Biography

James Salyer passed away c. 1891. Years later, Malinda applied for a Widow's Pension based upon Mr. Salyer's military service. She passed away from the effects of the debilities of old age and was laid to rest at the Henry Castle Cemetery, Nickelsville, Scott County, Virginia

Divorced

After the war, James and Matilda Jeans Castle started an affair. They began to have children together and eventually James stopped coming home and was living openly with Matilda. Malinda, a respected member of her community, did not tolerate this and filed for divorce. The divorce was quite contentious and Malinda asked for primary custody of the children and accused Mr. Salyer of attempting to woo her sons away from her home, by asking them to accompany him to Kentucky. She was also concerned that he may sell their property and leave her and the children destitute. Finally, the suit was settled and James was awarded some land, guns, tools, saddlery, grain and livestock. He was also granted right-of-way to use the spring, at his former home, "as long as he shall live and no longer". Reading between the lines, in the latter order, it seems apparent that Malinda did not want Matilda crossing the property line after James' passing.
