and in that case, I give a bequeath one equal Moiety of said Moneys to William BROOKS my Nephew, Son of Jesse BROOKS-and the other equal moity to William BROOKS, my Nephew, Son of Daniel. And to the Heirs for ever- And lastly I constitute and appoint my two good friends James LARUE and Thomas GRIGGS to be the Executors of this my last Will and Testament. In Testimony wherof I have here unto set my Hand and Affixed my Seal this 29th day of January 1798. Signed Sealed published & acknowledged before us William BROOKS Martin HOWARD James VIOLETT Jos. VANVACTER B this My Codicial to My Last will as above ?? At a court held for Berkeley County 28th day of October 1799 This last will and testament of William BROOKS dec’d was proved by the oath of Martin HOWARD on of the witnesses thereto and ordered to be for further proof and at a court continued and held for the said county the 22nd day of the month and year aforesaid the same was further proved by the oaths of James VIOLETT and Joseph VANVACTOR two other witnesses thereto and ordered to be recorded & at a court continued and held for the aforesaid county the 23rd day of the month and years aforesaid did Thomas GRIGGS one of the Executors therein named in open court refered taking upon his self the barthow of the execution thereof, which is ordered to be certified and on the motion of James LARUE the other executor therein named who made oath thereto according to ??? certificate is granted him to obtain a probate thereof in due form of law giving security where up he together with security ordered unto and acknowledged above conditions as the law directs.
