Comes now the plaintiff by his attorneys and the defendant comes by John D. Alexander her attorney and by agreement this case is set down for trial by the court and after hearing the evidence and being fully advised in the premises the court finds for the plaintiff and assesses his damages at $40.00.

It is therefore considered by the court that said plaintiff recover of said Administratrix to be levied of the assets of said estate the sum of forty dollars and his costs herein laid out and expended.^[5]
