Discrepancy

• This profile represents William Duncan, son of Charles Duncan and Sarah Browning, Married Lucy Bywaters and Sarah Collins (updated May 2021)

No original source records have been located to confirm birth or marriage records. It appears that some erroneous information may have been published, and perhaps republished/reported, making the “actual facts” obscure. There is a great deal of conflicting information surrounding the Duncan Family of Culpeper – Many Source-to-Source discrepancies; co-mingling, Lack of records; conflicting family stories; number of Duncan’s with the same names, (Many Duncan/Browning/Norman intermarriages), etc.

Parent Conflict (Culpeper was formed 1748 from Orange) Correct Parent is most likely Sarah Browning as she moved to Madison KY with children after Charles died and her Probate affidavit supports son William at this location - However, source to source Histories (and Grimsley Research and Duncan Comparison states that Norman's son married Bywaters. (Original error probably as a result of Grimsley's Culpeper Research) and the Robert Bywater's land transaction with William/Rawley).

For Years, the two Williams were thought to be Cousins (sons of Brothers who moved together) - Cross researching via Collin, Duncan, Oldham families have Proven The same William married both Bywaters and Collins. H. Miller Richmond, KY 1907 same page lists Sallie Collins as a member -- all received on second Saturday October 1797,]

I William Duncan of the County of Franklin in Tennessee Wish my estate disposed of, After my death as follows: (VIZ)

I give to my Wife Sarah during her life of widowhood my farm on which I now live situated in said County of Franklin the slaves Old Retter, Ann Dick, Austin & Richard, a wagon & Harness & as much as she may desire of my stock of horses, cattle, hogs, sheep, poultry provisions produce on hand & Farming utensils.

I give to my Wife absolutely with the within mentioned restrictions whatever money I may have on hand at my death.
I have heretofore given to my daughter Susan Wife of William Cowling a woman slave named Susan valued at $650.00
and to my son William W Duncan a boy slave named Nathan valued at $650.
I desire the residue of my slaves except those given to my Wife to be valued by the one who executes this Will. If I do not value them myself before my death &
I give to my daughter Sarah Wife of Joel Chitwood the slave Sarah
to my daughter Polly Wife of Robert Taylor the slave named Elizabeth &
to my daughter Margaret the slave young Retter and
to my son Robert B Duncan & my daughter Edy Coon the slave young Retter of Levi, should the said slaves Sarah, Elizabeth, young Retter of Levi or any of them die before me those to whom said slaves are given respectively are not to lose thereby
I give to my other children by my last Wife a slave a piece or the value thereof and they are to draw lots (816) for their said slaves.
I give the residue of my slaves to my Wife Sarah during her life or widowhood should old Retter serve me & my Wife she may choose a Master of Mistress among those who take under this Will & the one so chosen must take & support old Retter comfortably.
I give to my children by my last Wife Eighty dollars a piece &
to my daughter Margaret in addition thereto a horse & saddle & bridle a bed bedstead & furniture a cow and calf a sow and pigs a ewe & lamb.
I give to Robert and Elizabeth Oldham children of Jesse Oldham by my daughter two hundred dollars apiece if that sum does not amount to more than their share under the terms of this Will. If it does it must be Reduced accordingly. If there be anything undisputed of it must be sold and my debts & the expenses of executing this Will paid out of proceeds of the sale. If not sufficient the same must be paid out of any money I may leave on hand if that should not be sufficient the beneficiaries under this my Will must contribute thereto or the same must be paid out of the proceeds of the sale which must be made at the death of my Wife should she survive me or at the termination of her widowhood the residue of my estate. Real & personal must be sold & the one who exercises this Will is Authorized to the same to the purchaser by deed or otherwise & the proceeds of this sale as well as the proceeds of the first mentioned sale (if more than sufficient for its objects) after making my children by my last wife equal in their slave value under this Will shall be divided share and share alike among my children by my Wife and my son Robert B Duncan and my daughter Edy Corn & their representatives should and of my children now living die without issue the portion entered for such child under this Will shall go to his or her brothers & sisters & their issue in Among my sons Robert B Duncan and OHPB Duncan Executors of this Will but should they or either of them not serve I give to the one who finally executes this Will the same power which my first named Executors could exercise.
