Aug 28, 1732 from Benja Douglass, Gent, of CC, to Richard Edelen, Gent, of sd place, for 14 £ sterling, all that part of that tract of land in CC called New York, being on the north side of Cuckolds Cr formerly called Back Cr, it being part of a tract of land formerly taken up by John Mansell of the afd county (the whole taken up for 500 acres and conveyed from sd Jno Mansell unto James Turner of the same county, who died possessed thereof, without heirs, whereby the same became escheat), this being the westernmost part of the afd tract, bounded by the afd Cr, containing and laid out for about 188 acres. Prince George's Land Records 1710-1717 - Liber F -folio 386; Benjamin Douglass of Charles County, planter, states his late grandfather, John Douglass, Gentleman of Charles County owned a parcel of land in Prince George's County in the freshes of the Patuxent called Cold Spring Manor containing 1,050 acres of land; by his will dated 14 Dec 1678 he left 500 acres of this land to his sons, Charles Douglass and Joseph Douglass, when they reach 21 years of age; Joseph and Charles Douglass sold a 100 acre part of the 600 acres to Francis Collyer of Prince George's County and 370 acres to Guy White, deceased; for 10£ Benjamin Douglass acknowledged these deeds Signed: Benja. Charles County Court Records, March 1737/8 Court, Liber T#2, Page 430. Pursuant to the order of last Nov Court, Commission issued to examine witnesses touching the bounds of a tract of land called Asher, in possession of Rando: and Jacob Brandt. Commissioners appointed: Major Robert Yates, Capt: Benjamin Fendall, Mr. Richard Marshall, and Mr. Philip Lee (not being any way related to the Petr, contiguous Proprietor, nor interested in the sd land). Asher is in CC. The purpose of the Commission was to prove and perpetuate the memory of the bounds of sd tract of land. And now here, at Mar Court, Benjamin Fendall and Philip Lee return to this Court the Commission afd, with the following certificate and depositions thereto annexed: We certify that on Dec 20, 1737, we did meet on the land within mentioned, and then and there, in presence of all parties concerned that were there present, took the following depositions. Francis Glass, age about 60, deposes that about 31 years ago, he lived with Charles Brandt, and that the sd Brandt showed him a small valley falling into the head of a marsh belonging to Peters Cr, at the bottom of which valley stands a large, black gum adjoining the afd marsh, the valley and marsh being contiguous to and on the north side of the mansion house of Jacob Andrew Minitree, joiner, and told the deponent that the valley divided the lands between him and George Newman. This deponent further says that he helped to clear the ground on the north side of the valley for Charles Brandt, without let or hindrance from George Newman. Signed - Francis Glass.

Priscilla Newman, aged about 35, deposes that there was a potato patch on the north side of the afd valley, about 40 yards from the black gum afd, which sd potato patch this deponent has heard her decd husband, John Newman, say was on the land of Charles Brandt afd. Signed - Priscilla (X her mark) Newman.

Benjamin Douglass, age about 50, deposes that, to the best of his knowledge, the land on the north side of the afd valley, was cleared and cultivated by Charles Brandt without interruption, let, or hindrance from George Newman, owner of the land on the south side of the valley, but whether sd land was tended by sd Brandt as far as the valley, this deponent knows not. Barton Hungerford, age about 51, deposes that about 40 years ago, he was in company with Sam:l Fearson near the above valley, and that sd Sam:l Fearson showed him a tree which he informed this deponent, was a bound tree between Mr. Charles Brandt and George Newman. Signed - Barton Hungerford.

Capt. Joseph Douglass, age about 63, deposes that about 30 years ago, he was in company with George Newman near the abovesd valley, and that sd George informed him that he thought his neighbor Brandt encroached upon him, and farther this deponent says not in relation to the abovesd valley. But this deponent says also that the marsh between him and Randolph Brandt's has, for 20 years past and upwards, been reputed and commonly known by the name of Cottralls Mart [Marsh].

Elizabeth Sims, age about 35, deposes that to the best of her knowledge, John Newman told her that, in the above valley, he was in company with George Newman at the time that Charles Brandt was clearing the ground on the north side of sd valley, and adjoining to it, and that sd George Newman told sd Charles Brandt not to clear any further, for that he had cut down one his sd Newman's line trees, which stood in the afd valley near the marsh first before mentioned. Whereas by deed dated Mar 27, 1714 between Benjamin Dowglass of Charles County, planter, grandson & heir at law of John Dowglass, late of the same county, Gent., of the one part, and the sd Francis Collier (the uncle of the sd Charles Collier, which sd Charles Collier was father to the now Francis Collier, party to these presents), by which deed it was recited that whereas the sd John Dowglass, in his lifetime, was seized of a parcel of land lying in the Freshes of Petuxent River in PG called Cold Spring Manor, containing 1050 acres & by his will dated Dec 14, 1678, devised to his son, John Dowglass, father to the sd Benjamin, 550 acres of land, being part of Cold Spring Manor, when he arrived at age 21, with all the privileges belonging to the Lord of a Manor and to his hetrs, which parcel of 550 acres the sd John Dowglass, father of the sd Benjamin Dowglass, by his PG deed, sold to sd Francis Collier, and whereas likewise, by PG deed dated May 27, 1701 between Joseph Dowglass of Charles County, Gent., of the one part, and the afd Francis Collier decd of the other part, sd Joseph Dowglass sold to sd Francis Collier, part of a tract of land containing 1050 acres of land called Cold Spring Manor, formerly granted to Capt Josias Fendall, bounded by a parcel of land that John Dowglass sold to sd Collier standing on the brow of a hill between the two branches of Fendalls Fresh, containing 100 acres. Now this deed witnesses that the sd Francis Collier, party to these presents, for 30 £, sells to sd James Edmonston, all the sd tract of land containing 550 acres, and all that other tract of land containing 100 acres. Charles County Court Records, August 1742 Court, Liber T#2, Page 419. Benjamin Douglass, by his petition, sets forth that he is in possession of a tract of land in William and Mary Parish known as Blythwood, the bounds thereof being much decayed, asks for a Commission to prove and perpetuate the sd bounds. Ordered that Commission issue, returnable to Robert Yates, Charles Yates, William Penn, and Barton Warring, giving them power to examine witnesses in regard to the bounds afd.

Pursuant to the order of last Aug CC Court, Commission issued, returnable here, in response to the petition of Benjamin Douglass, dated Aug 10 in the 28th year of our Dominion, to Robert Yates, Charles Yates, William Penn, & Barton Warren, Gent, to examine witnesses touching the bounds of a tract of land called Blythwood, lying in CC in William and Mary Parish, in the possession of Benjamin Douglass, as follows: To Robert Yates, Charles Yates, William Penn, & Barton Warren, Gent, (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land) you are empowered to examine witnesses as afd. Signed Aug 14, 1742 - Edmd Porteus, Clk. And now here, Charles Yates and Barton Warren, two of the Commissioners afd, return to the Court here the Commission afd, viz - We, appointed to examine witnesses touching the bounds of the within land called Blythwood, now in the possession of Cap: Benjamin Douglass, met on the premises on Thursday, Sep 13, and took the within depositions. The deposition of Richard Smith, aged about 54, who says that about 30 odd years ago, William Nicholls showed this deponent a bounded hickory tree standing on a yellow knoll on the east side of the main Road that comes from Pickawaxon Church to Portobacco near the top of a hill, and that the afd tree was a bounded tree of Robert Douglass, the afd land being now in possession of Benjamin Douglass. The deposition of Richard Masten, age about 37, who says that about 3-4 years ago, Richard Smith told this deponent that there was formerly a bounded tree of Robert Douglass standing on a yellow knoll, and believes it to be the place that is mentioned in the deposition of the afd Smith.
