DAVID DAVIS to ZACHARIAH ARES., DAVIS & ARES agreeing to have the land run out according to plat signed & certified by ARTHUR MIDDLETON, Dep. Sur., 12 Dec. 1704. Whereas ARES left only 1 daughter & sole heiress, ELIZABETH, who married THOMAS ELLIS, died, & left 2 daughters, ELIZABETH & MARY, co-heiresses; & whereas ELIZABETH died, under age & unmarried; & MARY who had married ZACHARIAH STORY, carpenter, of James Island, & after his death married THOMAS SOISSIONS, party hereto, became sole heiress to the 2 tracts; now MARY & THOMAS SISSONS agree with STILES, GUY & STORY as follows: That whereas ZACHARIAH STORY willed to his son ZACHARIAH STORY the 2 tracts although the right of inheritance lay only in his then wife MARY (now MARY SISSON), & whereas STILES, GUY & STORY were appointed executors of the will, the remaining money after discharging all debts being £ 600; the executors agree to let the SISSONS have the use of the land until ZACHARIAH STORY (son) reaches 14 yrs. of age in consideration of bringing up & furnishing ZACHARIAH & ELIZABETH, his sister, with clothing, "meat, drink, washing, & lodging, wholesome & sufficient, answering at least to such interest money might arise from the same with schooling reasonably deemed", then at proper time, the SISSONS shall pay the executors £ 600.
