Biography

Rachel Meador was the daughter of John Meador and Elizabeth White, of Essex County, Virginia. She first appears in the records on 10 Dec 1694 when she is named in a deed of gift from her father prior to his second marriage. She was said to be under the age of 10 at that time, although her actual date of birth is unknown.[1][2]

Rachel presumably married William Jordan sometime before 1721, when she is mentioned by her married name in her father's will.[3] Jonas Jordan, born 1725 in Essex County, Virginia, is presumably their son, although there are no records to that effect.[4]

William Jordan probably died sometime before 1732, when Rachel, along with William Terrell, appeared in court in Caroline County, Virginia, charged with adultery. The charges were dropped.[5] Presumably William Terrell agreed to provide financial support for Rachel's child,[6] probably a daughter named Johanna Jordon.[7] Rachel and William Terrell may also have had a child named Jeremiah Jordan.[8]

In 1739 Rachel, along with William Hudson/Hutson, sold the property in Essex County, Virginia she had inherited from her father. Again, in 1768, while living in Amelia County, Virginia, she sold land that had come to her through her brothers. Rachel died sometime after that, although when is not known.[9]

July 16, 1739: Essex County, VA

"THIS INDENTURE made the Sixteenth day of July in the year one thousand seven hundred and thirty nine Betweeen RACHEL JORDAIN and WILLIAM HUTSON of CAROLINE COUNTY of one part and THOMAS MEADOR of County of Essex and Southfarnham Parrish of other part Witnesseth that said RACHEL JORDAIN and WILLIAM HUTSON in consideration of the sum of Five thousand pounds of good merchantable Tobacco and Twenty six shillings Currt. money of Virg& to them paid hath granted unto him the said THOMAS MEADOR his heirs or assignes for ever all the Estate whatsoever which is or shall hereafter become due to the said RACHEL JORDAIN and WILLIAM HUTSON to a certain Divident of Land in the County of Essex and Southfarnham Parish containing one hundred and five acres being part of a tract of land of fifteen hundred and sixty three acres granted by Pattent to Mr. EDWIN THACKER deced the 20th day of April 1687 which said one hundred & five acres of land being formerly purchased by JOHN MEADOR of the sd EDWIN THACKER as by a Deed to him thereof made dated the Seventh day of August One thousand Six hundred & Eighty Nine may appear and bounded Beginning at a Corner Hickory in the line formerly JOHN MEADORs and running thence South by West to a red oak standing by the ROAD side leading to the CHURCH from thence South West to a Corner Hickory on a Levell thence North by East to a Corner white oak standing on a hill side in the sd MEADORs line thence along the sd MEADORs line to the beginning, with all houses & hereditaments to the same belonging To Have and To Hold the said land unto the said THOMAS MEADOR his heirs and assigns. In Witness they the said RACHEL JORDAIN & WILLIAM HUTSON have set their hands and seals in presence of THOMAS MEADOR JUNER, RACHEL JORDEN, JOHN MEADOR JUNR., ELIZA. MEADOR W. HUTSON. At a Court held for Essex County at Tappa. the XVIlth day of July 1739." [10]

October 13, 1739: Essex County, VA

"William Allen: From Thomas Meador & wife Elizabeth. 52 1/2 ac. at head of Spring Branch; for 2325 Lbs of Tobacco. Being 1/2 of 105 ac bought by John Meador, 8/7/1689; also land bought by Thomas Meador of Rachel Jordan & William Hutson, 10/13/1739.[11]

I am wondering if the biography is incorrect to consider William dead at the time Rachel was charged with adultery? I believe if Rachel's husband was dead, the charge would have been fornication. But since it was adultery, it seems to imply that William was still living.

An interesting question. Do you know if Virginia made a distinction between adultery and fornication in that time and place? Or was the primary concern, as suggested by the source, primarily to avoid having to pay for an unwanted child?

I found this:

"The meaning of adultery at English common law was clear and tracked its definition under Biblical law: it encompassed only the situation in which a MARRIED woman had sexual intercourse with a man—single or married—who was not her husband." 70 http://www.histarch.illinois.edu/plymouth/Lauria1.html (Emphasis added).

Virginia would have been under English common law at that time. Based on this, I believe William was still alive at the time Rachel was charged with adultery.

I don't think that's enough to say that William was still alive. All it really says is that she is still considered his wife in legal terms, having been married to him and not yet married to anyone else. If he were still alive and she was publicly having children with another man, I would expect there to be more court cases than providing for the care of her children. Where is he during this time, and what is he doing? There really needs to be better evidence for his being alive.

Legally, one wouldn’t be considered married, though, if their spouse had died.

Guess it's time to step back and recognize that this is a discussion about a word in a derivative source, and we have no indication of what the original source said; also that we have no indication, based on references to original sources, that people in this time and place did actually make a distinction between adultery and fornication for a widowed woman.
