Posted by: Ruth V Jean- Eli Vinson is the son of Benjamin Vinson and Ester Hearne-born Somerset/Worchestor Co. Maryland in 1770 and died in Fleming Co. KY in 1845 I have a copy of his will and also a copy of Benjamin's will and these are true facts.

A full transcript of Thomas Hearnes fill follows. This, at least, gives you the full benefit of the wording of the original will in the Maryland archives.
"In the Name of God Amen the twenty Seventh Day of January in the Year of our Lord God One thousand Seven hundred and Sixty two I Thomas Hearne of Sommerset County and province of Maryland being very sick in Body But of perfect mind and memory thanks be to God for the same Therefore calling unto mind the mortality of my Body and knowing that it is Appointed for all men once to die do make and ordain this my last will and Testament in manner and form as follows First of all I give and bequeath to my Son George One negro fellow Called Hercules Also I give to my Son Ebenezer One Negro fellow Called Jeffrey and also as much Tobacco as shall get him Five pounds Sterling Also I give to my son Thomas Hearne a Negro Wench Called Sue Also I give to my Daughter Elizabeth Wife of Isaac Moore One Negro Wench Called Patience Also I leave to my Grand Sons Elisha Hearne William Hearne and Joshua Hearne the Sons of my Son Nehemiah Hearne One Negro Boy the Eldest of them to have the Boy and to pay the other two five pounds a peice It being the full whole part of my Son Nehemiahs Portion out of my Estate. Also I Give to my Daughter Jemima Hearne one Negro fellow Called London and I order that the said negro be hired out till she is of age or married the money for the hire of the said Negro to be applied toward Maintaining my Youngest Children as also one good Feather Bed with Furniture and Bedstead to my said Daughter Jemima and a Good likely Cow and Calf also a large pewter Dish and large pewter Bason Also three new pewter plates and three new pewter spoons also one Spinning Wheel Also I give and bequeath to my Son John Hearne One hundred Acres of Land lying and being in Sommersett County Called Hearns Venture with all and every the Ap-purtenances thereunto belonging to him and his heirs forever Also I give and bequeath to my Son John Hearne fifty Acres of Land Called St Kitts It lying and being in Sommersett County also a Tract of Land called Tower Hill Containing fifty Acres it lying and being in Sommersett County The said Tracts of Land I give to him and his heirs forever Also I give to my Son John Hearne one good Feather Bed and furniture and Bedstead and one likely cow and calf one large new pewter Dish one Large new pewter Bason three new pewter plates and three new pewter Spoons and one Small Gun and my Black Vest and Breeches and my best Hatt Also one Negro Wench Called Doll and her Increase and one Negro Wench Called Hannah to him and his heirs forever Also I give and bequeath to my Daughter Mary Wife of Joshua Morgan twenty pounds to be levyed out of my Estate it being the full of her portion out of my Estate Also I give and bequeath to my Daughter Sarah Hearne One good Feather Bed and furniture and one Bedstead and one likely Cow and Calf and one pewter Dish and one pewter Bason and three new sppons and one Negro Girl Called Pegg to her and her heirs forever Also I Give and bequeath to my Daughter Ann Hearne One Feather Bed and furniture and One Bedstead and one Cow and Calf and One pewter Dish and Bason and three new pewter Spoons Also I give to my Daughter Ann One Negro Boy Called Andrew to her and her heirs forever Also I give and bequeath to my Daughter Esther Wife to Benjamin Vincient one Negro Boy Called Holborn to her and her heirs forever Also I Give and Bequeath to James Hearne the Son of William Hearne One hundred and fifty Acres of Land taken out of a Tract of Land Called Stains containing four hundred and twenty Acres lying and being in Sommersett County near a Branch Called Coxes Branch Also I Give the remainder of my personable Estate to be divided amongst all my Children and they that take the most Valuable Effects to let the others have in proportion the more of other Goods Also I Appoint and Constitute my Son Thomas Hearne my only and Sole Executor of this my last Will and Testament Ratifying and Confirming this as my last Will and Testament In Witness whereof I have hereunto set my hand and Seal this Day and Year first above written.

But the will, in itself, does not answer your question. One researcher concluded that James was the son of Thomas; brother, William (since brothers William and Thomas jointly purchased the tract Stains).
A Somerset Sampler; however, reaches the conclusion that William was, indeed, the son of Thomas -- based upon correlating information from other records. Quoted in part:
William Hearne (Hearn, Hern) (before 1727-1754), tanner and carpenter, son of Thomas and Sarah (Newbold) Hearne, was listed in his fathers household in 1743 tax list for Wicomico Hundred, Somerset Co., and was mentioned in his fathers will (1762):Also I give and bequeath to James Hearne the son of William Hearne one hundred and ffifty Acres of Land taken out of a Tract of Land Called Stains; William Hearne was named with;Brothers and Sisters to the Deceased; in an account, estate of his brother, John Hearne (d. 1765) (even though William pre-deceased him). Inventory of estate of William Hearne Jun.r; was taken on 17 Apr 1754 by Robert Twilley and William Vennables and witnessed by brothers George and Thomas Hearne, jr., and George Parker;

Thomas, son of William and Mary Hearne, was born May 3, 1691, and died about March 1, 1762. He lived in Somerset county, Maryland. He married Sally Wingate. Children: George, born about 1715; Ebenezer, born May 6, 1717, died in April, 1785, married Priscilla Fooks; Thomas (2), of whom further; Elizabeth, married Isaac Moore; John; Nehemiah, died in March, 1760, married Bettie ---; Jemima; Mary, married Joshua Morgan; Esther, married Benjamin Vincent; Sarah; Anne; William.
