"Mary Dynes wid Relict of Richard Dod of Charles County showed Ye Judge heere that Ye Said Mary Dod upon the first Day of August Last Lying upon his Death Bed by Writing and by her hand and seal in Ye Nature of a last Will and not by Indenture as the law Requires did give unto Ye said Mary all his Estate both Real and personal by ye said Mary during her life and After her Death to his two sons John and Richard to be Equally Divided between them and by them to be Peaceably Enjoyed and quietly Inherited as by Ye said Writing Relation THereunto being more at Large it Doth and may appear and therefore prayed that sommission may issue to Major Benjamin Rozor To take proofs of Ye said Will of ye younger son may not be wronged that par to fo Real Estate Intended him by his decd father.
That commission did find to ye said Rozer to take proofs of ye said Will and to Administer to ye said Mary Ye power of Executrise in case the said Will be proved and that Joseph Cornell and Thomas Baker be apptd that the said Rozor did swear to them And the said Commission with Warrants to Appts and to swear them issued under ye seal of this Court Immediately.'
