Biography

Joshua Dodson, Jr., was born sometime between 1761 and 1770[1] in Virginia, very likely Fauquier county, Virginia.[2] Joshua was the son of Joshua Dodson Sr and Ruth Unknown.

Joshua married 1st - Sarah Warnock, daughter of Samuel Warnock. Samuel Warnock died in Stokes County, North Carolina in 1798, leaving a will naming his sons John and James Warnock and daughter "the wife of Joshua Dodson". It is believed that Joshua Dodson and Sarah Warnock were married in Stokes County, North Carolina.[3]

Joshua appears in the North Carolina state census taken 1784-1787. Joshua was living in Absalom Bostick District's in Surry county, North Carolina. Joshua is listed with 1 white males 21 to 60 years, and1 white males under 21 and above 60; and 1 female all ages in his household.[4]

Joshua and his brother-in-law James Warnock filed the following Power of Attorney in Stokes County, North Carolina authorizing Joseph Pearson as their attorney to recover their share of estate of Samuel Warnock. The Power of Attorney reads as follows: "State of N. Carolina Salisbury District} Know all men by these present that we James Warnock of the state of Kentucky, and Joshua Dodson of the State of Georgia have made constituted, and appointed and by these presents do make constitute and appoint Joseph Pearson Esq. of Salisbury, our Lawful agent and attorney with full power & authority to demand sue for, recover and receive in whatever manner he may think expediant, from Absalom Bostick of Stokes County, all the lands negroes, bonds notes and property of every or any species which is or hath been in his possession as Executor to the Estate of Samuel Warnock Deceased, and which he has not legally and justly accounted for, further we do authorize and in our stead put the said Joseph Pearson Esq.to demand sue for recover & receive all the lands negroes, bonds, notes all above mentioned from the said Absalom Bostock in our name or the name of John Warnock Idiot son of the said Samuel Warnock Dec'd to whom we all next of kin, but to the use of him the said John Warnock idiot son of the said Samuel Warnock Deceased, late of the county of Stokes in the District aforesaid And also to sue for, demand recover & receive in our names or in the name of each or either of us, but to the use aforesaid in what so ever manner he shall think proper. All the articles above mentioned, and particularly the following negroes, viz, one negroe man named Cuffee or woman named Cloe, and their increase, which negroes are in the possession of John Bostick of Stokes county, and which he unjustly __________, and further we do authorize the said Joseph Pearson Esq. with full power to do any actor acts, which he may think necessary, in Equity or Law, for the complete settling and recovery of any and every part of the said Deceased's Estate. Witness our hands and seal this 9th day of December 1801. [signed]James Warnock Joshua mark X Dodson Test John Ward & Joseph Banner Stokes County Dec. term1805. The execution of the above power of attorney was proven by Joseph Banner, ordered to be registered Robt Williams CC" "NB 2 Sept 1805.I have settled with John Bostick, and have received in notes and cash nine hundred and fifty dollars of which Joshua Dodson hath received his full share for himself & Idioti. Test John Evans. This NB is annexed to the above power of attorney."[5]

Joshua purchased in 1808, 202 1/2 acres of land in Baldwin county, Georgia. This land would eventually be in Henry county, Georgia when Henry county was formed in 1821. The deed reads as follows: "This Indenture made the 11th day of March Eighteen hundred & eight between James Wills of the county of Davidson & state of Tennessee of the one part and Joshua Dodson of the county of Jackson and State of Georgia of the other part Witnesseth that the said James Wills for and in consideration of the sum of Four Hundred Dollars in hand paid before the signing and delivery of these presents the receipt whereof is hereby acknowledged have given granted bargained and sold & do by these presents give grant bargain sells and confirm to the said Joshua Dodson his heirs or assigns for ever in fee simple all that tract or parcel of land containing two hundred two & a half (acres) situate lying and being in the county of Baldwin state of Georgia District number fifteen Lott number Eighty nine of that District together with all and singular the rights members & appurtenances to the said lands belonging or appertaining & I the said James Wills do for my self my heirs or assigns to the said Joshua Dodson his heirs or assigns warrent and for ever defend by these presents the said land and premises against the right title claim or demand of all manner of person or persons whatever In Testimony whereof I the said James Wills do hereunto set my hand & seal the day & year above written sealed signed & acknowledged in presence of [signed] James Wills (Seal) John McIhennon, J. McCarroll"[6]

Joshua married 2nd - Mary (surname unknown), and Mary is listed as Joshua's widow in his will.

Joshua appears in the 1830 Federal census in Henry county, Georgia. Joshua's household appears as follows: 1 male age 60 thru 69; 1 female age 40 thru 49; and 3 slaves.[7]

Joshua appears in the 1840 Federal census in Henry county, Georgia. Joshua's household appears as follows: 2 males age 30 thru 39; 1 male age 70 thru 79; and 1 female age 70 thru 79.[8]

Joshua made his last will and testament in Henry County, Georgia on the 1st of April, 1844. Joshua's will was admitted for probate on the 1st of July, 1844, in Henry County, Georgia. Following is the will of Joshua Dodson, Jr.: "Georgia - Henry County) In the name of God Amen I Joshua Dodson of said state and county being of advanced age and knowing that I must shortly depart from this world deem it right and proper that as respects myself & my family that I should make a desposition of my property with which a kind providence has blest me. I therefore make this my last & Testament hereby revoking & annulling all others heretofore made by me. It [Item] 1st I desire & direct that my body be buried in a decent & Christian like manner suitable to any circumstance and condition my soul I trust shall return to rest with God who gave it as I hope for eternal Salvation through the blessed Lord and Saveror Jesus Christ whose religion I have professed and as I humbly trust enjoyed for these many years. It 2nd I desire my just debts be all paint without delay by my Executor or Executors herein after named as I am unwilling my creditors should be delayed of their rights especially as there is no necessity for delay. It 3rd I give and devise to my beloved wife Mary during her natural life or widowhood with whom I have lived in the strictest quiet and love for many years one lot of land the same being the lot whereon I now reside and known by the number one hundred ninety two in the eighth District of the county and state aforesaid also one negro woman slave by the name of Patience & three children namely Martha, Dick and Greenbury with all the rights to the land named and to cultivate the same for her own proper use during her life time or widowhood also one bay horse known by the name of Fox also one cow & calf also one bed and furniture one sow & pigs also a sufficiency of cooking & table utentials for house keeping also a sufficiency of provision for her support for the ensuing year also the property that she had at the time of our Intermarriage. It 4th I give and devise that the balance of my Estate both real & personal after my decease be sold and after my just debts are paid that it be equally divided amongst my children as follows namely that the children of my son Elijah Dodson receive one eighth share with the rest of my children namely Samuel Dodson, William Dodson, Andrew D [Dodson] Hollis the son of my Daughter with Hollis, Isaiah Dodson also my Daughter Dicy Houley to have an equal share with the rest of my children which I give and bequeath to her and to her body heirs after her death. It 5th I devise that my son Samuel Dodson and William Dodson be my lawful Executors to act and do and perform all the duties required as Executor of this my last will & Testament in testimony whereof I have this day set my hand and seal in the presents of April 1st 1844 [signed] Joshua Dodson (SEAL) John L Bentley, Josiah James, John South

Georgia - Henry County) Court of Ordinary July Term 1844 In open court personally came John L. Bentley, Josiah James & John South who being duly sworn say that they saw Joshua Dodson sign seal publish and declare this writing to be and contain his true last will and testament that at the time thereof he was of sound disposing mind & memory and executed the same freely and with out compulsion so far a they know or believed and that they signed the same as witnesses at his request and in his presents and in the presents of each other John L. Bentley, Josiah James, John South Sworn in open court this 1st day of July 1844 Test John H. Low C.C.O.

Georgia Henry County) We William Dodson and Samuel Dodson do solmenly swere that the writing contains the true last will and testament of Joshua Dodson deceased as far as we know or believe and that we will and truly execute the same by paying first the debts and then the legacies contained therein so far as the law charges us and that we will make a true and perfect Inventory of all the good and chattles of said deceased as required by law [signed] William Dodson Samuel Dodson Sworn to in open court July 1st 1844 Test John H. Low C.C.O.

Georgia Henry County) Court of Ordinary July Term 1844 The within last Will & Testament of Joshua Dodson having been duly proven at this regular term in open court upon the oaths of John L. Bentley, John South & Josiah James order that the same be admitted to record."[9]

Joshua Dodson, Jr. very likely died sometime in June 1844 in Henry County, Georgia. Joshua's estate was not completely settled until after the death of his Widow, Mary Dodson. Joshua's home place and slaves left to his widow Mary for her own proper use during her life time or widowhood were sold by William Dodson, the Executor of Joshua's estate, in January 1863.[10]

The following four advertisements were published in the Southern Recorder, Milledgeville, Georgia, on November 19, 1844.[11]: "According to the last will and testament of Joshua Dodson, deceased, will be sold on the first Tuesday in January next, at the Court House door in the town of Marietta, Cobb county, that tract of land containing forty (40) acres, more or less, known as lot No. (712) seven hundred and twelve, in the first district and second section of formerly Cherokee county, now cobb county. Terms made known on the day of sale. Samuel Dodson William Dodson Ex'ors"

"According to the last will and testament of Joshua Dodson, deceased, will be sold on the first Tuesday in December next, at the court-house door in the town of McDonough, Henry county, within the usual hours of sale, to the highest bidder, that tract of land containing 202 1/2 acres, known as lot No. 192 in the twelfth district of Henry county. Also, at the same time and place, one negro man named Leroy, about twenty-eight or nine years old. Terms made known on the day of sale. Samuel Dodson William Dodson Ex'rs"

"According to the last will and testament of Joshua Dodson, deceased, will be sold on Thursday, the 28th of November next, at his late residence in Henry county, all the perishable property belonging to the estate of said deceased, consisting of horses, hogs, cattle, sheep, house hold and kitchen furniture, cart and oxen, farming tools and other articles too tedious to mention - sale to continue from day to day until all is sold. Terms made known on the day. Samuel Dodson William Dodson Ex's."

"All persons having demands against the estate of Joshua Dodson, late of Henry county, deceased, are hereby required to present them properly attested for payment, within the time prescribed by law; and those persons owing the estate, are requested to come forward and make payment to the subscribers, without delay. Samuel Dodson William Dodson Ex'ors"

Joshua's widow, Mary, was deceased before August, 1863. William Dodson recorded with the court in Henry county, Georgia that the sale of the land and slaves listed in Joshua's will that had been left to his widow ". . . for her own proper use during her life time or widowhood . . ." was sold on the 1st Tuesday of August, 1863.[12] The sale was listed in part as follows:

slave - Patience, Old Woman sold to John F. Faith - $550

slave - Nancy Adaline sold to A.W. Walker - $1,900
slave - Green sold to Samuel Dodson - $3,100 [relationship to Joshua Dodson not stated]

Slaves

Joshua acquired slaves during his lifetime. Joshua's slaves listed in the 1830 Federal census are 2 males age 10 to 23, and 1 female age 26 to 54.

Joshua left three slaves in his 1844 will to his widow, Mary, as follows: "one negro woman slave by the name of Patience & three children namely Martha, Dick and Greenbury . . . for her own proper use during her life time or widowhood . . ." [see will above].

Joshua's Executor's listed for sale one slave, " . . .one negro man named Leroy, about twenty-eight or nine years old . . .", for sale with other real estate to be sold on ". . . the first Tuesday in December next, at the court-house door in the town of McDonough, Henry county."[11]

Slave - Leroy, born ca. 1814/15 - sold first Tuesday in December, 1844 - purchaser unknown.

Joshua's widow, Mary, died sometime before August, 1863. William Dodson one of the Executors of Joshua's will recorded with the court in Henry county, Georgia the sale of the land and slaves listed in Joshua's will that had been left to his widow ". . . for her own proper use during her life time or widowhood . . ." was sold on the 1st Tuesday of August, 1863.[13] The sale was listed in part as follows:
