In the name of God. Amen. I Thomas Maddox Senr of the Territory of Arkansas & County of same, being far advanced in life and in a low state of health though perfectly in my senses, revoking all others heretofore made by me, do make this my last will & testament
In the name of God. Amen.
Item 1st After appointing my three sons, Thomas, John & Alpheus Maddox my lawful executors I commit my body to the dust and my soul to God that give it.
Item 2nd After my lawful debts are paid, which are but few, if any And having heretofore equally divided my property between all my children, John, Elizabeth, Thomas Jr, Alpheus, Sally, Nancy & Stephen Maddox, and having one son (Lue Mattox) who is and has been from infancy entirely incapable of acting or managing in any way for himself, I do therefore will and bequeath all the residue of my property, whether real or personal, to him, after my decease and the decease of my lawful wife, Jannet Maddox, or to such one of my sons as shall be hereafter appointed to take care of him and us.
Item 3rd Having for ten years past lived with my son Thomas Maddox Jr who has taken care of myself and lawful wife Jannet Maddox & Son Lue Maddox and it being from sundry reasons, most agreeable that we should continue with him, being too infirm to do for ourselves.
Item 4th I do therefore appoint him, Thomas Maddox as lawful agent or guardian to provide for and take care of (clear of wants) myself & lawful wife Jannet Maddox & Son Lue Maddox while we shall live, and for the performance of the same, I do will and bequeath to my son Thomas Maddox or [his] lawful heirs, one negro fellow by name Harry ____ during his natural life. Pinnell, Attaway B. Pinnell & Alpheus Maddox, Witnesses to the last will and testament of Thomas Maddox deceased and that you take probate of said last will and testament, as the law directs, and that you enclose the same with the commission under seal to this office without delay.
