Rhodes, one of the devisees under the last will and testament of Samuel J. Grimes, in respect to certain real estate described in this suit. SECOND that the defendants are all residents of the District of Columbia and are sued in respect to the same real estate in the following manner: Mary S. Cohill and Cinderella E. Grimes are sued as devisees under the said will of Samuel J.Grimes; the said Henry R. Cohill and Richard F. Grimes are sued as the husbands of Mary S. Cohill and Cinderella E Grimes; and the defendants Henry Grimes, Grace Grimes, and Alfred Grimes are sued as heirs at law of the late Alfred T. Grimes, one of the devisees under the last will and testament of the said Samuel J. Grimes deceased. THIRD that on or about the 20th day of March 1868 [sic] the said Samuel J. Grimes departed this life leaving a last will and testament executed and published on the 18th day of March 1867 [sic] and admitted to probate in the Supreme Court of the District of Columbia on 6 April 1867 (Will Book 10 p. 342). FOURTH that the said Samuel J. Grimes died possessed of real estate on the east shore of the Eastern Branch of the Potomac River near the Navy Yard Bridge (legal description) and three burial sites located in the congressional burying ground (description). FIFTH that by the last will and testament of said Samuel J. Grimes the real estate was devised to his wife Henrietta Grimes during her lifetime and after her death to his brothers and sisters share and share alike. SIXTH that after Samuel J. Grimes' death, his widow the said Henrietta Grimes took possession of said real estate and continued in possession thereof until her death in Nov. 1877. SEVENTH that the said Samuel J. Grimes had one brother, Alfred Grimes, and three sisters, Mary S. Cohill, Cinderella Grimes and Sarah E. Rhodes who were entitled to said real estate on the death of the life tenant, Henrietta Grimes; that on [blank] day of [blank] 1868 the said Alfred Grimes departed this life leaving a widow who has since died and three children the defendants Henry Grimes, Grace Grimes and Alfred Grimes the last two being still minors; that on or about the 2nd day of February 1878 the said Sarah E. Rhodes died also leaving besides her husband, three children as her only heirs at law, the complainants Margaret A. Rhodes, Mabel Rhodes, and Edna J. Rhodes, still minors. EIGHTH that since the death of said Henrietta Grimes and the death of said Sarah E. Rhodes, complainants and defendants are the only persons who are in any way entitled to any interest in said real estate under the last will and testament of said Samuel J. Grimes. NINTH Complainants represent that said real estate is presently yielding no income whatsoever on account of the unsettled condition of the property there being no person authorized to manage said property and collect the income.

    • Complainants therefore pray:
    • FIRST that guardians at litem be appointed by the Court to defend the rights of the infant defendants Grace Grimes and Alfred Grimes. SECOND that a trustee be appointed to take charge of and collect the rents now due from the tenants of the real estate in question, and to make sale of said real estate and divide the proceeds among the parties entitled thereto under the last will and testament of said Samuel J.
