From the National Archives: In July 1756 Andrew Lockhart was sentenced to 400 lashes, William Pritchard to 1,000 lashes and to be “drummed out of the Regiment with a halter ’round his neck,” and Robert Yates to 1,000 lashes (After Orders, 6 July 1756). Lockhart, a 19-year-old carpenter from Hampshire County, had been reported a deserter from Robert Spotswood’s company in January. He was back in Spotswood’s company in July. After Orders: Colonel Washington has been pleased to approve of the Sentence of the said court martial—which was of opinion that Andrew Lockhart should receive four hundred lashes: William Pritchard one thousand lashes, and be drummed out of the Regiment with a halter ’round his neck.

In 1767, Andrew Lockhart was appointed to "work the road" from James Given's Mill to Stone Meeting House, Augusta County, Virginia. [“Chronicles of the Scotch-Irish Settlement in Virginia," Court Records of Augusta County, Lyman Chalkley]

From a Kentucky Court Case record: On the same page is the following "We do hearby sign over all of our rights, titles, interest, claims or demands, of the within bond, or any claims I may have in the will made by Jacob Lockhart, Dec, as Heir at Large, by marriage to his daughter Nancy, to Jacob Smiger and William Coleman (Attnys)....given under our hand, this 13th day of August 1805. Signed by Andy (Andrew) Lockhart and Nancy Lockhart and witnessed by John Lockhart and Sanuel Hamler.

Tazewell County, Virginia Will Book 1, p. 98-99 (FHL Film 7645848, Image 150); November 27, 1815; In the name of God Amen: I Andrew Lockhart of Tazewell County and State of Virginia, being very weak in body but of sound mind and memory thanks be given to God and calling to mind of uncertainty of life and this certainty of my approaching disolution do hereby make and ordain this my last will and testament in manner and form as following: 1) I desire and recommend my soul to God that gave it, and as for my body my wish is for it to be entered in the earth in a decent Christian like burial. And as touching such worldly goods as it hath pleased God to put into my hands in this life I wish to dispose of in the following manner. And first I wish all my lawful debts to be taken of my estate and payed to my creditors. 2) I give and bequeath to my beloved wife Mary Lockhart, do constitute and ordain her the sole heir of my estate, house, lands, tenements, stock of every kind that I -----with all appartainence whatever thereunto belonging to be at her disposal in whatever manner she shall think proper to dispose of any of the estate while she continues to be my widow. 3) I wish at her death what is left of the estate to be equally divided amongst all my children, Sarah McGuire, William Lockhart, James Lockhart, Polly McGuire, Jane Belshe and Daniel Lockhart. And I do hereby utterly disallow, revoke and annul all former wills made by me at any time and declare this and no other be my last will and testament, In Witness whereof I have herein set my hand and seal, this twenty seventh day of November in the year of our Lord one thousand eight hundred and fifteen, 1815 Andrew X Lockhart

At Tazewell Jan. Court 1816 the within will was proven by John Goodwin and cont. for futher proof, and at another Court held in said County on the 27th day of August 1816 this the last will and teatament of Andrew Lockhart Dec'd was again exhibited in Court by oath of Thomas Malloy and Nellie Belshe witnesses to and ordered to be recorded.

I have that Andrew had the same 6 children , and possibly another, Andrew II. Sarah Mar Josiah McGuire. James mar Polly Bowling 20 Aug 1805 or 1815 Tazewell Co, Va. Mary Ann born c1775, married Joseph McGuire 12 Aug 1794 Wythe Co, Va. Jane (my line) in Tazewell Co Census 1820, age 26-44, so she would have been born 1776-94. She married John Belcher c1797, died 1820-22. Daniel married 1st Polly Ward 8 Jul 1805 Tazewell Co; 2nd Charity Brashier c1835.

After being listed as a deserter, 400 lashes sounds a bit severe for someone who returned to duty. Doubtful he had much of a military career after that beating!
