Hester Evans was born about 1645 in England. Her parents are uncertain -- see Research Notes. [2]
Find-a-Grave shows Hester Evans Smallwood born 1633, no place specified. [3]
Marshall states that she came to America 1650, according to James Smallwood's land grant application. [2] It is not clear then, if she were 5 years old, if she arrived as part of a family.
About 1664 in Charles County, Maryland, she married James Smallwood, born 1638 in England, d. 12 Jan 1714/15, Charles County, Maryland - Probate (Age 77 years) [2]
Find-a-Grave gives the marriage year as 1666 and her husband's name as James Matthew Smallwood (1639–1714) [3] Note that double given names were extremely unusual in this time period and generally indicate that two or more persons have been conflated.
Lt. Col. Smallwood was a soldier, merchant, attorney and large landowner with a tobacco plantation. He is believed to be the son of Matthew Smallwood (1585-1650) and the former Ann Whittington. [4]
Lt. Col. James Smallwood and his 1665 bride, Hester Evans, were both born in England and married each other in Charles Co., Maryland in 1665. She belongs to the family of the first Evans immigrant to Maryland. [4]

William Evans died in 1646 leaving a widow Ann.
However, another source refers to William Evans (Sr.?), the immigrant, as born about 1597, married to Ann Norris, and who is probably the William Evans who died in 1651 in Charles County.[4]
This date is problematic if it is his widow who remarried in 1646, and whose widow then married John Nicholls.
As early as December 1646 John Nichols married Ann, the widow. At that time he was reimbursed out of the William Evans estate.
In 1661, Esther Nicholls, daughter of John Nicholls, is under 18 (born not earlier than 1643), and involved in a disputed indenture.
This leaves open the question of whether Esther / Hester was born between 1643 and 1646, in which case she was the daughter of William Evans and then adopted by John Nicholls, or whether she was born after 1646 and was the biological daughter of John Nicholls and William Evans' widow Ann.

Smallwood-Evans Lineage
The following line of descent from Hester Evans and James Smallwood was given to this author in the 1970s by researcher Mary Ann (Ward) Brady, who was born in 1913 at Muncie, Indiana. [4]
Readers should use data from this lineage—and from all undocumented online lineages—only for clues leading to their own documented pedigree.
Last name believed to be Evans from will of John Evans, evidently her brother; gives us names of parents. [2]
She was the daughter of William Evans and Alice Norris. [2]
Hester Evans was thought to be the daughter of William Evans, who immigrated in 1630 and died in 1651, whose widow remarried John Nicholls before the birth of daughter Hester. Therefore, it was not certain if her father was Evans or Nicholls. Hester died in 1693. [4]
Evans Family is a Researcher’s Headache. Much about the first Williams Evans, who was in Maryland by 1650, is shrouded in mists of the past. We don't know if William was accompanied by his English family. Indeed, it is difficult to separate him from a younger William Evans also in Charles County, Maryland, in the 1650s. [4]
William Evans (Sr.?), the immigrant, was born about 1597, married Ann Norris, and is probably the William Evans who died in 1651 in Charles County.[4]
In 1655, a Captain Evans was captured at the Battle of the Severn between Catholics and Protestants, tried and sentenced to death, but subsequently released. This William Evans, however, died in 1668, so must be a different William Evans. [7]
It was probably this Capt. William Evans who was appointed by Gov. Josias Fendall in 1658 as officer in charge of all forces between “Wicocomaco River and Poplar Hill exclusively, them to muster Exercise and traine up in the art of Warre.” [4]
Genealogists are urged not to copy data on the first three generations of Maryland Evans family members from web-based family trees. They are full of contradictory parent-child relationships and such impossible dates as a daughter being born before her mother! Unfortunately, dozens of inexperienced family researchers have copied and proliferated these unproven conclusions.[4]
In the proceedings of the Maryland Provincial Court, 1661, is found a dispute between John Nicholls and John Nuthall concerning the servitude of Nichols' daughter Esther Nicholls. John Nicholls had indentured his daughter for service in the household of Captain Thomas Cornwallis; in exchange for her service to his wife, she would be taught domestic skills and freed when her term was over. Cornwallis, however, died, and the indenture passed to John Nuthall. [8]
Esther ?Hester? is named by the court and called ?my daughter? by John Nichols. A jury of 12 in the Lower Court who ?find this Indenture illegal, deceitful, and void? sets Hester free. [9]
The Indenture has the distinct John Nichols mark and Hester Nichols her + mark. Archive editors show the John Nichols mark as overlapping Hs. His actual mark looks like a rope with a knot in the middle and knots on each end with the rope protruding from the ends. [9]
Thomas Cornwallis, a previous Lt. Governor, in a self-righteous harangue petitioned to bring the case to the Court of Chancery on a claim of error. Cornwallis crudely disparaged the Nichols and the only witness who did support the Nichols. [9]
In the Provincial Council in 2 to 3, the Nichols case is lost and Hester must serve out her term. [9]
Mr. Secretary [Mr. Henry Sewall] and Mr. Jerome Whyte declared the Indenture insufficient because there was no consideration specified at the expiration of the said Hester?s time and because she was not brought before a magistrate as should have been done. The other 3 declared the Indenture valid. Counselor was Baker Brook [married Anne Calvert]; Chancellor was Phillip Calvert; Governor was Charles Calvert. [9]
Also, there was no term of service specified in the Indenture although Cornwallis discussed the disagreement about a term of 5 years or 7 years. The two Indenture witnesses were not called to testify the Nichols understood the words although the Nichols only signed by marks.
