Lieut Peter Davis Jr served with 7th Regiment, Worcester County Militia, Massachusetts Militia during the American Revolution.
Peter Davis, son of Capt. Peter Davis and Rebekah Hopkinson of Rowley, Massachusetts, was born on November 14, 1731 at Rutland, Massachusetts. [1][2]
Peter married Mary How on May 11, 1758 at Rutland. Mary was born there on February 17, 1737/8, daughter of Eliphalet and Hepzibah How. [1][2]
Peter died at Rutland on January 2, 1781 in his 49th year. [1] He is buried in the Old Cemetery at Rutland where his inscription reads: In Memory of Lieut. PETER DAVIS who died Jan. 2nd 1780: in the 49th year of his age. [3]
Peter died intestate and the administrators of the estate were widow Mary Davis and John Frink. [4]
The administrators submitted the estate inventory on February 4, 1782. In assessing the personal and real properties as well as accounts due and debts owed, there was an a debt of L 870: 10:4 due 'whenever demanded' to John Irving, Esq. of Boston, that was the debt of Peter Davis Sr., and the obligation of Peter Davis Jr. from this estate. The current debt amounted to L1236:8:2 with added interest, and the administrators informed the court that Mr. Irving had put in his demant on April 10, 1781. The administrators indicated that this obligation could not be met without the sale of Peter Davis' real estate and that would likely be insufficient considering Continental Loans and amounts owed by the estate. [4]
On May 28, 1782, the committee responsible for dividing the real estate, which contained 332 acres and 101 rods of land in Rutland, set off No. 1 of a plan, containing 49 acres and 99 rods including buildings and also No. 11 containing 20 acres and 60 rods to the widow Mary Davis as her one third dower. [4]
John Frink reported to the court that he possessed a balance of Peter Davis' estate in the amount of L13: 16: 1: 2 and on May 6, 1883 the court ordered the distribution among the children as follows:
On March 14, 1782, John Frink of Rutland was appointed guardian to Peter Davis a minor aged 11 years, son of Peter Davis, deceased. [5]
On March 14, 1782, John Frink, physician of Rutland, was appointed guardian to David Davis, minor aged 8 years. son of Peter Davis, deceased. [6]
On the same date, John Frink, physician was also appointed guardian to Peter Davis' son Joel aged three. [7]
His widow Mary survived him and died at Rutland on, July 23, 1825 aged 87. [1] She is buried in the Old Cemetery with Peter. Her inscription reads: : In Memory of MRS. MARY DAVIS widow of Mr. Peter Davis
who died July 23. 1825. AE. 87. ) [3]
