Biography

David Lusk was born in the early to mid 1770's (see research note re: Birth Year) in Virginia (see research note re: Birth Location). His parents are believed to be Samuel Lusk Sr. and Susannah Stevenson.

It is likely that David was living in Virginia when the 1790 U.S. Federal Census was conducted. Unfortunately the Virginia records for this census have been lost[1].

In 1792, it appears that his brother, Samuel Lusk Jr., was captured by Shawnee after pursuing them for stealing horses (see research note re: Survived a Shawnee Raid).

From 1793 to 1797, David Lusk appeared on the Personal Property Tax List for Wythe County, Virginia. He did not appear on this list in 1798 (see research note re: Personal Property Tax Lists)[2].

On 1 November 1798, David Lusk was granted 100 acres of land situated on Clear Fork of Wolf Creek within Wythe County[3].

David Lusk again appeared on the Wythe County Personal Property Tax List in the years 1799 and 1800[2].

Tazewell County, Virginia became effective in 1800. It was established the previous year, using land that was mostly part of Wythe County, but a smaller amount from Russell County[4]. The 1800 U.S. Federal Census records for most of Virginia (including Wythe and Tazewell counties) have been lost[1]. Tax records, however, indicate that the personal proprety owned by David Lusk, previously part of Wythe County, began appearing on the Personal Property Tax List for Tazewell County in 1801[5].

Although a marriage record has not yet been located, David Lusk and Chloe Bailey began a relationship sometime in the late 1790's. Chloe was born in the early to mid 1770's in Virginia to Richard Bailey Sr. and Elizabeth Anne Belcher. The first evidence of their relationship is a court case against them that is dismissed in 1801. On 15 October 1801, in Tazewell County, Virginia, the attorneys for the Commonwealth of Virginia moved to dismiss a case against David Lusk and Chloe McComas[6]. No details are given regarding the nature of the case (see research note re: Commonwealth of Virginia vs. David Lusk and Chloe McComas).

On 16 August 1804, In Tazewell County, Virginia, an indenture of bargain and sale from "David Lusk & Chloe his wife, to John Lawson" was acknowledged in court and ordered to be recorded[7].

On December 24 1805, in Tazewell County, Virginia, an indenture of bargain and sale from "William Davidson and Polly his wife, to David Lusk" was acknowledged in court and ordered to be recorded[8].

On 28 June 1809, in Tazewell County, Virginia, an indenture of bargain and sale from "David Lusk and Cloe his wife, to Hugh Tiffany" was acknowledged in court and ordered to be recorded[9].

The 1810 U.S. Federal Census records for Tazewell County, Virginia have been lost[1]. The Personal Property Tax List for Tazewell County, however, provides evidence that David Lusk was living in that county in 1810. David appeared on this tax list every year from 1809 through 1820[5].

On 14 August 1811, David Lusk was granted 100 acres of land situated on the Bluestone River within Tazewell County[10].

According to Annals of Southwest Virginia, 1769-1800 by Summers, there was a David Lusk from Tazewell County, Virginia, who served during the War of 1812[11]. The Index to Compiled Service Records of Volunteer Soldiers Who Served During the War of 1812, hosted by FamilySearch, indicates that a David Lusk served in the 4th Regiment of the Virginia Militia sometime in the years 1813-1814[12]. Given that the Tazewell County Personal Property Tax List never included more than one person named David Lusk in any given year, it seems likely that the David Lusk who served in the War of 1812 is the same David Lusk described by this profile[5]. A pension claim for David, or his wife, Chloe, does not exist because David was neither disabled nor killed in the war. It was not until 1871, well after the death of both David and his wife, that the requirements for a pension were relaxed to accept only service tenure[13].

In the 1820 U.S. Federal Census, David Lusk was enumerated in Tazewell County, Virginia. His household consisted of six individuals[14].

On 22 August 1821, David Lusk was granted 146 acres of land situated on Brush Creek within Tazewell County[15].

From 1821 through 1827, David Lusk appeared on the Tazewell County Personal Property Tax List. He was absent from this list in 1828, but reappeared in 1829[5].

It appears that David and his wife Chloe separated from each other at some point in 1828 or 1829. David cannot be located in the 1830 U.S. Federal Census (see research note re: 1830 U.S. Federal Census), even though his name appears on the Tazewell County Personal Property Tax List for that year[5]. Chloe was enumerated in the 1830 census as the head of her own household, and David was not part of that household[16]. Chloe was also listed on the Tazewell County Personal Property Tax List in 1830, separate from David[17].

David would appear on the Tazewell County Personal Property Tax List for three more years, 1831 through 1833[18].

On 18 February 1833, David appeared in Tazewell County Court with regard to a pension. It is not clear what type of pension David was presenting to the court[19].

David Lusk presents in Court a declaration for a pension which was sworn to, examined & ordered to be certified according to Law.

1833 was the last year for which a record for David Lusk can be located. His name no longer appeared on the Tazewell County Personal Property Tax List after 1833[18]. Meanwhile, Chloe would continue to appear on the Tazewell County Personal Property Tax List, from 1831 through 1837[20]. In 1837, Mercer County was created from land previously located in Giles and Tazewell Counties[21]. Chloe would appear on the Mercer County Personal Property Tax List only one time, in 1839[22].

Based on the pattern of records for David, it appears that he passed away some time in 1833 or 1834, presumably in Tazewell County, Virginia. Note that some researchers indicate that he passed away in 1830, likely because he cannot be located in the 1830 U.S. Federal Census. His presence on the Tazewell County Personal Property Tax List from 1830 - 1833, and his pension related appearance in Tazewell County Court in 1833, suggest that he was not deceased until 1833 at the earliest. Neither an official record of his death nor evidence of a burial have been located.

  1. Before the establishment of Tazewell County in 1800, David Lusk resided in Wythe County. FamilySearch contains unindexed images from the Wythe County Court Order Books for the year 1790 and years 1795-1800. Was there any mention of David Lusk in the court minutes for these years? The images for these years are contained in a single film beginning with FamilySearch Image: 3Q9M-CS4V-XWC4.
  2. As noted in the biography, the last mention of David Lusk, thus far, was in Tazewell Court minutes in 1833 regarding a pension. A more thorough review of the FamilySearch unindexed images for Tazewell County Court Order Book for the years 1825 to 1841 would be beneficial. Was David Lusk mentioned any other times in that timeframe. The images for these years are contained in a single film beginning with FamilySearch Image: 3Q9M-CSKK-69F2-P.
  3. There is a Land Grant for a woman named Hannah Bullock, dated 17 September 1810, for 83 acres located in Rockbridge County, Virginia. The description for this land was "83 acres on Buffaloe Creek adjoining David Lusks land"[23]. No research has been done to determine whether the David Lusk mentioned in that description was a different person than the David Lusk described by this profile. Could they be the same person?

Birth Year

A primary source for David's birth date has not yet been located. Two sources, however, provide an idea for when David was born:
  • The first time that David appears on a personal property tax list was in Wythe County, Virginia in 1793[2]. In that entry, there was one male over the age of 16 years - presumably this was referring to David. This indicates that David was born on or before 1776. Note that personal property tax records prior to 1793 are not available for Wythe County, so David's record in 1793 may not be the first time he is paying property tax.
  • The 1820[14] U.S. Federal Census - This census noted that David's age was older than 44 years. This indicates that David was born on or before 1776.
Unfortunately, no additional records have yet been found that could be used to narrow when David was born. The two records above only provide an estimate of a later boundary for his birth year. There is no estimate of an early boundary. For example, based on these two records, he could have been born in the 1760's.

Birth Location

A primary source for David's birth location has not yet been located. Based on where he lived most of his life, it seems reasonable to believe that David was born in Virginia. A source, however, that provides any location for his birth, has not yet been located.
On 27 December 2023, this profile indicated his birth place to be "Augusta (now Tazewell) County. Virginia". This can only be true for certain birth years.
The sequence of Virginia county creations that led to Tazewell County went as follows:
  • 1770 - Botetourt County was established from the southwestern portion of Augusta County.
  • 1772 - Fincastle County was established from the southwestern portion of Botetourt County.
  • 1777 - Montgomery County was established from the northeastern portion of Fincastle County.
  • 1790 - Wythe County was established from the southwestern portion of Montgomery County.
  • 1800 - Tazewell County was established from the northwestern portion of Wythe County and a smaller northeastern portion of Russell County.
Assuming that David was born in what is today Tazewell County, you can derive a birth county based on when you think David was born:
  • Born before 1770 - Augusta County.
  • Born 1770-1771 - Botetourt County.
  • Born 1772-1776 - Fincastle County.
  • Born 1777-1789 - Montgomery County.
  • Born 1790-1799 - Wythe County.
  • Born 1800 or later - Tazewell County.

Survived a Shawnee Raid

On 28 December 2023, this profile's biography contained the following text:
David Lusk and his Brother Samuel jr. were the only surviving sons of a Shawnee Indian raid, which killed their father Samuel Sr. and three brothers. They along with their mother and one sister survived the attack. The Attack occurred in 1792.
Unfortunately, this text had no sources associated with it. An attempt was made to find supporting sources, but what was found only supported certain elements of the above text. There is a story of a Shawnee raid, focused on stealing horses, that occurred in 1792. In this story, however, no Lusks are killed. Only one Lusk was mentioned - Samuel Lusk - who was captured during the pursuit of the raiding Shawnee. A separate story, about Mrs. Elizabeth Wiley escaping the Shawnee with the help of Samuel Lusk[24], makes it clear that Samuel Lusk was a young man, under twenty years of age, and therefore not David's father, but possibly his brother - Samuel Lusk, Jr.
The story of Samuel Lusk's capture was originally published in 1852 in Bickley's History of Tazewell County, but subsequently republished several times, including the following:
  • Annals of Tazewell County by Harman[25].
  • Annals of Southwest Virginia, 1769-1800 by Summers[26].
  • History of Tazewell County and Southwest Virginia: 1748-1920 by Pendleton[27].
  • From Cabins To Coal Mines, 1799-1999, Volume I by Blankenship (an excerpt of which was published online by the Wyoming County Report)[28].

Commonwealth of Virginia vs. David Lusk and Chloe McComas

FamilySearch hosts images of a transcription of the Tazewell County Court Order Books, with Book #1 covering years 1800 - 1810 (the title on the spine of the book reads "Court Record Transcribed Order Book 1800 - 1810 Tazewell County, VA" - these are not images of the original order books).
Reviewing the images for this order book (images 1 through 31, pages 1 - 50, covering only years 1800 - 1801), looking for items related to the case against David Lusk and Chloe McComas, found the following:
  • On 13 August 1801 (page 37) there is a reference to a case by the Commonwealth of Virginia against "Turk & McComas". Since the images hosted by FamilySearch are a transcription of the original, I suspect that this reference is a transcription error, and it should have been a reference to "Lusk & McComas". A grand jury was convened to review several cases, including the case against "Turk & McComas", but the grand jury returned with "nothing to present".
  • On 14 August 1801 (page 39) defendants David Lusk and "Clow (M) Cormus" each plead not guilty and the case was continued. No other details of the case are indicated (for example - what was the charge?).
  • On 15 October 1801 (page 45) the case against David Lusk and Chloe McComas was dismissed.
Other researchers have suggested there is more to this case described in the Court Order Book for year 1800 - 1810. Perhaps there is more detail in the original order book vs. what is visible in the transcription images hosted by FamilySearch.

1830 U.S. Federal Census

If you assume that David Lusk would be enumerated with an age consistent with the 1820 census (born before 1776), then his age in the 1830 census would be at least 54 years old, and he would be marked as being 50 - 59 years old. On 17 January 2024, searching for a "David Lusk" in the 1830 census returned six matches. None of the six were living in Virginia, and only two of these matches had a male whose age was 50 or older:
  • David Lusk's household in Reily, Butler, Ohio had one male age 60 - 69 years and one male age 50 - 59 years.
  • William D. Lusk's household in Tioga, New York had one male age 50 - 59 years.
Adjusting the search last name to "Lisk" returned three matches, none of which lived in Virginia, and only one had a male whose age was 50 or older:
  • David Lisk's household of Northfield, Richmond, New York contained one male age 70 - 79 years.
Adjusting the search last name to "Lurk" or "Lush" returned zero matches.

Hi Cary, I just wanted to ask you why are u listing Samuel Jr siblings as Half. I'm a direct Descedant of Sam Jr. Son Andrew. I've been researching for years and I believe Sam Jr. David, .Robert A, William F, James R and Mary are Full blood siblings. Unless u know something I don't. lol. Sam Sr and Susannah are their parents. In 1792 Sam Sr , James, Robert and Will were killed in an Indian raid. It is then Susannah remarried a Thomas Godfrey and they had one son Absalom Godfrey, he would be the half brother. The others are full on sibs. Accept my request as A Trusted partner an I'll help u correct your info.
Lusk-725 and Lusk-601 appear to represent the same person because: Same name, birth year, and profile manager. Looks like a duplicate profile.
