The suit of Caroline Alice Holmes against Frederick Henry Holmes, was based on the ground of cruelty and desertion. The parties were married on 30th December 1883, and lived together in Auckland for five years. After a year spent at Gisborne, and another year in Wellington, the parties went to Sydney and to Melbourne, where the husband treated petitioner with cruelty because —according to the account given by petitioner —she refused to work at her trade for her husband’s support. Witness had been severely ill through the cruelty she had been subjected to. The children had been supported by Mrs Holmes since November, 1898, and she now sought an order for dissolution of her marriage and for custody of the children. The order was made for decree nisi, with costs ,(£l5) and disbursements,[3]
