LIoyd had been given notice to quit by Grace Bros but refused to go Defendant challenged plaintiffs' right claiming- that he was a yearly tenant, and could not be ejected till August 1911.
Defendant, in evidence, said that on the expiry of the second lease on August 1 1908, Mrs Coulter said in a conversation "I shan't want the premises You can stay as long as you like. Mrs Coulter gave him no notice that she was going to sell to Grace Bros
Mr. Mack, instructed by Mr. Bourne, appeared for the plantiff, John George Davis Kent, of Victoria street, North .Sydney and Mr James, instructed by Mr White, for the defendant, Martha Ann Coulter, of 21 Lower Fort-street, Sydney. This was an action for the recovery of 200 compensation for damages, for alleged illegal distrait. Plaintiff, who was a tenant to defendant, claimed that while the defendant's bailiff was in possession of his goods he tendered the defendant 16 17 a sum. sufficient to satisfy and discharge all arrears of rent and charges of the distraint. He requested defendant to re-deliver up the goods, which tender the defendant refused to accept, but subsequently sold the goods
Judge Backhouse delivered his reserved judgement yesterday in District Court action brought by John. George Davis Kent, cf Victoria-street,North Sydney, against Martha Ann Coulter, of Lower Port-street, Sydney, for '£20 damages, for wrongful distraint for rent. His Honor found in favor of the plaintiff for £50. Particulars of the case have already appeared in the 'Evening News.'
