Henderson v. Burke — Application for order on a judgment summons for £9 6s l0d. Mr Reid appeared for the judgment creditor. He said Burke could pay if he liked. Some years ago he was left, by will, a farm of considerable area, also some hundreds of pounds in cash.
His Worship : Does he not like the idea of paying out then ?
Mr Reid : Well, in common parlance, he is somewhat fond of "going the pace." A large amount of the claim is for binder twine and bags for grain.
His Worship said he was not satisfied as to the date on which the debt was contracted, and it was then agreed that the case should be adjourned until evidence in this direction was forthcoming.
After the lunch adjournment a communication was received from Mr Reid's client saying that the debt was contracted in February, May, and June, 1900.
An order was made for payment of the amount by April 17th, in default 10 days' imprisonment in Dunedin Gaol, order to be suspended if debtor paid £5 on or before 17th April, and the balance before May 17.
