APRIL 5 1881
STATE OF TENNESSEE
WARREN COUNTRY I, THOMAS BROWN, being of Sound mind, do make and publish my last will and testament hereby revoking and making void all other wills by me made at any time.
1st, I give my Soul to God who gave it, and my body to the dust from whence it came.
2nd, It is my will that my funeral expenses and just debts be paid as soon after my death as possible, out of any money that I may have on hand at my death, or that may first come to the hands of my Executors.
3rd, I give to each of my children (or their heirs) both by my first and last Wives, an equal Share in my land, which being only about 140 acres, could not be divided so as to make these each a home, but shall be sold by my Executors as required by law, and the proceeds divided equally among them, except my Son ISAIAH, who has already received .50) Forty Six dollars fifty cents out of my estate, for which I hold his receipt, and for which he must be charged, but he is not to pay interest on said .50. I desire here to explain that my Son ISAAC is not of sound mind and is incapable of taking care of himself, and being anxious that he shall be well cared for, I say that any of his Brothers or Sisters of the whole blood, or any friend who will take good care of him during his natural life, shall be entitled to ISAAC's portion or share of the land. I have divided bits and few clothing among all of my married children, and whoever takes care of my Son ISAAC shall be entitled to his bit and bit-clothing, to be theirs forever.
4th It is my will that all of my personal property of which I die seized and possessions, both in the house and out of doors, (except ISAAC's bit and clothes above mentioned) shall be sold by my executors as the law directs and the proceeds divided equally among Tunall my children, both by my first and last Wives, and whoever takes care of my Son ISAAC shall be entitled to his Share of Said Proceeds.
5th It is my will that my Wife MARY S BROWN be allowed none of my property neither real nor personal, for the reason that she has deserted my house and home in my old days, and left what ought to be a happy home a miserable deserted place. I have settled with her and given her all that she asked me of my personal property. I begged her to live with me. She refused and I don't feel bound to give her any thing, except what I have already given her.
6th I desire that my Son ISAAC have all of my wearing clothes, shoes and hats at my death. Lastly I hereby nominate and appoint my Sons LEDDEN BROWN and G T BROWN the Executors of this my last will and Testament.
In witness whereof, I hereunto set my hand and seal this the 15th day of November 1876.

CODICIL
I, THOMAS BROWN, of the County of Warren State of Tennessee, do this 24th day of January make and publish this codicil to my last will and testament, in manner following.
I give and bequeath to my Son ISAAC besides what I have given him in my last will One hundred Dollars to be used to his benefit when he needs it, if he becomes of proper mind. I want him to have the care of what I have allowed him in my will, and this my codicil to my will, and if he does not become capable of managing I want his own Brothers to have a Guardian, or see that he is not wronged out of his rights, and when he dies if he has no legal heirs, I want his own Brothers and Sisters and their heirs to have his Share equal divided of my first Wife's children. ELIZABETH, I bequeath that the hundred dollars be paid to him out of my estate for his care. - provided he is not capable of caring for himself. And I further state that in my last will that I made, ABSOLOM BROWN, my Son and MARTHA PATRICK, my Daughter, WM W BROWN, my Son equal Shares in my will with my other children and for just and legal causes. Since I signed my last will I allow them nothing nor their heirs as in last will. In particular for trying to slander me on my character in my old days which is well known to the country and public - in general, for being the cause of me having to pay a good deal of money for nothing, and further for their Mother conveying from me and them my double wove counter pins other property goods with out my leave or consent, which I think is as much as their shares ought to be, beside the two boys (to wit) ABSOLOM WM W BROWN, owes me on account I think near one hundred dollars - for which reasons mentioned above I allow none of them any share in my estate of lands or personal property or anything else, for the above named reasons. Lastly, I desire that MARY S BROWN, my former Wife because she deserted me in my old days be allowed nothing because my former will left her all I had during her life or widowhood she has abandoned me I want her to have nothing more, as I divided with her when she left a full share, she agreed to take it for her portion forever. And in consequence of her leaving me, and causing me to pay with money in my old days my desire and will is that she be allowed nothing more, lastly, it is my desire that this my present codicil be annexed to made a part of my last will testament, to all intents purposes. In witness whereof, I have hereunto set my hand seal this 24 day of Jan 1880. Further more I appoint G T BROWN, my Executor of my last codicil will.

This day appeared in open court, LEDDEN BROWN, the Executors, and produced a paper perporting [sic] to be the last will testament of THOS BROWN (DEC) and also the codicil thereto, and also came J H ROBERSON, J C M ROSS and R R WOMACK, the three subscribing witnesses to the will who after being sworn as required by law, after hearing the will read examining the same, proved that the said THOS BROWN signed said will in their presence, after the same had been read to him, he made acquainted with its contents, and that he requested them to attest the same, which they did in his presence, and that as they verily believe he said THOS BROWN was of sound mind and disposing memory at the time and also cause WM PATRICK and JOHN S COPPINGER the Subscribing witnesses to the codicil, who after being legally sworn, hearing the paper read and examining the same proved that THOS BROWN signed Said Codicil in their presence after hearing the same read over to him and being fully aware of its contents, and that he requested them to attest the same which they did in his presence and as they verially [sic] believe the said THOS BROWN was at said time of Sound mind and disposing memory. It is therefore ordered by the Court that said will codicil be recorded.
On April 4 1882 regarding THOMAS BROWN's ESTATE:

Warren County Pursuant to an order of the Warren County Court made its January Term 1882, I make the following Settlement with LEDDEN BROWN Executor of THOMAS BROWN DEC-- Define in said Executors hands as per his Inventory made and Sworn to 5 September 1881.
Note: This goes on to list the various settlements made. At the conclusion the Executor LEDDEN BROWN goes on to note "Executor claims that he has been at considerable trouble looking after said estate- that he has spent 18 days labor - and that he ought to be allowed .50 per day. - But I am of opinion that he should not be allowed excluding twenty dollars for his Said Services.
L BROWN makes oath that the above and foregoing report is true to the best of his knowledge, information and belief.
