Biography

Elisha Dodson Jr. was born about 1761, possibly in Fauquier county, Virginia, based on the records of Broad Run Baptist Church which state: "Received into the care of the Broad Run Bapt Church on 9 Oct 1763 as son of Elisha Dodson".[1] Elisha was the son of Elisha Dodson Sr. and Virginia Sarah Everett.

Elisha married Hannah Fuqua Lawson (the widow of Thomas Lawson) on the 21st of May, 1789 in Halifax county, Virginia.[2]

Elisha and his wife Hannah in 1791 were the administrators of Hannah's late husband, Thomas Lawson's estate.[3]

Elisha and Hannah were the administrators of her late husband's estate; however, Hannah's children by Thomas Lawson were under the guardianship of Theoderick (Theo) Carter who was responsible for accounting to the court their interest in their father's estate. Elisha charged the children's interest in the estate annually for their upkeep. The court record for the years 1794 and 1795 reads as follows: "October Court 1795 . . . Elisha Dodsons charge against Theo Carter guardian to Lawsons orphans for boarding clothing & schooling said orphans for the years 1794 & 1795 . . . "[4]

Elisha was an ordained minister and the court in Halifax county, Virginia authorized him to perform marriages in 1794. The court record reads as follows: "September Court 1794 - On the motion of Elias Dodson who produced credentials of Ordination also of his being in regular communion with the Church of Anebaptist took the oath to support the Constitution of the United States and together with James Walhons and William Harris his securities entered into and acknowledged their bond considered agreeable to an Act of Assembly an Act for Celebrating the rites of matrimony and he is hereby authorized to celebrate the same agreeable to the from of said church between any persons to him legally applying therefor with this state."[5]

Elisha assumed guardianship of Hannah's son, Smith Lawson, sometime before 1800. The September Court 1800 reads as follows: "Smith Lawson In acct with Elisha Dodson his guardian . . . At a court held for Halifax County the 22nd day of September 1800 The within written account was presented in court by Elisha Dodson guardian of Smith Lawson orphan of Thomas Lawson dec'd & the court having examined & passed the same the said Elisha Dodson made oath thereto according to law which was ordered to be recorded . . ."[6] Elisha continued as Smith Lawson's guardian through 1804.[7]

Elisha was named as one of the executors in the will of his step-son, Smith Lawson. The will reads in part as follows: "In the name of God Amen I Smith Lawson of the County of Halifax & state of Virginia being in sound state of mind, do make & ratify this my last Will and Testament, . . . I appoint Elisha Dodson James Lucas & Joseph Kirby, Executors of this my last Will & Testament signed with my hand this twenty ninth day of September in the year of our Lord one thousand eight hundred & sixteen [signed] Smith Lawson . . ."[8]

Elisha purchased from his son John the land John had received from his half brother, Smith Lawson, on the 10th of July, 1817. The deed reads in part as follows: "This Indenture made the 10th day of July 1817 Between John F. Dodson of the county of Halifax of the one part and Elisha Dodson of the same county of the other part Witnesseth that said John F. Dodson in consideration of the sum of twenty five hundred dollars of lawful money of this Commonwealth to him in hand paid by the said Elisha Dodson at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have bargained and sold and by these presents do bargain and sell unto the said Elisha Dodson his heirs and assigns a certain track of land it being the land left to the said John F. Dodson by Smith Lawson dec'd containing one hundred & twenty two acres also his part of his mother's dower at her death, bounded by the lands of Thomas Lawson Thomas Boyd, and Dan River, together with all the singular houses, barnes, buildings, orchards & to have and to hold the said land with the tenements, hereditaments and all and singular other the premises herein before mentioned or intended to be bargained and sold, . . . In Witness whereof I have hereunto set my hand and seal the day and year first above written. [signed] John F. Dodson Signed, sealed and delivered In the presents of Layton Yancey, Pleasant Waller, Apphire Waller, Major Prince At a Court held for Halifax county the 23rd day of February 1818 The within written Indenture was proved by the oaths of three witnesses thereto subscribed to be the act and deed of the within named John F. Dodson party thereto and ordered to be recorded . . ."[9]

Elisha appears in the 1820 Federal census in Halifax county, Virginia. Elisha's household appears as follows:

and 31 slaves.[10]

Elisha appears in the 1830 Federal census in Halifax county, Virginia. Elisha's household appears as follows:

1 male age 30 thru 39;

1 female age 5 thru 9;
2 females age 15 thru 19;
and 39 slaves.[11]

Elisha entered into a marriage contract with his intended second wife the widow Mary L. Jordon. The marriage contract reads as follows: "This Indenture made and entered into this 29th day of May 1832 between Mary L. Jordon widow and relict of Baxter Jordon dec'd of the first part, Elisha Dodson of the County of Halifax of the second part; and Wm B. Jordon and Thomas C. Jordon of the third part, Whereas a marriage is shortly intended to be had and solomnized between the said Mary L. Jordon and Elisha Dodson and is whereas the said Mary by the last will of her deceased husband Baxtor Jordon dec'd is possessed and entitled to during her natural life and at her death to his two son certain property consisting of land slaves and household and kitchen furniture, and whereas it has been agreed by and between the said Mary and Elisha that the said property of every description shall be vested in a trustee to be held by him trust in the manner and for the purposes herein after mentioned and declared. Now this indenture witnesseth that the said Mary L. Jordon for and in consideration of the promises and for the further consideration of the sum of five dollars her in hand paid at & before the sealing and delivery of these presents by the said Wm B. Jordon and Thomas C. Jordon the receipt whereof is hereby acknowledged and by and with the privity and consent and agreement of the said Elisha Dodson testified by his being a party to these presents hath granted bargained and sold assigned transferred and set over and doth by these presents part bargain and sell assign transfer and set over unto the said Wm B. Jordon & Thomas C. Jordon their exors admors or assigns all the property debts money and legacies of which the said Mary is possessed or to which she is entitled in possession or action for the term of her natural lie free and clear from the management and control of the said Elisha his heirs exors admors or assigns; to have and to hold the same and for the trust and purposes following that is to say. In Trust for the said Mary and her assigns until she so lamnigation of the said intended marriage, then upon the trust that the said Wm B. Jordon & Thomas C. Jordon their exors admor or assigns shall and well permit the said Elisha Dodson during the life time of the said Mary L. Jordon his intended wife (and no longer) to receive and take all the issues hires profits and interest of the said property debts legacies and money to and for the joint use and benefit of the said Elisha and Mary and the benefit support and maintainance and education of the issue said intended marriage and at the decease of the said Elisha if he should happen to die first, upon trust that that said Wm B. Jordon & Thomas C. Jordon shall assign and deliver over to the said Mary L. the said property debts, money legacies & c to be by enjoyed without control (her natural lifetime) in the same manner as if this instrument had never been made and executed and if the said Mary L. Jordon should happen to die first and the said Elisha survive her then and in that case the said property herein conveyed shall be held by the said Wm B. Jordon and Thomas C. Jordon subject to each order or decree as may be made in the premises and upon the intent that the said property may not be at the disposal of or subject to the debts forfeitures or engagments of the said Elisha her intended husband, and it is understood and agreed between the said Elisha and the said Mary L. that upon the event of the death of the said Elisha and the said Mary L. surviving him the said Mary shall not be entitled to receive any part or proportion of the estate of the said Elisha as dower. In testimony whereof the said parties have hereunto set their hands and affixed their seals the day and date above written & it is also agreed upon by the parties hereunto, that all the slaves, excepting two which said May L. Jordon may hereafter choose shall remain in the possession the trustees on the premises in Lunenburg county during the joint lives of said Mary L. and the said Elisha Dodson. But that the said Elisha Dodson shall have the direction a management of said property so remaining on the plantation. [signed] Mary L. Jordon, Elisha Dodson, Wm B. Jordon, Thos. C. Jordon Witness Geo: Craghead, Wm Mcfarland, John McFarland Lunenburg Court June 11th 1832 The foregoing marriage contract was this day proven in open court by George Craighead & Wm McFarland witnesses thereto and on the 15th of the same month the same was fully proven in vacation by the oath of Jno. Elisha married the widow Mary Lipscomb Pettus Jordan about 11 June 1832 in Lunenburg county, Virginia.[13]

Elisha made his last will and testament on the 1st of June, 1846 in Halifax county, Virginia. Elisha's will was proved and certificate to administer the estate was given by the court in Halifax county, Virginia on the 26th of October, 1846.

Elisha's will reads as follows: "In the name of God Amen I Elisha Dodson of the county of Halifax & state of Virginia being of sound mind & disposing memory (thanks be to God for the mercies) but calling to mind the uncertainty of live & being desirous to dispose of such worldly estate as God in his goodness has been pleased to bless me with I do hereby make publish & declare this my last will & testament in words manner & form following after committing my flesh to the dust from whence it came my soul I commit & surrender to almighty God on whose premises I put my trust for a happy resurrection at the great day of final judgement. Item 1st as soon after my decease as practicable it is my will & desire that all my just debt be paid & for that purpose my Executors hereafter named are authorized & required to sell to the best advantage all my perishable estate not otherwise desposed of & out of the money arising from such sale together with what may be owing to me pay my debts & monies bequest hereafter made reserving a sufficiency of the stock tools & provisions to furnish the hands hereafter directed to be kept on the plantation & for the support of my son John F. Dodson & family. Item 2nd I give to my beloved wife Mary L. Dodson three hundred dollars in cash to be paid her by my Executors together with all stock of every discreption with the increase on hand household kitchen furniture which I got by her in marriage also such other goods as she may have made or acquired & which she may hereafter make or acquire which articles of goods bed clothes furniture & c will when practicable be marked in her own name to her & her heirs forever. Item 3rd I also give & bequeath to my wife Mary S. Dodson one negro woman Mariah (which I got by her in marriage & their & three children Billy Sam & Henry with the future increase of said Mariah together with all property money debts interests & claims which may come or be coming through or by her from the estate of her father or other relations to her & her heirs forever. Item 4th I give to my step granddaughter Martha formerly, Martha Price five hundred dollars in cash to her & her heirs forever. Item 5th. I have loaned to my grandson Elisha D. Waller a negro man Simon (now in his possession, during his lifetime which boy Simon is not to be accounted for in a division of my estate among my grand children after my death & at the death of Elisha D. Waller I give & bequeath said negro Simon to the children of said Elisha D. Waller if any & the heirs of their bodies forever. Item 6th I lend to my grandson John R. Waller one negro boy Lewis during his life & not to be accounted for in a division of my estate among my grand children after my death which negro Lewis I give at the death of John P. Waller to the heirs of his body if any forever. Item 7th I lend to my grandson William J. Waller during his life a negro boy Sim & at the death of Wm J. Waller I give said negro to the heirs of his body if any, forever. The above named Sim is not be accounted for in a division of estate among my grand children after my death. Item 8th I have loaned & delivered to my grand daughter Sally A. Oliver a negro boy Peter valued at four hundred dollars during her life to be accounted for in a division of my estate among my grand children after my death and at the death of my grand daughter Sally A. Oliver I give & bequeath the same to her children & the heirs of her body forever. Item 9th I have loaned to my granddaughter Susan L. Boulton & delivered to her a negro boy Coleman valued at four hundred dollars to be accounted for in a division of my estate among my grand children after my death & at the death of my grand daughter Susan L. Boulton I give & bequeath the same to her children & the heirs of their bodies forever. Item 10th I bequeath to my great grandson Henry Clay Trent a negro woman Daphne & children Mary & infant with the future increase also three hundred dollars in cash to be & remain in the hands of Wilson Oliver for the benefit of said Henry C. Trent untill he shall arrive to the age of twenty one years the & not untill then to be surrendered to him or the heirs of his body forever & I hereby appoint the said Wilson Oliver agent & quardian for the said Henry C. Trent with the instruction that should the said Henry C. Trent depart this life leaving no lawful child or children then the above bequest to be a portion of my estate for distribution. Item 11th I bequeath to my grand daughter Nancy Dodson one negro during her life to make her equal with my grand daughters Sally A. Oliver & Susan L. Boulton & at the division of my estate among my grand children after my decease to be accounted for then I give & bequeath the same at the death of said Nancy Dodson to the heirs of her body forever. Item 12th I lend to my daughter Affia Townes during her life one negro girl Mary Ann with the increase to her special use it being my intention to secure to her individually the use & services of said girl which may not be bound for her debts or the debts of any other person & I hereby request & direct that my Executor be invested & I do invest them with every power sufficient to control this loan to the fulfiment of the object intended. Item 13th It is my will & desire that the whole of my landed estate be kept up by my Executors during the life time of my son John F. Dodson & my daughter Affia Townes & I hereby direct that the plantation whereon I now reside, the land purchased of Boyd the mill & lands purchased of Stamps & the lands whereon on my son John F. Dodson resides be cultivated & kept in such manner as will be most profitable to the estate without injury to the land shisling & resting as occasion may require. resting when necessary & that the shop & other lotts & tenements may be rented when practicable. Item 14th In order that the instructions & acquirements in the above Item 13th may be fulfilled I hereby will & direct that the following slaves be kept together on the several plantations during the life time of my son John F. Dodson & my daughter Affia Townes or a sufficiency to cultivate the land to advantage & keep up the mill & blacksmiths shop if proper which my Executors may decide the slaves are Jerry Deck Fanny Gabe Mack Joe Fellony Charles Henry (Wagoner) Andrew Tom Miller Peggy Jesse Isaac Smith Sally & son Joe Hal Reubin Anderson Martha Saan Bob Ned & Crilly any part of which may be hired out when ever the number becomes to great for the advantageous cullivation of the land & at the death of my son John F. Dodson & my daughter Affia Townes I will & bequeath the above lott of negroes with the increase to be equally divided among all my grand children namely Sally A. Oliver, Susan L. Boulton, Elisha D. Waller, William J. Waller, John P. Waller & Nancy Dodson to be held by them during their life time & at their death I give the above named & allotted negroes to the heirs of their respective bodies & their heirs forever with the future increase. Item 15th It is my will & intention in making the above & succeding bequests to my grand children that should either of such grand children die childless that all of the portion with the increase of the one so dying (Childless) be equally divided among my surviving grand children for their use during life & then to the heirs of their bodies forever it being my desire object to lend the property so bequeathed to my grand children & to give to the heirs of their bodies. Item 16th It is my will & I hereby bequeath to be divided at my death the following negroes namely Randolph Richard Sandy Lucy John Aggy Sena Rachel Caroline & Bird with the increase of the females after making Nancy Dodson equal with Sally A. Olive & Susan L. Boulton alloting to her one negro worth four hundred dollars the remainder I bequeath to be divided equally among all my grand children namely Sally A. Oliver, Susan L. Boulton, Nancy Dodson, Elisha D. Waller, John Pl Waller & William J. Waller during their lives & at their death I give the respective portions so allotted with the increase of the females to the heirs of their bodies forever. Item 17th It is my will & desire that my son John F. Dodson live & occupy the mansion where I now reside during his life & that himself & family be plentifully supported without encouraging waste out of the profits of my estate in the hands of my Executors & that my daughter Affia Townes may have the privilege of living in the house which John F. Dodson now occupies during her life & be supported also out of the profits of my estate in the hands of Executors it being my wish to provide against her coming to want & this bequest is intended for her individual support nor is she or my son John F. Dodson to have any control over the land negroes mill stock crops or profits of my estate & that no part or portion of the same be liable for their or either of their contracts. I further will & direct that the houses where my son John F. Dodson now resides as well as the houses where I now reside be kept in repair & that especial care be given to ensure comfort & a plentiful support to such of my negroes as may from age or infirmity be incapacitated for labour. Item 18th all monies arising from the profits of my estate after support of my son John F. Dodson & Affia Townes & for such other purposes as I shall hereafter direct I desire to be put at interest until the death of my son John F. Dodson & my daughter Affia Townes. Item 19th Should the provision made be insufficient to pay my debts & monies bequests it is my wish that they be paid out of the annual proceeds of my estate in the hands of my Executors. Item 20th Whereas I have not a perfect title to the land purchased of Boyd but hold his obligation to make me a good and lawful title or my Executors it is my wish that the amount be collected of him should he fail to comply & also out at interest until the death of my son John F. Dodson & my daughter Affia Townes. Item 21st I hereby will & direct that the grave yard at the plantation place where my son John F. Dodson now resides be substanteally walled in with rock & paid for out of the proceeds of my estate in the hands of my Executors. Item 22nd after the death of my son John F. Dodson & my daughter Affia Townes it is my wish that the whole of my landed estate including the land whereon I now live the land where John F. Dodson resides & the land purchased of Boyd amounting to about 800 acres together with the Mill & land purchased of Stamps be sold to the highest bidder or upon such terms as my Executors may deem best also the crop stock & all perishable estate not otherwise disposed & the money arising from such sale of land crops stock & perishable estate & that with all monies debts claims & interest accumulated & all property of whatever description not otherwise disposed o be equally divided between my grand children Elisha D. Waller John P. Waller, William J. Waller, Sally A. Oliver, Susan L. Boulton & Nancy Dodson for their use & benefit during their lifetime & at their death I give their several portions so divided & allotted to the heirs of their bodies forever. Item 23rd To the intent that this & all other bequest by me herein made to my grand children may receive their proper direction I hereby invest my Executors with power & authority & direct them to demand & require such assurance as shall secure the object intended. Item 24th Lastly I appoint my friends Claiborne W. Barksdale, Banister Anderson, Thomas E. Jeter & my grandson Elisha D. Waller & Wilson Oliver Executors of this my last will and testament herby revoking all other & former wills by me heretofore made & request the Court that my Executors may not be ruled to security for their faithful performance. [signed] Elisha Dodson Signed sealed & acknowledge in the presents of interlings & erasions before signed Witness Timothy H. Stamps, John Carter, William H. Adams, Charles H. Moseley June 1st 1846.

At a Court held for Halifax county the 26th day of October 1846 the within written last will and testament of Elisha Dodson Dec'd was presented in court and proved by the oaths of 2 witnesses thereto subscribed and ordered to be recorded and on the motion of Claiborne W. Barksdale Elisha D. Waller & Wilson Oliver three of the Executors therein named who made oath thereto according to Law and entered into and acknowledged 3 several bonds in the penalty of $50000 each conditioned according to Law certificate is granted them for obtaining probate of said will in due form without giving security Teste William Hold CHC"[14]

The following Halifax records show Elisha involved in the estate of Thomas Lawson, whose widow, Hannah Fuqua Lawson, Elisha married in 1789. Hannah Fuqua Lawson had minor children by her marriage to Thomas Lawson at the time of Elisha's marriage to Hannah.

Here is a different Lawson - Francis - who may have had a widow, "Patty" - is this the Martha who receives payments from the estate of Thomas Lawson?

Dodson-2692 and Dodson-340 appear to represent the same person because: Both men are named Elisha Dodson, and both men are born in Virginia and died in Virginia. Elisha Dodson -2692 has different dates and places of birth and death but gives no sources for these dates and places. The dates of birth for Elisha Dodson are based on location of where his parents were living at the time of his birth. Elisha Dodson-2692 has no parents listed. The date and place of death for Elisha Dodson-340 is based on when and where his will was probated. Sources are listed for both wives in Elisha Dodson-340. These men are obvious duplicates and should be merged.

Dodson-594 and Dodson-340 appear to represent the same person because: Dodson-594 is also Elisha Dodson Jr. son of Elisha Dodson and Sarah Averett (Everett) Dodson. This Elisha was also named in the minutes of Broad Run Baptist Church on 9 Oct 1763 as one of the infants received into the care of the church.
