Biography

March 1918 Lavina elopes to Newport Kentucky with an aged bachelor by the name of John T. Deavers

CHILDREN Fuss Over MOTHER - object to caring for mother and motherless niece - Threaten To Get a Guardian - Children of Mary Hamilton, 73, Are Ordered Back In Court Next Wednesday.

Children of Mrs. Mary Hamilton, 73, Urbana, whose arrest on non-support charges filed by their aged mother, refused to retire to a private room at the office of Magistrate S. M. Pence, Wednesday afternoon, to agree among themselves to support their mother, when they appeared there Wednesday afternoon.

They preferred to remain in a public room and fuss in the presence of their mother. Only two sons showed any disposition to aid their mother who through Magistrate Pence, asked only $3 per month from each of the six children.

After 20 minutes of argument, in which Albert Evilsizor, husband of one of the daughters, said he would get a divorce from his wife if he had to keep her whole family and even went so far as to say that before he would give anything toward the support of his wife's mother as long as she insisted on keeping a young orphan granddaughter with her, he would go to jail and let the ants carry him out the cracks. Magistrate Pence continued the case until next Wednesday. The case was continued because Clarence was not there.

Some of the children objected to their mother giving a home to her motherless granddaughter who is a student at the Urbana high school. They insisted that this girl be put out and be made to "get down to hard work like we had to." This suggestion was made by an aunt of the girl.

Declarations were also made that the case would be carried to a higher court and that an effort would be made to have a guardian appointed for their mother.

"I don't need a guardian and I don't want your money if you are going to fuss like this. I always made a living and I guess I can yet," was the only comment of the aged mother.

One of the children also wanted to know why their mother signed her name to the affidavits as Mary Hamilton. They insisted that her name is Mary Devers by reason that she was married to a man by that name and when she got a divorce did not secure her former name.

Some of the children also objected to returning to the Magistrate's court next week.

"The state of Ohio makes this a serious offense and I am going to settle this case In a way you won't appreciate at all if you don't get together and do something for your mother," said the Magistrate.

But when one of the children made a remark about this he notified them that if they did not abide by the order of the court they would not be farming very long.

The mother of the children earns enough to pay her rent by her own labor.

The children are Anna Evilsizor, Emma Evilsizor, Laura Hamilton, John Hamilton, Clarence Hamilton and George Hamilton. George Hamilton put up a fight for the girl at his mother's home and wanted the case settled at once. He offered to give $5 per month to his mother if the others would do the same.

Magistrate Pence also warned the children, that they would have to prove to a court that their mother needed a guardian before they could have one appointed for her.[1]
