Biography

This Patrick Hepburn was firstly designated "in Stevenson", Haddingtonshire, where he then resided. He had a Great Seal charter from King James VI of the lands of Newmylnes, at Haddington. He was party to a post-nuptial contract dated 28th June 1586 with Thomas Fawside of that Ilk. He left four sons and six daughters.[1]

In Acts of Caution 1601-1605 (folio 172b, 9th May 1603) there appears the following: "James Sinclair of Murchill [Merkill], James Hepburne of Manishill [Mainshill, Morham], and George Hepburne, brother of Mr. Patrick Hepburn of Gilmerton, for James Learmonth, burgess of Haddington, 500 merks in manner and to the effect specified in the Act for William and George Hepburne, dated 30th April last." This original Act of Caution appears earlier in the same volume where it is stated that the above William and George Hepburn were brothers of Patrick Hepburn of Gilmerton. There is also mention of a James Hepburn, brother of Patrick Hepburn of Newmylns .On 20th May 1603 Patrick Hepburn of Newmills appeared before the Privy Council for William and George, his sons, either of them, in £100 to answer upon the 15th July next to the complaint made against them by Thomas Hamilton of Drumcairne and the late George Carkettle, for their alleged coming to the said George's house of Monkrig and violently ravishing [raping] and taking away his daughter.[2]

In the archives is a Summons raised at the instance of David Forrest of Gymmersmylne against Patrick Hepburn of Newmylnes, George and William, his sons, and William Ker in Bairfute [Bearfoord] ordering them to appear before the court on 1 November to give reason why they refuse to pay compensation for damage done to the lands of Dobeis Hauch pertaining heritably to the said David Forrest: half of the money to go to the latter and half to the Crown, dated 4th June,1608. In dorso: three charges on the summons dated 6, 7 8 June 1608.[3]

In settlement of his marriage contract George Hepburn received from his father, [this] Patrick Hepburn, with the consent of his wife, a long list of properties, including his patrimony, the New Mills. Also included was the Abbey Mill "occupied by Katherine Millar [Miller] and Laurence Paterson, her spouse, with another, John Hodge". Life rents are reserved for this Patrick and his spouse Jonet Scheill. Witnesses are John Ayton, William Arnot, junior, burgesses of Haddington; William Hepburn brother of the said Patrick, and George Schortus, who lived in and was a burgess of Haddington. Dated at Newmylnes 20th February 1612. Adjoining owners of properties are listed. They include John Johnstone, miller, and Patrick Hepburne of Beinstone.[4]
