Biography

Jacob Holtzclaw was born about 1743, in Fauquier county, Virginia.

Jacob married Milly Dodson before the 17th of June, 1767.[1] Together they raised nine children; Susannah Holtzclaw, Alexander Holtzclaw, Winnie Holtzclaw, Elizabeth Holtzclaw, Frances Holtzclaw, William Holtzclaw, Elias Holtzclaw, George Holtzclaw and Catherine Holtzclaw.

Jacob was named, along with his mother-in-law as Executor of the last will and testament of his father-in-law, Abraham Dodson. Jacob's wife Milly is also left bequest in the will of her father. The will of Abraham Dodson reads in part as follows: "In the name of God Amen I Abraham Dodson being sound in sense and memory do make this my last will and testament . . . I lend to my beloved daughter Milly Holtzclaw my negro man Joseph during her life and if she should die without a lawful heir begotten of her own body then return to her brothers and sisters and if she dies and leaves a lawful heir begotton of her own body after her death I give the said negroe Joseph to that heir. . . It is also my will that if any of the negro women breeds that my daughter Milly and my daughter Molly may have the two first young negroes that is born . . . the remainder part of my household goods I leave to be equally divided amongst them all Milly Hollzclaw and Tabitha Dodson and Enoch Dodson and Greenham Dodson and Molly Dodson. I appoint Jacob Holtzclaw and my beloved wife Barbary Dodson lawful Executors as witness my hand this 17th day of June 1767 . . . At a Court continued and held for Fauquier County the 25th day of October, 1768 This will was proved by the oaths of Absalom Cornelius and John Bennett wittnesses thereto ordered to be recorded and on the motion of Jacob Holtzclow and Barbary Dodson who made oath and executed and acknowledged bond as the law directs Certificate is granted them for obtaining a probate thereof in due form"[2]

Jacob appears in the Fauquier county, Virginia Personal Property Tax Books for the following years and is taxed on the items listed. The tax list includes the number of free males the number of negroes, horses, cattle, wagon's, etc.[3][4][5]

Jacob entered into a bill of sale for goods to John Waddell. The Bill of Sale reads as follows: "Know all men by these presents that I Jacob Holtzclaw of the county of Fauquier Common Wealth of Virginia have bargained & sold & by these presents do bargain sell & deliver unto John Waddell of the county aforesaid the following goods & chattels (Viz) one chesnut sorrell horse with a balled face branded with two Os four white feet supposed to be ten years old, one feather bed & furniture, seven hogs with a crop & slit in the right ear & also crop in the left, two pots, one oven, one kettle, six plates, one dish, one bason, one woolen wheel, one linen wheel, two chests, one table, one tubb, one pail, one piggon, one trunk, one plow, two hoes, one axe, and all my crop of corn tobacco wheat & oats now in the house & in the field for the consideration of Eleven hundred pounds of next crop tobacco cash to me in hand paid before the sealing and delivery of these presents that receipt whereof I do hereby acknowledge & I do by these presents warrant & will for ever defend the said goods & chattels from the claim or claims of any other person or persons whatsoever. In witness whereof I have hereunto set my hand & seal this 18th day of May 1784 [signed] Jacob Holsclaw Sealed & delivered in presence of W. Waddell, J. Waddell At a court continued & held for Fauquier county the 25th day of May 1784 This Bill of Sale was acknowledged by the said Jacob Holtzclaw to be his act and deed and ordered to be recorded."[6]

Jacob and Theodosia's daughter, Anna married on the 5th of December, 1808 Isaac Saffell in Fauquier county, Virginia. The marriage record reads in part: ". . . This is to certify that we have each of us Jacob Holsclaw and Theodosia Holsclaw his wife, in the presence of William Holsclaw given unto Isaac Saffell our free grant and liberty without any kind of reluctance, for him the said Saffell to join in wedlock with our daughter Anna Holsclaw in witness whereof we have hereunto set our hands this 3d day of Decr. 1808 [signed] Jacob Holsclaw Theodosia Holsclaw - Fauquier Co. Teste William Holtzclaw Elious Holtzclaw."[7]

Research Notes

  • Males were not taxed under Virginia law in the 1780's until they reached the of 16 years. There is no personal property tax list for Virginia in 1808 as the Virginia General Assembly did not pass a tax law for that year.
  • William Holtzclaw first appears in the 1799 personal property tax records of Fauquier county, Virginia in the tax list of his father, Jacob Holtzclaw. If William Holtzclaw was 16 years of age in 1799 this would give him a birth year of about 1783. William appears in the tax list in Jacob's tax list from 1799 to 1802. In 1804 William appears in the tax list as being on his own and is listed in the line below his father. William would have been about 21 years of age by 1804.
  • Elias Holtzclaw first appears in the 1804 personal property tax records of Fauquier county, Virginia in the tax list of his father, Jacob Holtzclaw. If Elias was16 years of age in 1804 this would give him a birth year of about 1788. The tax list for 1805 is incomplete and Jacob Holtzclaw does not appear in the list that exist. Elias does appear in the tax list in Jacob's tax list in 1806.
  • Jacob Holtzclaw found on a list of taxpayers for Hamilton Parish, Elk Run & vicinity, 1751. From the account book of Capt. John Crump, Sheriff of Prince William County. After 1759, this area became Fauquier County.[8]
  • 1809 was the last year Jacob appeared on the tax rolls of Fauquier Co. It's not known when Millian died, but Jacob had a wife Theodosia in a record in 1808. Before 1808 Jacob married (2) Theodosia ??? The first four children were definitely Millian's, Anna known to be a child of Theodosia.
