In the name of God Amen. The 5 day of April, 1777. I Henry Burk of Caroline County being sick and weak but in perfect mind and memory thanks to God: therefore calling to mind the mortality of my body and knowing its appointed once for all men to die, do make and ordain this my last will and Testament that is to say principally and first of all I give and recomment my soul into the hands of God that give it and my body I recommend to the Earth to be Buried in Christian decent burial at the discretion of my Executors hereafter named. And as touching such worldly Estate wherewith it has pleased God to bless me in this life I give, demise and dispose of the same in the following manner and form. First My desire is that all my just debts be paid as soon as possible after my Death. I give to my son John Burk two hundred Acres of Land more or less as I purchased of Fisher together with four Neroes (VIZ) Ben and Lucy his wife young Lucy and Sukey and their increase to him and his heirs forever. I give to my son Thomas Burk Negro Amava and Ambrose (as he has sold) together with Gilbert and Rose and their increse to him and his heirs forever. But in case any debts shoul come against my estate from son Thomas Burk as I was security for him then the said Thomas Burks Negroes Gilbert and Rose is to be sold to pay those debts as it is not my desire that the rest of my children shall suffer on that account. I give to my son Henry Burk's children VIZ John Burk seventy Pounds Current money as my son John Burk is to pay to the said John Burk son of my son Henry Burk for the consideration of of two hundred acres Land as be my son John is to have possession of at my death which land I purchased giving to the said John my son Henry's son. Likewise I give to Ann Burk my son Henry's Daughter two Negroes (VIZ) Sarah and Fanney and their increase to her and her heirs forever. I lend to my daughter Judith Hundley four Negroes (VIZ) Phyllis, Esther, young Jack and Mary and their increase during her natural life and after her decease to hre children as she had them by George Priddie to be equally divided amongst them to them and their heirs forever. I lend to my daughter Ann Burton four Negroes (VIZ) Old Jack, Charlotte, Glouchester, Rachel and their increse during her natural life & after her death to be equally divided amongst all my children hereafter name to them and their heirs forever. I give to my daughter Elizabeth Cross four Negroes Hannah, Milley, Edmund & amy & their indrease to her and her heirs forever. I give to my daughter Jane Southworth four Negroes (VIZ) Daphmy, Mingo, James and Peg and their Increase to her and her heirs forever. My desire is that all my Personal etate be sold and equally divided among all my Children (VIZ) John Burk, Thomas Burk, Judith Hundley, Ann Burton, Elizabeth Cross, and Jane Southworth, & my son Henry Burk's children (VIZ) John Burk, and Ann Burk is likewise each of them to have an equal part of my personal estate to them and their heirs forever. I hereby constitute and appoint my son John Burk and my son in law Joseph Cross, Executors of this my last will and testament whereby revokeing all other will or wills as witness my hand and seal the day and day before written. At a Court held for Caroline County on Tuesday the 10th of July 1777. This will was proved by the oaths of William Brown and Humphrey Haley two of the witnesses & and ordered to be Recorded. On motion of John Burke and Joseph Cross the executors therein named a certificate for obtaining a probate is granted them they having taken the Oath of Executors and together with Robert and John Gatewood their securities entered into and acknowledged a Bond which is Ordered to be recorded.
