This is the last Will and Testament of Robert Harris the Elder hertofor of Cannon Street London hatter and haberdasher but now of Wandsworth in the County of Surry Gentleman whereby I do dispose of all my Estate and effects in the manner and form following (that is to say) first I give and Bequeath to my son John Harris all that my leasehold Estate for L---- consisting of a Messuage or Tenement with the appertenances and the two closes of Land hereunto belonging commonly called or known by the name of Middle Crott containing by Estimation twelve acres more or less situate and being at ffordingbridge in the County of Southampton now in the tenure or occupation of Daniel Brisey? his undertenants or assigns to hold the same unto my son John Harris and his assigns for and during the term of his natural life and from? and after his decease I give and bequeath the same unto my son Joseph Harris his executors administrators and assigns to and for his and their own proper use and benefit and I give and Bequeath unto my ffour sons John Harris Joseph Harris Richard Harris and Robert Harris the sum of three thousand ffive hundred pounds a piece to be paid to them respectively within six months next after my decease and in case any or either of them my said sons shall happen to be indebted to me at the time of my decease in any sum of money then I order that the debt or debts due and owing from him or them shall be sett off against or deducted from the Legacy or Legacys so given to him or them as aforesaid and I give and bequeath unto my Daughter Sarah Harris spinster the sum of one thousand eight hundred pounds to be paid to her within six months next after my decease together with interest for the same after the rate of ffive pounds per cent per annum from the day of my decease also I give and bequeath unto my said Daughter Sarah Harris the Gold watch which she now wears together with the chain and trinkets thereunto belonging also I give and Bequeath unto my said sons Joseph Harris and Richard Harris and my Nephew Richard Harris of London Linendraper (whom I have appointed joint executor of this my will) the sum of three thousand pounds three per cent consolidated bank annuities upon Trust nevertheless that they my said Trustees and Executors and Survivors and Survivor of them and the Executors and Administrators of such Survivor do and shall pay the interest dividends and proceeds thereof from time to time as the same shall become due and be received by them into the proper hands of my said Daughter Sarah Harris to and for her own sole seperate personal and peculiar use and benefit exclusive of any husband with whom she may marry for and during the term of her natural life and I do hereby expressly order and direct that such interest dividends and proceeds or any part thereof shall not be in any wise subject or liable to the debts Incumbrances? Intermedling Disposition or Controul (sic) of any such husband but the receipt of my said Daughter alone shall from time to time not withstanding any such Co__ecture? be a sufficient discharge for the same and from after the decease of my Daughter Sarah Harris I give and Bequeath the said sum of three thousand pounds three per cent Bank annuities unto or amongst all and every of the child and children of my said Daughter Sarah Harris which shall be living at the time of her decease equally to be divided between them if more than one share and share alike and if but one to such one child be transfered to such child or children at his her or their age or respective ages of twenty one years and I will and direct that my said Trustees and Executors shall and may from and after the decease of my said Daughter Sarah Harris pay and apply the whole or so much of the Interest dividends and proceeds of the said three thousand pounds three per cent consolidated Bank annuities as they in their discretion shall think proper in the maintenance education and bringing up of the children of my said Daughter until such child or children shall attain the said age of twenty one years so as that no more than the share therein of each respective child be applied in his or her maintenance education and bringing up but in case my said Daughter Sarah Harris shall happen to be leaving without child or children living at the time of her decease or leaving such they shall all die before they or any of them shall attain the age of twenty one years then I give and Bequeath the said sum of three thousand pounds three per cent consolidated Bank annuities unto and amongst all and every my Grand children living at the decease of my said Daughter share and share alike to be transfered to them at their respective ages of twenty one years and in the mean time I will and direct that my said Trustees and Executors shall and may apply the whole or so much the interest dividends and proceeds of the said three thousand pounds three per cent consolidated Bank annuities as they in their discretion shall think proper in the maintenance education and bringing up of my said grandchildren until they shall severally attain the said age of Twenty one years so as that no more than the share therein of each respective grandchild be applied in his or her maintenance education and bringing up and I give and Bequeath unto my Daughter Margaret the wife of James Masterman the sum of one thousand pounds to be paid to her within six next after my decease together with the interest of the same after the rate of ffive pounds per cent per annum from the day of my decease and I will and direct that the said last mentioned Legacy be deducted out of the debt or debts which shall be owing to me from the said James Masterman at the time of my decease it the said debt or debts shall be sufficient for that purpose otherwise so far as the same will extend also I give and Bequeath unto my said Trustees and executors the sum of one hundred pounds per annum Long? annuities now standing in my Name in the Book of Govener? and company of the Bank of England upon Trust nevertheless that they my said Trustees and Executors and the Survivors and Survivor of them and the Executors and Administrators of such survivors do and shall pay the said annuities from time to time as the same shall become due and be received by them into the proper hands of my said Daughter Margaret Masterman to and for her own sole seperate personal and peculiar use and Benefit Exclusive of her present or any after taken husband for and during the term of her natural life and I do hereby expressly order and direct that the same or any part thereof shall not be in any wise subject or liable to the debts Incumbrances Intermedling Disposition or Controul (sic) of any such husband but that the receipt of her my said Daughter alone shall from time to time notwithstanding her Covecture? be a sufficient discharge of the same and from and after the decease of my said Daughter Margaret Masterman I give and Bequeath the said sum of one hundred pounds per annum long? annuities unto or amongst all and every child and children of her my said Daughter which shall be living at the time of her decease equally to be divided between them if more than one share and share alike and if but one to such one child to be transfered to such child or children at his her or their respective ages of twenty one years and I will and direct that my said Trustees and Executors shall and may from and after the decease of my said Daughter Margaret Masterman pay or apply the whole or so much of the said annuity as they in their discretion shall think proper in the Maintenance Education and bringing up of such child or children until he she or they attain the said age so that no more than the share therein of each respective child be applied in his or her Maintenance education and bringing up but in case my said Daughter Margaret shall happen to die in the life time of her husband the said James Masterman without leaving any child or children living at the time of her decease then I give and Bequeath the said one hundred pounds per annum long annuities unto the said James Masterman for the term of his natural life but in case the said James Masterman shall be then Dead and there be no child or children of my said Daughter Margaret his wife then I will and direct that the said one hundred pounds per annum long annuities shall be divided into five equal parts and I give and Bequeath one of five equal parts unto and equally among the children (if more than one) of each of my sons and daughter John Harris Joseph Harris Richard Harris Robert Harris and Sarah Harris and if but one child of each son and daughter to such one child and in case any or either of my said sons and daughter shall happen to die without leaving any child or children him or her surviving then I give and Bequeath the part or share of the said one hundred shares per annum long annuities intended to his or her children unto and amongst all and every my grandchildren then living equally to be divided between them share and share alike to be transfered to them at their respective ages of twenty one years and in the mean time I will and direct that my said Trustees and Executors shall and may apply the whole or so much of the said Annuities as they in their discretion shall think proper in the Maintenance Education and bringing up of my said Grand children until they shall respectively attain the said age of Twenty one years so that no more than the share therein of each respective Grandchild be applied in his or her Maintenance Education or bringing up also I give and Bequeath unto all and every my Grandchildren who shall be living at the time of my decease or whom the ______ of my said Sons or my Daughters shall be then ____________ with and shall afterwards be born alive the sum of one hundred pounds a piece and I order and direct the same shall be laid out one ________ sum in Government Securities in the Names of my said Trustees and Executors and that the accumulating and acruing dividends thereof shall be added to the principal and shall once in every year be laid out and invested in the same ffund with the principal until the same shall become payable or transferable as hereinafter mentioned and as and when my said grandchildren shall _______________
and respectively attain their __________ and respective ages of Twenty one years I will and direct that the part or shares of each Grandchild therein shall be payed and transfered to him or her respectively and in case any of them shall happen to Die before attaining the said age of Twenty one I will and direct that the part or share or him or her so Dying shall go to and be divided amongst the survivors and if but one survivor to such surviving Grandchild but no benefit of survivorship accrue??? to such of my Grandchildren as shall live to attain the said age of Twenty one years after becoming intitled to receive their respective shares of the said Legacy and I order and direct that the Lease of my Dwellinghouse and premises with the appertenances situate at Wandsworth aforesaid and now in my own occupation together with all and singular the ffixtures thereunto belonging which are my property shall be valued at ffour hundred and Twenty pounds and in case eather of my said ffour sons shall chose? to take it at that price for his own residence preference being given to them according to thier seniority) the same with all and singular the appertinances thereunto belonging shall be assigned over to such son by my Executors for that sum but in case neather of my said sons shall ______ to give that sum for the said Lease and premises? for his own residence then I order and direct that the same shall be put up to sale by public auction to the best Bidder and in either of the said cases I direct that the money arising from sale thereof shall fall unto the residence? of my Estate he? matter? disposed of and I give and Bequeath unto my son in law Joseph Peckover the sum of ffifty pounds as a token of my regard for him and I give and Bequeath unto my said Nephew Richard Harris the Sum of ffifty pounds as a recompence for the trouble he may have in assisting the execution of the Trusts of this my will also I give and Bequeath unto my Housekeeper Harriett Lindoc? the sum of ten pounds in case she shall be living with me at the time of my decease also I give and Bequeath unto my servant Thomas Chooseman? all my wearing apparel both woolen and linen and also my silver shoebuckles and sauce? Buckles together with the sum of ten pounds in case he shall be living with me at the time of my decease also I give and Bequeath unto my servant Sarah ffreeman the sum of ten pounds in case she shall be living with me at the time o my decease also I give and Bequeath unto my servant Ann ffreeman the sum of ffive pounds in case she shall be living with me at the time of my decease all the rest residue and remainder of my Estate and effects whatsoever and wheresoever or of what nature kind or quaility (sic) soever (from and after payment of all my just debts Legacy and ffuneral expenses I give and Bequeath equally among my ffour said sons John Harris Joseph Harris Richard Harris and Robert Harris absolutely share and share alike and to their respective Executors administrators and assigns and I do hereby declare that is shall and may be lawful to and for my said Trustees and Executors and each of them his and their executors and administrators from time to time deduct and retain to and reemburse himself and themselves out of my estate and effects all such costs charges damages and expenses as they any or other of them shall or may at any time sustain undergo expend or be put unto in or about the execution of the Trust hereby in them reposed or in any respect related thereto and that my said Trustees and Executors or any of them shall not be Answerable or Accountable the one for the other or others of them but each one only for his own seperate Acts Deeds Defaults and Receipts nor shall them any or other of them be liable to make good any involuntary loss or losses that may happen by or out of any part of my estate or the produce thereof or for any sum or sums of money for which they or any of them shall join in any receipt? or receipts for conformity and lastly I do hereby _________ nominate and appoint my said two sons Joseph Harris and Richard Harris with my said Nephew Richard Harris joint executors of this my last will and Testament and hereby revoking and making void all former and other wills by me at any time heretofor made I declare this to be my only and last will and Testament in witness whereof I the said Robert Harris have to this my last will and Testament contained in this and the ffour preceding sheets of paper set my hand and seal (that is to say) my hand to the ffirst ffour pages and my hand and seal to this ffifth and last sheet thereof this third day of September in the year of our Lord one thousand seven hundred and eighty nine Robt Harris Signed Sealed Published and __________ by the said Robert Harris the Testator as and for his last will and Testament in the presence of us who have hereunto at his request and his sight and presence and in the sight and presence of each other subscribed our names as witnesses to the execution thereof John Sudlow Any?
