Biography

Notes on URIAH HONEYCUTT: Nickname – Rice. Uriah lived in Ramseytown Township of Yancey County until sometime in the 1850s when they moved to Fork Mountain township in Mitchell County. In 1812 Database: NC 1812-1814 Muster Rolls, Uriah was listed in Buncombe County in the Third Regiment. In 1836, in court records, Yancey Co., spring, 1836, ordered that Uriah Honeycutt oversee the road from the forks of the road below Joseph Tuckers to the mouth of Brummits Crick and that all hands living in the bounds of Julius Robesons work on said road. In 1850, Uriah and “Cussair” both 42 were living back in Yancey Co., NC. Their children, Docia (17), Deborah (16), Anna (14), Davie (12), Samson (10), Telithea (6), Locky (5) and William (1) were with them. Moses Honeycutt, (84) Uriah’s father is living with them, as well as Anna Tipton (74), Deborah’s mother. In 1860, the couple were living in Fork Mountain, Yancey Co., NC, with children Locey (14, William (11) and Biddy (6). Uriah and Cozey cannot read. Uriah is listed as a Union soldier in Company C, 7th Tennessee Infantry. In 1870, they now live in Red Hill, Mitchell Co., NC, with Wilson Honeycutt (11). Uriah’s property is valued at $800 and his personal estate at $400. On Sept. 9, 1873, Uriah Honeycutt married Ibbe Tipton. D. W. Adkins was the minister. NC Wills and Probate Records, Mitchell Co., Estate Records 1826-1946. State of North Carolina, Mitchell County, in the probate court. Isabella Honeycuttagainst Ceilda Hughs et al Deffs. Petition for Dower. The defendants Celia Hughes, Docia Jarret, Debra Whitson, Anna Street, Labratha Street, Lockey Street, Cordelia Whitson, Wm Honeycutt, and the heirs of David Honeycutt Wilson Martha and William minors. Answering the petition and complaint says: They admit that they are the heirs at law and legal representatives of Uriah Honeycutt deceased. They admit that Uriah Honeycutt died intestate in the county of Mitchell during the month of August 1876 and that he was sized? In for the lands inscribed in the petition. They admit that the petitioner Isabella Honeycutt is the widow of their father Uriah Honeycutt, deceased and deny that she has any right to have dower assigned out of said insurances and allege and even though the petitioner Isabella Honeycut by her deed of the 19th of August 1876 conveyed her right of dower and all other interests in said lands to the defendants which said deed is herewith filed as joint? Of this answer and marked exhibit “A.” And that said deed does duly acknowledged by the said petitioner and recorded in the office of the Judge of Probate of Mitchell County on the 22 day of August 1876. And was duly registered in Book “B” page 276 & 277 in the 23rd day of August 1877. The defendants ask that the petition be dismissed at the cost of plaintiff and that they discover judgment for the costs of this suit. This 19th of Nov. 1877. J. W. Bowman Atty for Deffs. Oct. 11, 1877, Answer. To the Judge of the Probate Court. The petition of Isabella Honeycutt widow of Uriah Honeycutt respectfully showeth that her said husband died intestate in the county of Mitchell during the month of August 1876, leaving him surviving the following children, his only heirs at law. Ceilia Hughs wife of Godfrey Hughs, Docia Jarrett widow of Elisha Jarrett, Bebba Whitson wife of Isaac Whitson, Anna Street wife of Joseph Street Tabitha Street wife of John D. Street, Locky Street wife of Harrison Street, Cordelia Whitson wife of Wm Whitson and Wm Honeycutt and the heirs of David Honeycutt, decd, viz., Wilson, Martha and William and also David Honeycutt heir of Sampson Honeycutt. Your Petitioner further showeth that her said husband at the time of his death was seized in fee simple of a tract of land situated in said in said County, adjoining the lands of James Bailey Sr., Julius Whitson and others and containing by estimation fifty acres. Your Petitioner further showeth that she desires to have her dower in the said land allotted to her and to that end she prays your Honor to order a writ to be issued to the sheriff of Mitchell County commanding him to summon a jury of freeholders as the law prescribes unconnected with the parties by consanguinity or affinity and entirely disinterested, to view the aforesaid tract of land and to allot and set apart to her one third part thereof, including the dwelling house and all out houses, buildings and improvements appertaining to the same for the term of her natural life and report their proceedings in due form of the law. May it please your Honor to order subpoenas, with copies of this petition to be issued to the said Celia Hughs, Docia Jarrett, Debbe Whitson, Anna Street, Tabitha Street, Lockey Street, William Honeycutt, Cordelia Whitson, Wilson Honeycutt, Martha Honeycutt, William Honeycutt and David Honeycutt requiring them to appear at the office of the Clerk of the Superior Court within the time prescribed by law and show cause if any they can why the prayer of the Petitioner shall not be granted. And your Petitioner as in duty bound shall ever pray, A. M. Erwin, Atty for Petitioner. A summons to the parties was signed Oct. 25, 1877. Papers were served Nov. 2, 1877. L. R. Hensley charged $6.60 for it. Everyone was to appear in court on November 24, 1877. L. R. Hensley charged $1.80 for those papers to be delivered. (This part, while chronologically out of place, seems to be what the family took to court to win their case. It seems Isabel placed her mark on this document shortly after her husband, Uriah, died. She got some personal property and one year’s worth of provisions, but then needed to move on.) This Indenture made on this the 19th day of August AD 1876 between Isabella Honeycutt widow of Uriah of the first part and Joseph Street Annie Street, John D. Street and Delitha Street, Cecilia Lewis, Isaac Whitson, Debra Whitson, Harmon Street and Lockey Street, Wm Whitson and wife Cordelia, Dosha Jarret and Wm Honeycut hiers of law and legal representatives of Uriah Honeycutt deceased. The said Joseph Street acting for himself and as agent of the heirs of the said Uriah Honeycutt, deceased, witnesses that whereas the said Uriah Honeycutt at the time of his decease who died intestate on or about 15th day of August 1876 was seized in fee of certain land in Mitchell County and was the owner of various articles of personal property and the said party of the first part a widow aforesaid became entitled by law to dower in said lands and also to a years support out of the personal property. And whereas the said party of the first part and the said party of the second part, the acting as agent afforsaid did agree mutually with themselves aided by Dr. Stephen Adkins to lay off and set apart to the said party of the first out of the stack crop and provisions a years support as afforsaid by the allotment to the said party of the first part corn, wheat, oats, 1 cow, 7 sheep, poultry and which the said party of the first part agrees by these presents to receive in full satisfaction for her claim for a years support and in lieu of dower in said lands. The said party of the first part did receive one horse and saddle, household and kitchen furniture and other property of value which was received by the said party of the first part in lieu of and in full satisfaction of claims for dower in said lands. Now in consideration of the process once the further sum of one dollar to her in hand paid by the said Joseph Street agent of afforsaid before sealing these documents the recipt whereof and all the current property is hereby fully acknowledged doth bargain sell convey alien and confirm unto the said Joseph Street as agent and hiers as aforesaid all her right title claim intent or estate to which she is entitled of in and to any and all land, owned by her said husband relinquishing to the party of the second part her right to dower in the same. Also release and relinquish unto the said parties of the second part all claim to a years support to hence the said parties their heirs and assigns forever. In witness whereof the said party of the first part hath hereunto set her hand and seal. Date above. Isabel (her mark) Honeycut. H. M. Hampton, State of North Carolina, Mitchell County. On this 22nd day of August 1876, personally appeared before me J. H.Greens Judge of Probate of said county.
