There are several Probate Court Minute entries regarding additional hearings for settlement of the Estate of William Bynum, the last being the final settlement and sale of the real estate on the 31st of May, 1874. The two that follow are the most significant as the first filed and the other names his spouse and children. Actual date of death is left blank in the first filing, and does not appear in any of the other filings. (The year of actual death is in question, as it could have been written incorrectly by the
Court Clerk.)
Estate of William Bynum, Dec'd. -- October 31st, 1866
pgs 19 and 20 Blount County Probate Court Minutes
This day comes Joshua T. Smith and makes verbal application for letters of administration on said Estate to be granted to him alleging that he is one of the heirs at law of said deceased having intermarried with one of the daughters of dec'd, and showing that said deceased was an inhabitant of this state at the time of his death to wit: on the day of 1866 leaving property in this county of about the value of Five Hundred Dollars and probably not more, and the Court being satisfied that allegations of the said Joshua T. Smith are substantially true, and he having entered into bond in the Sum of One Thousand Dollars with the requirements of the law as a condition therein with Solomon Bynum, Hamilton Brooks & Samuel D. Smith, Jr. as securities therein which bond has been duly taken and approved as good and sufficient by the Judge of this Court.
It is therefore ordered and adjudged by the Court that said Joshua T. Smith be and he is hereby appointed administrator of Said Estate and that proper letters of administration issued to him forthwith.
It is further ordered that an appraisement of Said Estate be made and that they have due notice of their said appointment.

Joshua T. Smith, Administrator of Said Estate, having this day filed this application in writing and made Oath, praying for an order all proceedings to sell certain real Estate in said petition described of the property of said decedent at the time of his death, for the purpose of paying the debts due from Said, upon the grounds that therre is no personal property subject to administration, and it appearing from an inspection of Said petition the heirs of Said decedent are as follows to wit:
1. Cynthia Bynum widow of Decedent resides in Blount County.
2. Jesse, Son of Decedent, over 21 years old.
3. Heirs of Elijah, Dec'd, who was a Son & heir of Said William, to wit:
Isabella, over 14 & under 21 years old, Cobb, Eli, & Asa,
Elizabeth, under 14 years old, residence unknown.
4. Mary, intermarried with your petitioner.
5. Elizabeth, daughter of Decedent, intermarried with _________Glover, resides in TN.
6. Heirs of Caleb, Dec'd, who was Son & heir of Said William, Dec'd, to wit:
Jane, over 14 years old residence unknown to petitioner.
7. James, Son of Deceased over 21 years old residing in Blount County.
8. Jane, daughter of decedent, over 14 and under 21 years old and resides in Blount County.
It is therefore Ordered that the 9th Day of Feb. next be appointed for hearing Said application and the proofs which may be submitted in proof of the same.
It is further ordered that due notice of the nature of said application and of the time above set for the hearing thereof be given for thirty days by written advertisement posted at the Court House door and three other public places in Blount County, for all persons in interest to appear and contest the same if they think proper.
It is further ordered that said Cynthia, Jesse, James, and Jane have notice of this proceeding by and of the day set for hearing the same by citation to be personally served on time.

WILLIAM BYNUM - Distant relative of John Bynum, trunk of the tree
William Bynum, who was a distant relative of John Bynum, my grandfather, was born about 1790, and lived in Blount county. He was about seventy years old when the Civil War broke out. He was very much opposed to the war and would boldly speak his union sentiments and persisted in his views. But as he was too old to fight, he had to remain quietly at home. However, a company of home guard cavalry arrested him and carried him to Ashville jail. While on the way someone struck him on the head with a gun, fracturing his skull. He spend the night in jail, but as he was fatally injured the doctor recommended that he be carried home where he died the next day.
It is no wonder that Sherman said, "War is hell." Our readers, no doubt, will have different opinion as to whether such an action were right or wrong.
PERSONAL OBSERVATIONS AND QUESTIONS
Joshua T. Smith, son-in-law of William Bynum was Captain of the Blount County Home Guard during the Civil War. Did he beat his own father-in-law for his Union sentiments?
Son listed as Thomas in 1850 census is not listed as heir in Estate Settlement. Son listed as Elijah in estate settlement is not listed on census. :Are Thomas and Elijah the same person?

He has a books on The Murphree's, Bynum's, Allgood's, and Cornelius's of Blount County, Al. According to Bruces Cornelius book Jesse's father and mother were William Bynum and Mary Brown.
