Probate
Elisha Foster of Scituate, gentleman died intestate and on 28 May 1771, John Foster of Scituate was granted the administration of his estate. His inventory was taken on 30 May 1771 in Scituate. It included an enslaved mulatto boy named Mark.[16]
In 1772, an account of his estate by John Foster was recorded which included funeral charges, debts paid, necessaries to the widow, and administration fees. His widow, Temperance was appointed guardian of his minor daughters, Mary and Ruth.[17]
In 1772, the court found that his estate could not be divided without prejudice, so the estate was settled upon the eldest son, John Foster, and he agreed to pay out to the other children their share, viz., Barsheba, wife of Seth House of Hanover, Elisha Foster, Temperance Foster, Sarah Foster, Mary Foster, and Ruth Foster.[18]
