"Thomas Gilbert, of Brinklow, publican, was charged with refusing to pay James Whitehead £1.1s.6d. for work and wages under the following circumstances. Whitehead stated that in consequence of a previous conversation with defendant, he was engaged on the 27th of March last, to repair his pump at Brinklow, and he promised to pay him whatever it came to as soon as the work was done. He went over to Brinklow on that day, and informed Gilbert that he had brought everything with him that would be necessary to complete the repairs, and he would do the work either by the job or by the day, his charge would be 3s.6d. a-day for himself, and the same for a man, his assistant: he appeared to be satisfied with the terms and ordered them to commence immediately; they were occupied two days, and finished the repairs to defendant's satisfaction. Upon asking for payment, Gilbert said he must first see his landlord, and if he (Whitehead) would call the next day he would receive his money. He did call, and was informed by Gilbert that his landlord refused to pay, and he, himself, could not, as his landlord refused to allow him to stop the money out of his rent; the charge was for two days' work for himself and his man, which amounted to 12s, the other part of the account was for materials used in the repairs of the pump. It being considered by the Magistrates that this was a contract in which they could exercise no jurisdiction they dismissed the case, Whitehead having to pay the expenses, 11s. 6d."
