To the Honorable the Judge of the Barren Circuit Court in Chancery sitting - your Orator william Huckaby states that a certain William Smith, now deceased, in his lifetime obtained from the Barren County a certificate for vacant land being certificate No 12 agreeably to an Act of the laws of the land for settling and improving the vacant lands of the Commonwealth.
That said Smith caused a survey of 187 acres to be made on the certificate and had the same registered in the land office on the (the following was written in & then marked out "l5th Decr 1807").
That said Survey interfered with a military tract of land which military claim is superior & paramount to the claim on said certificate. That in order to avoid interfering with the military survey, application was made to the Barren County Court on 18-- for an order of resurvey which was granted, and which will more fully appear by reference to the record. That 130 acres, part of the 187 acres were included in the resurvey and that a grant from the Commonwealth bearing date 28 Decr 1819 issued in the name of Smith £or said 130 acres of land.
Your Orator charges that Smith in his lifetime on the 8th 0f Dec 1809 sold to Allen Drake said land & as evidence 0f said sale assigned the receipt 0f the Register of land office for the first installment on the said 187 acres to said Drake without recourse. That Drake on the 28th day 0f August 1820 assigned transferred and made over all his right title & interest to said 187 acres land purchased of Smith.
Your Orator charges that said Smith is now dead & that he has left heirs who are unknown to your Orator, and the heirs are non-residents and in whom now the legal title £or said land now is. Makes the heirs of said Smith Defts to this bill - asks for legal title.

ASSIGNMENT- I do hereby assign transfer and make over all my right title and interest in 187 acres land which I purchased of William Smith being in Barren Co., Ky on the waters of Peters Creek & which said Smith assigned to me on the back of the registers receipt dated I5th Decr 1807 unto William Huckaby his heirs etc. this 28th day of August 1820.
