Biography

IN THE COUNTY COURT OF THE STATE OF OREGON, FOR UMATILLA COUNTY IN THE MATTER OF THE ESTATE OF R.G. McCLELLAN, DECEASED. PETITION FOR ORDER DIRECTING DELIVERY OF WILL. TO THE HON. J. E. BEAN, COUNTY JUDGE OF UMATILLA COUNTY, OREGON: H. T. McClellan, your petitioner, represents and shows: —

- I - That R. G. McClellan died in Umatilla County in the State of Oregon, on or about the last day of August, 1899; that at said time he was the owner of an estate in Umatilla County, State of Oregon, consisting of both real and personal property of the probable value of $2000.00; that at the time of his death he was about eighty-four years of age; that he left the following heirs at law, to-wit: Cornelius D. McClellan, a son, residing in the State of Illinois, about 50 years of age; Henderson T. McClellan, a son, your petitioner, who resides in Umatilla County, State of Oregon, and about 42 years of age; Thomas B. McClellan, a son, who resides in the State of Kentucky , and is about thirty-five years of age; Rosina Wallace, a daughter, who resides near Oregon City, State of Oregon, and is about forty-nine years of age; Sarah J. Dozier, a daughter, residing near Roseburg, Oregon, about 48 years of age; Margaret Parrott, a daughter, who resides in Umatilla County, State of Oregon, and is about 40 years of age; Elizabeth McClellan, wife of the deceased, who was at said time about 79 years of age.

- II - That your petitioner is informed and believes that said deceased left a will in the possession of J. H. Koontz, of Echo, Umatilla County, State of Oregon, who now refuses to surrender the same or deliver it up for probate, which said will was in substance as follows: "IN THE NAME OG GOD, AMEN! I, Robison G. McClellan of Umatilla County and the State of Oregon being past fifty years of age and of sound and disposing mind and {mercy}, not acting under any undue influence coertion [sic], or duress of any kind form any person of persons whatsoever, do hereby freely and voluntarily and of my own will and accord, make this my last will and testament as follow:

1st I do order that all my just debts be paid including funeral expenses 2nd I do hereby give and bequeath to my son Cornelius D. McClellan the sum of Ten Dollars $10. 3rd I do hereby give and bequeath to my son Henderson T. McClellan the sum of Ten Dollars $10. 4th I do hereby give and bequeath to my son Thomas B. McClellan the sum of Ten Dollars $10. 5 I do hereby give and bequeath to the children of my son James D. McClellan (deceased)to wit John G., William and Eliza McClellan each the sum of Five Dollars or as many of them as may survive the testator. 6th I do hereby give and bequeath to my daughter Rosina Wallace (married daughter) the sum of Ten Dollars $10. 7th I do hereby give and bequeath to my daughter Sarah J. Dozier the sum of Ten Dollars $10. 8th I do hereby give and bequeath to my daughter Margaret A. Parrott the sum of Ten Dollars $10. 9th All the remaining portion of my estate after all debts and bequests have been paid as directed whether real or personal property I do give and bequeath to my beloved wife Elizabeth McClellan, for her natural life. None of my real estate shall be sold by her unless necessary to provide for the support herself and the payment of my just debts. At her death I do direct that all the remainder of my property real and personal shall be divided equally among the heirs.

Signed R.G. McClellan {Seal} On this seventh day of May 1898 the above named Dobison [sic] G. Mclellan in our presence signed the forgoing instrument and published and declared to us that the same was his last will and testament, and requested us to subscribe our names thereto as witnesses and we in his presence and of the presence of each other in compliance of such request have hereunto subscribed our names. - III - That said will makes no provision for any one to carry said trust, or to distribute the funds of said estate: that the estate of deceased is in great need of the care and attention of some one to manage and control the affairs thereof, and to conduct the business of connected therewith; that with the exception of the bequests mentioned in said will, the said property was to be and to remain the property of the widow of the deceased, during her natural life.

- IV - That on or about the 2nd day of December, 1899, the said Elizabeth McClellan died that after the death of the said R.G. McClellan, the said Elizabeth McClellan never remarried; that she left no other heirs at law, other than the ones hereinbefore mentioned, who were the children of the said R.G. McClellan and the said Elizabeth McClellan.

- V - That the other heirs of said estate are anxious and willing that your petitioner should be appointed to administer upon the said estate.

WHEREFORE, Your Petioner prays that an order may be entered directing and requiring the said J. H. Koontz to surrender and deliver up the said last will and testament of the said R.G. McClellan, deceased, into the custody of this Honorable Court, so that the same may be probated; and that said order direct and require the said J. H. Koontz to deliver up the said last will and testament forthwith; that your petitioner may be appointed to administer upon the said estate, and to carry out the said trust in accordance with the terms and conditions of the said last will and testament of the said deceased.
