Will, father Jacob Lockhart

Jacob's will lists his three sons, Charles, John, James, two daughters, Agnep(?) and Elizabeth and wife, Maery[1]

To the sons, all the property in Kentucky to be divided equally. Daughters to receive 50 pounds Virginia currency. Meary is left one bay ? dismal ?...[NOTE: Meary is shown later in the file to have paid for property to the estate that she "purchased".[2]] The remainder of the estate to be divided between the sons. Property in Greenbriar to be sold to pay any debts. Col Andrew Donaley, Corp. George Clendennon, and William Ware were to be executors.

Charles was a minor child and an executor was chosen, Robert Rennick.[3]

July 15 1809 a case was filed on behalf of Charle, John AND James Lockhart, plaintiffs against the executors of Jacob Lockhart's Will, in the court of Chancery Staunton, Virginia. Defendents: Andrew Donnelly, ex [executor]of Jacob Lockhart deed the exr. of George Clendennon William Clendennon, the representatives of Robert Clendennon and James Houfton [Houtton ?].[4] Aug 19 1819 was the last date that I found. So theoretically this lawsuit last over ten years, and came to a close over thirty three years after Jacob's death. Hmmm.[5]

I Jacob Lockhart of Greenbrier Countey and Steate of Virginia being of perfect mind and memorey at this time But Coaling to mind the mortallitey of my Boddey Knowing that it is apointed for all men to die I meake and ordeain this to be my Last will and Testement and I dow Renounce and Decleair all former Wills to be void first of all I Recommend my Soule To god and touching Such wourley goods as it heath Pleased god to blis me with I bequith in the following manner and form I bequth to my beloved wife meorey [sic, Mary] one bay meare of the Dismil Stream besides hir full thirds which she is intiteld to by Law Likewise I bequith to my three sons Charls James and John all my Land in Ceaintuckey to be equeley Divided betwixt them according to Quantitey and Qualletey Likewise I bequith to my two Daughters Agness and Elizebeth fiftey pounds Each Current money of Virginia and the Remeainder of my Esteate after my Just Debts are payed to be Equley Divided betwixt my three Sons and for the Discharing of my Debts I alow all my Land in green brier Countey to be Sold as well all my Entreye that is not Survayed as them That is Surveyed and I Dow herby apoint my beloved Frends Coln Andrew Donneley Capt George Clindinian and William Ward to be my Execeters I dow Declair This to be my Last will in witness Whereof I heave herunt Set my hand and Seale this 31st of March 1784

This Instrument of writing as & for the last Will and Testament of Jacob Lockhart Decd was presented in Court & prven by the Oath of Alexr Welch a Witness thereto & ordered to Record on the Motion of Andw Donnally & Geo Clendinen, Excrs namd therein, who made oath according to Law, Certificate granted them to obtain a probate thereof, whereupon they entered into and acknowledged with their bond with Conditions as the Law directs, Copy, Teste John Stuart

At a Court contd & held for Greenbrier County the 24th day of March 1786, Jno Moore one of the Witnesses to this Will, made oath that he saw Jacob Lockhart sign and acknowledge the same & was present when John Harra, a Witness, testified the same, Copyt, Teste John Stuart

Second marriage of William Kenton[6]

July 1797 William Kenton is appointed guardian of John, James and Charles Lockhart, sons of Jacob. Referenced: Court order book C, page 64, July court 1797 "Upon motion of William Kenton, guardian of the orphans of Jacob Lockhart, deceased, John Gutridge, Patrick Hunter, Robert B Mortan, are appointed Commissioners, or any two of them, to take depositions to perpetuate Testimony to establish an entry of 500 acres made in a military warrant in the name of Jacob Lockhart."

Mason County Court Records Deed book E, page 480, Jan 19 1799: "Indenture between William Kenton of Mason County and John Nichols of same place - tract of land, dower in lands of Mary Kenton, wife of said William Kenton, late Mary Lockhart, formerly wife of Jacob Lockhart, decd. land in Mason county on west side of Scott's Spring and the plantation where said Kenton now lives."

This land was disposed of by Charles, James and John, sons of Jacob Lockhart in 1806 sold to William Coleman.[7]
