Born 21 May 1656. Cobbs Hall, Northampton, Virginia, United States. [1]

Origin

Charles Lee, youngest son of Richard Lee and Anne Constable, was probably born about 1656, at "Dividing Creeks" (later known as "Cobbs Hall") in the Northern Neck, in Northumberland County.[2] Formerly, the family had lived at "Paradise" in Gloucester County, but removed to "Dividing Creeks," near what is today the town of Kilmarnock.[3] The date of this move is uncertain, but Richard Lee served as burgess for Northumberland County in 1651 and began patenting land there in the same year (p 65).[2]

On 6 February 1663/4, Charles' father executed his will in London. He was preparing for the return voyage to Virginia, and by 20 April 1664, he had died (p 64).[2]

Marriage and Children

He married c. 1676-1678 to Elizabeth Medstand, daughter of Thomas Medstand, of Lancaster County (p 558).[2][4] On the date of Charles' will in 1700, only his oldest child was of age.

Property and Positions

Charles Lee and his wife, Elizabeth, on 21 December 1684 sold 203 acres in Christ Church Parish acres to Robert Scholfield (p 558). This was land inherited by Elizabeth from her father, Thomas Medstand.[2]

Charles and his brother, Richard, owned the plantation known later as "Cobbs Hall." In 1707, brother Richard assigned his portion to his nephew, Charles' son by the same name (p 559). The Cobbs Hall plantation (600 acres) was the family homestead of Charles and his family.[2]

Charles was a Justice for Northumberland from 1687 until 1699.[2] Charles' name was included in a 1702 list of civil officers, showing he was still in public service until the time of his death.[2]

Death and Legacy

Charles died before 17 December 1701 (when his will was proved), at "Dividing Creeks" (later known as "Cobbs Hall") in the Northern Neck, in Northumberland County, Virginia.[2] He was buried at the Lee Family Graveyard, Dividing Creek, Northumberland County with his parents, wife, and other family members.[2]

Within this enclosure was buried ~ Richard Lee ~ of an ancient family of Nordley Regis in Shropshire, who emigrated from London to Virginia in 1639. He was successively clerk of the quarter court at Jamestown, Attorney General of Virginia, Secretary of State, and a member of the council. Having long traded with the nearby Wicomico Indians, in 1656 he established his home on Dividing Creek, at a point 400 feet to the Northeast of this stone. He died there in 1664 and was buried here in his garden. ~ Also buried within this enclosure were Anne Constable, the wife of Richard Lee; their son, Charles Lee (1656-1701), and his wife Elizabeth Medstand; their son, Charles Lee of Cobbs Hall (1684-1734); and his son, Charles Lee (1722-1747), and his wives, Mary Lee of Ditchley and Leeanna Jones of Hickory Neck. In 1761 this Leeanna Lee ordered the erection of the original enclosing wall. Later members of the Cobbs Hall family, Lees and Harveys, were buried nearby outside the wall. ~ Erected by The Society of the Lees of Virginia ~ 1958.[2]


Last Will & Testament

His will was dated the 13th of July, 1700, and probated at Northumberland on the 17th of December 1701. From this will it is learned that his wife survived him, and four children are named in the will -- Thomas, Charles, Leeanna, and Elizabeth.

Younger son, Charles received the 600 acre homestead, Cobbs Hall. Leanna received the 200 acres across Andrews' creek and on the south of the "Ditchy Creek" property.

This profile reported an exact birth date May 21, 1656, without evidence, citation: Find a Grave memorial - which cites Edmund J. Lee, but Lee does not report this exact birth date for Charles Lee. Charles Lee. [6]

Is it possible that Charles Lee first married Hannah Miller daughter of Patrick Miller, Sr. (1620 Scotland - prior 5/3/1675) given she is noted as Hannah Lee in 1675/January, 1676 Middlesex County, Virginia documents (see below).

Charles Lee could have been Hannah Miller's husband. Charles Lee did name a daughter Hannah Lee based on his will noted on FindAGrave (spelled "Leanna" Lee on Charles' WikiTree profile). WikiTree lists Hannah/Leanna Lee's mother as Elizabeth Medstand. In Charles Lee's 1701 will, he notes his wife's name as Elizabeth (noted as Elizabeth Medstand on WikiTree with marriage in 1676 in Northampton Co., VA). Hannah (Miller) Lee could have died shortly after her 1675/1676 court case. The latest document I have found mentioning Hannah Lee was in January, 1676 (the year Charles Lee is thought to have married Elizabeth Medstand). Charles Lee appears on a number of Middlesex Co., VA documents [county Hannah (Miller) Lee filed her 1775/1776 court case]. Charles Lee's brother, Richard Lee married the sister of Gawin Corbin. Hannah (Miller) Lee's brother John Miller (c. 1665 - 1742 Middlesex Co., VA) owned the ship, The Token with Gawin Cordin.

Whittaker and his return on this order shall discharge Rowland Mackrory.

Upon ye Peticon of Hanah Lee, It is Ordered that she give up a Mare and the increase Bequeathed by Patrick Miller to Sarah Miller doth more property belong to the said Hanah Lee. Mr. John Needles, Mr. Thomas Robe and Mr. Jno Nicholls are appoynted to make an equall devision of the said Mare & increase betweene ye said Hanah and Patrick Miller [Jr.], her Brother. they are to returne to ye next Court.

Elizabeth Keene did not marry Charles Lee, she married first husband Thomas Lee 01 Nov 1716, son of Charles Lee and Elizabeth Medstand, and he died in 1735. She married second husband James Scrosby 15 April 1737.
